About this file

This is an Amendment/Modification to a Request for Proposal (RFP) for construction services at the Sioux Falls VA Health Care System. The solicitation (36C26326R0027) is a 100% Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside issued by the Department of Veterans Affairs Network Contracting Office 23 in Omaha, Nebraska. The project, PN 438-22-600 "Improve Campus Bldg. Exteriors (SF)," involves building roof replacement and exterior improvement work at 2501 W 22nd Street, Sioux Falls, SD 57105, with a maximum performance period of 700 calendar days after Notice to Proceed. The amendment corrects the requisition number from 438-26-3916-0001 to 438-26-4-3916-0018 and provides the "Instructions to Bidders" document that was not previously posted.

Proposals must be submitted via email to Michael.Freeman3@va.gov as PDF files no later than the deadline specified in SF1442 Block 13.A (subject to amendment). The government will evaluate proposals using a Lowest Price Technically Acceptable (LPTA) approach, with evaluation based on four factors: (1) Technical/Schedule (non-price), (2) Experience—minimum three to five building roof replacement projects valued at $10,000,000 or above completed within the last five years (non-price), (3) Key Personnel Experience—Project Manager, Site Supervisor, Safety Manager, and Quality Manager with collective experience on projects valued at $10,000,000 or above (non-price), and (4) Price (evaluated for reasonableness). Required submittals include signed SF1442, VETS-4212 verification, current SBA Veteran Small Business Certification, Limitation of Subcontracting Certificate of Compliance, technical proposal (30-page maximum), experience documentation (20-page maximum), key personnel resumes (20-page maximum), bid bond, and detailed price proposal with breakdown. A pre-proposal site visit is scheduled for July 23, 2026, at 10:00 AM CT, and the technical question cut-off is August 10, 2026, at 10:00 AM CT. All offerors must be registered in SAM at proposal submission and award, verified in the SBA Small Business Search at both offer and award times, and compliant with CPARS registration requirements for contracts exceeding $900,000.

4. SELECTION PROCEDURES

This is a Request for Proposal in accordance with RFO Part 15. The Government will award a contract resulting from this solicitation to the offeror whose offer conforming to the solicitation is determined by the Source Selection Authority to provide the best overall value to the Government utilizing the Lowest Price Technically Award (RFO 15.103-2) method of evaluation. It is the intent of the Government to award without discussion; however, the Government reserves the right to engage in discussions. If the Contracting Officer decides that discussions are in the Government’s best interest, they will be conducted in accordance with RFO 15.306.

9. DETERMINATION OF RESPONSIBILITY

A Determination of Responsibility will be conducted for the apparent “awardee” prior to award of the project. The required information from the proposal, along with other information obtained from Government systems, such as, but not limited to the OSHA and EPA online inspection history databases, as well as any other information the Contracting Officer has determined to be valid, will be used to make the Determination of Responsibility. NOTE: Any information received by the Government that would cause for a negative Determination of Responsibility may make the Offeror ineligible for award.

10. VETS 4212

Title 38, USC Section 4212(d), codified at 41 CFR Section 61-300, requires that federal contractors report, at least annually, the number and category of veterans who are within their workforce. Submission of the VETS-4212 reporting information can be done electronically at: https://www.dol.gov/agencies/vets/programs/vets4212. Award cannot be made unless the awardee has filed their VETS-4212 report. Therefore, all offerors are encouraged to file every year. The Contracting Officer may request a copy of the email confirmation of receipt notification, prior to awarding the project.

11. SYSTEM FOR AWARD MANAGEMENT (SAM)

Federal Acquisition Regulations require that federal contractors register in the System for Award Management (SAM) database at http://www.sam.gov and enter all mandatory information into the system. Offerors are required to be registered at the time of proposal submission and at time of award. Offerors are encouraged to ensure that they are registered in SAM prior to submitting their proposal.

12. REVIEW REQUIRED REGISTRATION WITH CONTRACTOR

Contractor Performance Assessment Reporting System (CPARS): As prescribed in RFO Part 42.1102(e), the Department of Veterans Affairs (VA) evaluates contractor past performance on all construction contracts that exceed $900,000 and shares those evaluations with other Federal Government contract specialists and procurement officials. The RFO requires that the contractor be provided with an opportunity to comment on evaluations prior to each report closing. To fulfill this requirement VA uses an online database, CPARS. CPARS also includes access to the federal awardee performance and integrity information system (FAPIIS). FAPIIS is a web-enabled application accessed via CPARS for contractor responsibility determination information. Each contractor whose contract award is estimated to exceed $900,000 is required to register with CPARS database at the following web address: http://www.cpars.gov/. Help with registering can be obtained by contacting Customer Support Desk DSN: 684-1690 or COMM: 207- 438-1690. Registration should occur no later than thirty days after contract award and must be kept current should there be any change to the contractor’s registered representative. For contracts with a period of one year or less, the contracting officer will perform a single evaluation when the contract is complete. For contracts exceeding one year, the contracting officer will evaluate the contractor’s performance annually. Interim reports will be filed each year until the last year of the contract, when the final report will be completed. The report shall be assigned in CPARS to the contractor’s designated representative for comment. The contractor representative will have thirty days to submit any comments and re-assign the report to the VA contracting officer. Failure to have a current registration in the CPARS database, or to re-assign the report to the VA contracting officer within those thirty days, will result in the Government’s evaluation being placed on file in the database with a statement that the contractor failed to respond.

13. BACKGROUND INVESTIGATIONS AND SPECIAL AGREEMENT CHECKS

All contractor employees are subject to the same level of investigation as VA employees who have access to VA Sensitive Information. The level of background investigation commensurate with the level of access needed to perform the statement of work is: Low Risk. This requirement is applicable to all subcontractor personnel requiring the same access. As per VA Directive 0710, costs of background investigations will be borne by the contractor. Please be advised that the awardee will need to coordinate with the VA Medical Center concerning badging requirements.

14. SPECIAL NOTES REGARDING RFO 52.229-3: FEDERAL, STATE, AND LOCAL TAXES

Offerors are hereby notified that all state and local sales or use taxes for construction materials must be included in their bid or proposal price. It is solely the responsibility of the offeror to include all other applicable taxes in their bid or proposal price as well. The Government has determined that for this acquisition it cannot take advantage of any sales or use tax exemptions that may be available to it under applicable state law. Under no circumstances will any Contractor be designated as an agent of the Government for purposes of any tax exemption, nor will the Government authorize any Contractor’s use of any tax exemption directly applicable to the Government under this procurement.

15. REFERENCES TO VA ENGINEER, RESIDENT ENGINEER OR PROJECT MANAGER Any reference contained within the solicitation/contract specifications and/or drawings to the “VA Engineer,” “Resident Engineer,” or “Project Manager” or their abbreviations shall be replaced with “Contracting Officer’s Representative (COR).”

7. EVALUATION FACTORS AND BASIS FOR AWARD

Proposals will be subject to an initial screening for compliance with proposal preparation instructions. Failure to comply will result in a proposal being excluded from competition without further evaluation of the proposal beyond the initial screening.

It is the Government’s intent to award one (1) firm-fixed price contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, is fair and reasonable, and has been determined to be the most advantageous to the Government, price and other factors considered. The Government will use the lowest price technically acceptable source selection approach (RFO 15.103-2) to evaluate proposals and award the contract. An award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the requirements for acceptability on all non-price factors.

Proposals will be subject to an initial screening for compliance with proposal preparation instructions. Failure to comply will result in a proposal being excluded from competition without further evaluation of the proposal beyond the initial screening. The CO will conduct a “proposal compliance review” for determination of basic proposal adequacy.

Proposal adequacy refers to the baseline state where a proposal is complete, accurate, compliant with all solicitation instructions, and supported by enough data to justify the proposed price and technical approach.

The following factors should be used to evaluate offers:

1. Technical Evaluation Factors/Schedule (non-price factor).

2. Experience (non-price factor).

3. Key Personnel Experience (non-price factor).

4. Price

Factor 1 – Schedule (non-price factor) The Offeror shall provide a draft project schedule for construction that adheres to the period of performance of this project. Each Offeror’s construction schedule shall address the following:

1. Be in the form of a progress chart of suitable scale to indicate the work scheduled for completion by any given date during the work period.

2. Construction period milestones, phasing, and timeframes.

3. Sufficient information to indicate full understanding of the project scope.

4. Identification of long lead materials/equipment

5. Consideration of work delays due to seasonal weather The Government will evaluate the extent to which the draft project schedule includes all requirements above and demonstrates the offeror’s understanding of and ability to perform all required elements of the project in the timeframe specified with limited impact to the Sioux Falls VA Health Care System (SFVAHCS). The draft project schedule must include the activities which are consistent with those described within the project drawings, specifications, and Scope of Work documents and must not exceed the Governments maximum allowable performance period. The period of performance for this project is 700 calendar days after the Notice to Proceed. For scheduling purposes, assume an estimated award date of 28 May 2026, and that the Notice to Proceed will be issued fourteen (14) calendar days after the award date, 28 May 2026. The Offeror shall prepare and submit a reasonable construction schedule showing all necessary work elements to complete the project identified under this solicitation. The schedule must be in the form of a progress chart of suitable scale to indicate appropriately the percentage of work scheduled for completion by any given date during the performance period. The submitted schedule must be developed using project scheduling software such as MS Project, Primavera, or any other comparable form. These items must be submitted and to be considered the standard for technical acceptability.

.Factor 2 - Experience (non-price factor):

The offeror shall submit a minimum of three (3) and a maximum of five (5) Building roof replacement projects completed within the last 5 years valued at $10,000,000.00 or above. The offeror shall explain how the scope of the provided projects is relevant to this current project and the projects selected should clearly demonstrate the construction capabilities of the Offeror. The offeror should also provide the start and completion dates (original and actual) for each project provided.

In order to be rated as technically acceptable, the offeror’s proposal must include at least three building improvement exterior projects that meets the requirement in the established timeframe.

Factor 3 – Key Personnel Experience/Team Qualifications (non-price factor) The Offeror shall provide a resume for each of the following key construction personnel: Project Manager, Site Supervisor, Safety Manager, and Quality Manager. For each resume, include company name; name of individual; relevant listing of experience; qualifications such as specialized training, and education. Each member of the key personnel should possess construction experience that add up to at least $10,000,000.00 in monetary value.

In order to be rated as technically acceptable, the offeror must provide a resume for each key construction personnel listed above with the required content. In addition, each member must possess experience working on construction projects that are valued at $10,000,000.00 or above.

Factor 4: Price Price will be evaluated to determine the lowest priced technically acceptable vendor.

The offeror’s proposed price will be evaluated for price reasonableness. Price reasonableness will be established using any necessary price/cost analysis techniques in RFO 15.404-1, including but not limited to price competition information and the Independent Government Cost Estimate (IGCE).

The Price Breakdown Schedule - will it factor into the LPTA analysis and also it will be used to determine price reasonableness.

An award cannot be made if the lowest priced, technically acceptable offeror’s proposal exceeds available funding or cost limitations, if applicable.

8.0 EVALUATION PROCEDURES

During the source selection process, disclosure of proprietary or source selection information will be governed by RFO 3.104-4 and 15.3. Each proposal received by the Contracting Office will be identified, marked, and secured. Proposals will be accepted via email only. The subject line for all electronic correspondence involving the source selection process, including offers, will include “For Official Use Only”. The individual proposals and evaluation worksheets will be controlled by the Contracting Office and issued to the evaluators for their review. Source Selection Sensitive Information will always be secured.

The Contracting Officer shall award a contract to the successful offeror by furnishing the executed contract or other notice of award to the company that submitted the lowest priced offer that is also found technically acceptable. The Contracting Officer shall also post an Award Notice to https://sam.gov and make any required Congressional Notifications for awards over $5.5 million per RFO 5.302 (a) unless an exception exists.

The Contracting Officer shall also send unsuccessful offeror letters to each offeror whose proposal was not selected for award, within three days after contract award. Debriefings will be provided to unsuccessful offerors who submit timely requests in accordance with RFO 15.505 and RFO 15.506.

The TEB is going to evaluate all proposals and then identify the lowest for award (provided the pricing is fair and reasonable

Intent for No Discussions: Offerors are hereby advised that the Government intends to evaluate proposals and award a contract without conducting discussions with offerors. However, the Government reserves the right to contact Offerors and/or hold discussions if the Contracting Officer determines them to be necessary. Offerors are cautioned that discussions may not be conducted, and Offerors should not assume that they will have an opportunity to revise their proposals after submission.
