About this file
This is a Claim of Business Confidentiality Form submittal document for the Utah Department of Transportation (UDOT) Region 3 Repair of Hydraulic Lift Apparatus Invitation for Bid (IFB). The solicitation seeks contractors to repair hydraulic lift apparatus of all brands for the Basin Area under the Utah Procurement Code. Bidders must demonstrate compliance with stated specifications and requirements through sufficient documentation and information. The form permits bidders to designate specific proposal information as confidential or protected, subject to Utah Code Annotated provisions governing trade secrets and commercial information.
Bidders may claim business confidentiality for non-public financial statements, specific employee names and contact information, customer information, client lists, or other specified proprietary information that derives independent economic value from non-disclosure or would result in unfair competitive injury if disclosed. However, pricing and cost proposals cannot be classified as confidential and must be considered public information. Furthermore, an entire proposal cannot be marked as protected, confidential, or proprietary. Bidders asserting a business confidentiality claim must specify the page, paragraph, and reason for each protected item and submit the form with their proposal. The governmental entity will notify bidders if claimed protected records are classified as public or released after weighing relevant interests under applicable Utah Code provisions.
