About this file
This is a Procurement Certification for Disclosure of Lobbying Activities form issued by the State of Florida Department of Transportation in compliance with 49 CFR Section 20.100(b), applicable to the City of Fort Myers' Sanitary Sewer Evaluation Survey Program On-Call Contractors solicitation for underground utilities and infrastructure services. The certification requires prospective participants to confirm that no federal appropriated funds have been or will be paid to influence officers or employees of federal agencies, Members of Congress, or congressional staff in connection with the awarding of this federal contract or related federal funding. Contractors must submit this certification as a prerequisite for contract participation, and the form requires completion by an authorized representative with signature, title, and date.
The certification establishes mandatory compliance requirements under Section 1352 of Title 31, U.S. Code, with civil penalties ranging from $10,000 to $100,000 for each failure to file required disclosures. If non-federal funds are used for lobbying activities related to this contract, participants must complete and submit Standard Form-LLL, Disclosure of Lobbying Activities, according to its instructions. Additionally, all prospective participants agree to require this certification language be included in all lower-tier subcontracts exceeding $100,000 and that all subrecipients certify and disclose accordingly. This disclosure requirement applies to the on-call contract with multiple awards for comprehensive utility and stormwater management contracting services across Lee County, with proposals due September 11, 2025, and City Council approval anticipated for October 20, 2025.
