About this file
This is a Claim of Business Confidentiality submittal form issued by the Utah Department of Transportation (UDOT) Procurement Services in connection with the UDOT Regional Welding and Fabrication Services Request for Proposals. The form allows bidders to assert claims of business confidentiality for sensitive information submitted as part of their proposals, in accordance with Utah Code Annotated Subsections 63G-2-305 and Section 63G-2-309. Bidders may claim confidentiality protections for non-public financial statements, specific employee information, customer lists, subscription lists, or other specified information that constitutes trade secrets or commercial information meeting the statutory definition. The form requires bidders to identify the specific pages and paragraphs of their proposals for which confidentiality is claimed and provide supporting reasons demonstrating that disclosure would result in unfair competitive injury or impair UDOT's ability to obtain necessary information in the future.
Pricing and cost proposals are explicitly excluded from confidentiality protection and will be considered public information. Entire proposals cannot be designated as protected, confidential, or proprietary in their entirety. Bidders will receive notification if UDOT determines that information claimed to be protected should be classified as public or released after the agency weighs the competing interests under applicable Utah statutory provisions. The form requires the submitting company representative to sign and date the claim, with the revision date noted as June 4, 2015.
