About this file

This document amends the solicitation for patient ceiling lifts to change the evaluation criteria. The solicitation issued by the Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 22 seeks quotes for 65 patient ceiling lifts. The amendment changes the evaluation from a tradeoff between repair services and price to selecting the lowest priced offer meeting acceptability. Acceptability will be determined by verifying any brand name items meet the solicitation's salient characteristics. The contract award will go to the lowest total price including any option prices.

Changes to section E.5 FAR 52.212 Evaluation.

This amendment to Solicitation change the verbiage on Section E.5. FAR 52.212 Evaluation FROM:Please scroll down to “To:” section see changes

E.5 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

a. Offers submitted for this procurement will be evaluated using FAR Part 13 procedures. The Government intends to award one contract resulting from this solicitation to the responsible Offeror, whose offer conforming to the solicitation, is most advantageous to the Government, as determined by a trade-off between the price and non-price proposal evaluation factors identified below.
b. The Government will evaluate the following factors as part of the trade-off analysis:

FACTOR 1- REPAIR SERVICE, PREVENTIVE MAINTENANCE AND EXTENDED WARRANTY PLAN. This factor will be used to assess the offeror’s plan to provide repair services, preventive maintenance, and extended warranty to the proposed Patient Ceiling Lifts for delivery at PVAHS.

FACTOR 2 – PRICE. This factor will be used to assess the reasonableness of the offeror’s proposed pricing.

For the purposes of the trade-off analysis, evaluation factors are listed in descending order of importance. Factor 1 – “Repair service, preventive maintenance and extended warranty plan” is more important than Factor 2 – “Price” for the purposes of determining the best value to the Government. Therefore, the Government may award to other than the lowest priced Offeror if it is in the Government’s best interest to do so.

c. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

d. A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of Provision) This amendment to Solicitation change the verbiage on Section E.5. FAR 52.212 Evaluation TO:

E.5 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government with the lowest overall price (overall price includes estimated costs submitted by the Offeror in Table A). The following factors shall be used to evaluate offers:

Acceptability shall be established by review of each submitted quote, attachments, and/or information by the Agency and verification that any “brand name” or “equal to” items meet all the salient characteristics included in this solicitation.

Once acceptability has been established, the Contracting Officer shall award to the Lowest Price (including estimated costs submitted by the Offeror in Table A).

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
