Will pay applications for materials secured on site or in a bonded warehouse be approved for payment?
In accordance with contract terms and conditions, Contractors should not bid assuming the Government will approve payment for material and/or equipment procured by the Contractor and stored on the construction site, as space is available, or at a local approved location off the site. Payment of stored materials and/or equipment is at the Contracting Officer’s discretion and will be handled on a case-by-case basis during the contract and under such terms and conditions as the Contracting Officer approves.

Due to the current economic inflation, Will the government reduce the amount of time that contractors must hold their numbers to 60 days? By reducing the inflation risk, the government will avoid escalations costs that general contractors and subcontractors must account for.
The Government standard concerning price-hold period is 90 calendar days and will not be altered.
1.
9-23-24
10-9-24
Will the government consider the inclusion of an Economic Price Adjustment Clause in accordance with Federal Acquisition Regulations (FAR), Subpart 16.203 "Fixed-price contracts with economic price adjustment" and the related contract clause language in FAR 52.216-2, 3, 4? We believe such a clause is appropriate for the following reasons:
· The contract involves an extended period of performance with significant costs to be incurred beyond 1 year after performance begins;
· The contract amount subject to significant fluctuations in price is substantial [may want to list specific examples of highly unstable pricing items within the scope]; and The economic variables for labor and materials are too unstable to permit a reasonable division of risk between the Government and the contractor, without this type of clause."
This procurement will remain as a firm fixed priced award. The government will not consider this request.

Is the VA willing to pay for materials stored on and/or offsite such that it meets requisite FAR and VAR clauses for stored materials. There are materials which have a 12+ week lead time which SDVOSB firms cannot procure up front without taking on the financial risk, any schedule impacts could cause irreparable harm financially. Proof of materials possession would include vendor invoices, materials under security systems, insured and bonded, photos of materials, and inspection upon request.

Due to current potentially significant tariffs being placed on the importation of building materials such as wood or steel by the current Presidential Executive Branch, if a tariff is placed after bid time and before award will the government consider a price escalation on a contract value for products such as steel or wood should the executive branch levee tariffs effecting such materials? Most of these materials would still have been Buy American compliant as the tariffs would increase pricing on all steel or wood materials, regardless of origin.
This will be awarded as a Firm Fixed Price (FFP) contract and all escalation should be factored in your FFP. Additionally, FAR 52.216-4 “Economic Price Adjustment – Labor and Material” is not included in the solicitation and will not be added.

Per FAR 52.236-2, allows for differing site conditions that arise during construction, which may come at a cost to the VA. Changes to the contract will follow FAR 52.243-1/4 |

Can the VA confirm that the frame may not have a double vertical stud on each side?
Bids should include removing and reinstalling the door and frame. See keynote #9, demolish existing wall and base. The existing frame will be rebuilt per the plans.
