About this file
This is a Maintenance Bond document for the City of Fort Worth, Texas, related to the 2027 Asphalt Resurfacing Contract 3 (City Project No. 106794). The bond secures the contractor's obligation to maintain the completed work in a defect-free condition for two years following final acceptance by the City. The project involves substantial infrastructure work including 7,840 linear feet of curb and gutter, 15,700 square feet of concrete driveway, 709 square yards of concrete valley gutter, 72,984 square yards of asphalt pavement (Superpave SP-D), 72,984 square yards of pavement pulverization, and 1,168 tons of cemlime.
The maintenance bond requires the principal contractor and a corporate surety authorized to conduct business in Texas to guarantee performance during the maintenance period. If the contractor fails to remedy any defective work identified by the City within the maintenance period, the City may repair the work at the contractor's and surety's expense. The bond is continuous in nature, allowing successive recoveries for successive breaches. Venue for any legal action lies in Tarrant County, Texas or the United States District Court for the Northern District of Texas, Fort Worth Division. The bond must be executed by duly authorized officers and backed by certified bylaws documentation, and its date cannot predate the contract award date.
