About this file

This file is a Questions and Answers document for RFQ 36C78626Q0116, a Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside procurement issued by the Department of Veterans Affairs National Cemetery Administration for fertilizers and chemicals at Florida National Cemetery in Bushnell, Florida. The document clarifies key specifications and regulatory requirements for potential offerors responding to this solicitation.

The Q&A addresses critical product specifications and regulatory compliance matters. Regarding delivery, all herbicides will be accepted at once rather than staggered throughout the year. The SBA Nonmanufacturer Rule class waiver applies to this procurement for herbicides, insecticides, and fungicides under NAICS 325320, allowing small businesses to supply these products without meeting standard nonmanufacturer requirements. The document provides critical clarifications on two products: CLIN 0002 specifies Strobe (Azoxystrobin 50%) as a dry formulation sold in 20 x 1-pound containers (totaling 20 pounds), not gallons as originally listed; CLIN 0018 specifies Recognition (Trifloxysulfuron 20.4%) with 1.95 ounce containers being acceptable instead of the originally specified 1.3 ounce containers, with quantity remaining at 10 bottles. These clarifications reference updated Statement of Work and Cost Schedule documents. Quote responses were due by 10:00 AM on September 14, 2026, with award anticipated on a firm fixed-price basis with award without discussions intended.

RFQ 36C78626Q0116

1. Question: Please advise if the customer is able to accept all the herbicides at once or if they will be requested over the course of the year. If they are staggered, please advise on a typical baseline program.

Answer: Accepting all the herbicides all at once.

2. Question: We identified an SBA Nonmanufacturer Rule class waiver for herbicides, insecticides, and fungicides under NAICS 325320. Because this RFQ is classified under PSC 6810 and includes multiple chemical product types, please confirm whether an SBA Nonmanufacturer Rule class waiver is applicable to the products required under this RFQ.

Answer: Yes, the SBA Nonmanufacturer Rule class waiver is applicable to the products required under this RFQ.

SBA has a current class waiver for herbicides, insecticides, and fungicides under NAICS 325320, allowing small businesses to supply these products on certain federal set‑aside contracts without meeting the Nonmanufacturer Rule.

3. Question: As this is a multiple-item supply acquisition and the solicitation incorporates VAAR 852.219-76, please confirm whether an SBA Nonmanufacturer Rule waiver, either class or individual, applies to this procurement or any of the chemical products listed in Attachment A.

If no waiver applies, please confirm whether an SDVOSB nonmanufacturer must ensure that at least 50% of the estimated contract value consists of products manufactured by domestic small-business manufacturers in accordance with 13 CFR 121.406(d).

Please also confirm which version/tailoring of VAAR 852.219-76 the Government requires the offeror to complete and return with Volume A.

4. Question: The price schedule identifies the product as “Strobe (Azoxystrobin 50%)” and specifies a quantity of 20 x 1-gallon containers, totaling 20 gallons. Our supplier has advised that Strobe 50WG is a dry 50% azoxystrobin formulation, rather than a liquid product sold in gallon containers.

Please clarify the intended formulation, package size, and required quantity for CLIN 0002 so that offerors may submit compliant pricing.

Answer: The product listed in the solicitation is sold by the dry pound not liquid ozs. Product should have been listed in pounds (Lbs.) instead of Gallons (Gal). 20 x 1Lb containers, totaling to 20lbs is the correct size and quantity. See updated SOW and Cost Schedule.
