Contracting Officer
Question and Answer – Amendment 0007
1) QUESTION: Amendment 4 did not answer the question if the new contractor will inherit the patient’s last Primary Care vesting visit. The references indicated vesting procedures for new patients. Will the contractor inherit the existing vesting date of all currently enrolled veterans or will the new contractor be required to vest every patient beginning on day 1 of the new contract?
ANSWER: Yes, the contractor will inherit the existing vesting date of all currently enrolled veterans
2) QUESTION: The current CLINs starts at 4447 enrollees, but current billable enrollment is 3,572. Will the government adjust the CLINs to accurately reflect billable enrollment?
Doing so will save the government a considerable amount of money over the life of the contract, as contractors are forced to plan to staff at a higher level than will be required.
We do not believe that this clinic can grow by 900 patients in the first year and therefore the cost to the government will continue to cascade over the ten-year life of the contract.
ANSWER: The CLINs will remain unchanged. The contractor is expected to staff to PACT PCMM guidelines for those patients assigned in PCMM. Please reference section 2.1. MINIMUM PATIENT ALIGNED CARE TEAM (PACT) STAFFING
REQUIREMENTS of the PWS.
3) QUESTION: Page 14 – to clarify question pertaining to p17, 2.2, can board eligible physician candidates be considered for VA credentialing and hiring?
ANSWER: ANSWER: No, per section 2.2 – “Physicians performing under this contract shall be board certified by the ABMS in Internal Medicine and/or Family
Practice or the BOS in Internal Medicine and/or Family Practice. Physicians shall be licensed in the state where the Outpatient Site of Care (i.e. CBOC) is located”
4) QUESTION: Will use of telemedicine be allowed in the form of VVC or telephone visits to provide care for the veterans during and after COVID?
ANSWER: Please reference the following sections in the PWS:
SECTION 6.2.2.1.4 Billable Roster - which includes Primary credit cod of 338
(Telephone Primary Care) and secondary credit code 179 (Real Time Clinical Video
Telehealth to Home Provider Site)
5) QUESTION: Will VVC visits be eligible for vesting during and after COVID?
ANSWER: Please reference the following sections in the PWS:
SECTION 6.2.2.1.4 Billable Roster - which includes Primary credit cod of 338
(Telephone Primary Care) and secondary credit code 179 (Real Time Clinical Video
Telehealth to Home Provider Site)
6) QUESTION: Please confirm that if a contractor proposes the existing facility it will need to meet the same seismic standards as a different location and cannot be grandfathered.
ANSWER: The contractor is required to comply with the terms and conditions of its contract with VA when providing CBOC services to VA. To the extent the contractor has questions about its obligations with respect to California state law, the contractor should seek guidance from its legal counsel or guidance from the
State of California.
7) QUESTION: In the last question answered in amendment 4, the government was asked about 90 vs. 180 day start up conflict in the RFP. The government replied with the following “Section 6.1.2 – total of (83 days to have all start-up requirements in place +
90 days for the commencement of medical care +7 days raining & resolution of any last-minute challenges = 180 days). The answer is unclear. Will contractors be expected to begin seeing patients 90 days or 180 days after award?
ANSWER: Section 6.1.2 has been updated to the following: “The Contractor shall have one hundred and twenty (120) days from contract award to commencement of the provision of medical care to local veterans. However, the Contractor shall have all start-up requirements in place and ready to commence operation NLT one hundred and thirteen (113) calendar days from contract award. The final seven (7) days will be used for training and resolution of any last minute or unexpected technical or personnel related challenges.” The contractor is expected to begin seeing patients 120 days after award.
8) QUESTION: With regard to physical security the VA references attachment Real
Property Memorandum 2018-02 Physical Security Standards for Leased Facilities
(Existing Space and Lease Construction Projects) VAIQ 7866496. This document addresses window film added to existing glazing to protect the perimeter shell, in doing so the document under Structure references the GSA guidelines for performances standards. The GSA guidelines for physical security require barriers to protect or defend the perimeter at entrance points. Are both window film and barriers required?
ANSWER: Correction - the Real Property Memorandum is not approved. Please see attached VA Handbook 0730 and Physical Security Design Manual (PSDM).
Handbook 0730 is a law enforcement document and not limited to physical security.
The facility must comply with Handbook 0730 for the law enforcement aspects of the facility, and the PSDM will only complement those requirements.
9) QUESTION: As we consolidated our understanding of the space requirements we have found a significant discrepancy in the size of the VA Lease space requested and the specific rooms requested to be included within the VA leased Space as well as the hallways required to support access to the space.
Section F of the Solicitation the Government requires:
• 15 mental health offices at 125 square feet each totaling 1,875 square feet
• 1 mental health storage room at 100 square feet
• 2 group therapy rooms at 300 square feet each totaling 600 square feet
• A reception area to accommodate 2 check-in stations and a security guard
• A dedicated waiting room
Section 4.1 Space Requirements requires:
• General space requirements for the clinic will be based on PG 18-9 (dictates size of waiting room and reception area)
In Amendment 004:
• The VA requests the number of bathrooms required per code which = 2 bathrooms (one each for Male and Female) based on up to 25 males and 25 females in the space.
• Space requires a separate entrance only accessible by authorized personnel
When you add all the square footage requirements of the Mental Health offices, storage and group therapy rooms this total 2,575 which ties exactly to the VA leased space requirements as shown in the Request for Lease Proposal document (Attachment D21
Section F).
The conflict arises when we take into account the additional reception area, the dedicated waiting room, the 2 bathrooms and the hallways required to provide access to the rooms outlined above as well as the required exits. When added together, the square footage is more than double than the 2,575 square foot requested in the Lease Proposal Document.
Please provide either an explanation of the discrepancy or an updated detailed space requirement that aligns with the size of the space requested in the Lease Proposal
Document.
ANSWER: Please see attached Updated Section F and Attachment D21. Changes are highlighted in Yellow.
10) QUESTION: In section F item 1.01.4 is states that: “offices shall be soundproof to maintain confidentiality”. In PG-18-3 it recommends a minimum Sound Transmission
Class (STC) rating of 45 and the VA provides a recommendation to achieve this rating by
“using construction such as a double layer of 16 mm (5/8 in.) gypsum board (GB) on both sides of 100 mm (4 in.) nominal metal studs and 64 mm (2 1/2 in.) sound attenuation blankets between the studs. These should extend above conventional lay-in ceilings to the underside of walk-on deck/platforms”. Is the guidance in PG-18 adequate for the VA leased space? If Not, please provide the appropriate minimum Sound Transmission Class
(STC) Rating for the Mental Health offices and Group Rooms.
ANSWER: Please refer to attached “PG-18-3 Noise Transmission Control” for best method to use. Please do not divert from these standards. These design and construction procedures are mandatory where specific statutes and/or regulatory references are included in the Topic text.
11) QUESTION: In Section F paragraph 1.06 Labor Standards of the Solicitation is specifically identifies that the Davis-Bacon Act applies to the VA Leased space. It is also noted that the Solicitation for the Primary Care CBOC does not contain reference to the same Labor Standards or related applicable Davis Bacon Act construction Federal
Acquisition Regulation (FAR). According to [Section 4.11 of the Solicitation], an offeror must provide substantial construction work in accordance with detailed specifications that appears to be physically and functionally segregable from service work set forth in the
Statement of Work and [the agency] will pay, directly or indirectly, for this construction work.
a. As such, please confirm that the Davis-Bacon Act and related FAR clauses also applies to any of that work set forth in the Solicitation as it relates to the
Escondido primary care clinic (CBOC) and that Davis Bacon Act wages should be used for pricing work under Section 4.11.
ANSWER: Yes, the Davis Bacon Act applies to all construction work necessary to meet the requirements specified in the PWS for the contractor-operated portion of the Escondido CBOC. Please see updated language in
PWS section 4.11 – highlighted in yellow.
b. Please also expressly identify the portion of the work for which the requirements of FAR 52.222-6 applies, when FAR 52.222-6 will be incorporated into the
Solicitation, and which wage determination(s) will be incorporated into the
Solicitation so offerors can have a common basis for pricing the portion of work subject to FAR 52.222-6.
ANSWER: The Davis Bacon Act applies to all construction work that will be performed under this procurement for both the contractor-operated portion of the CBOC and the space in the CBOC that is leased to VA. FAR 52.222-6 has been incorporated into the solicitation. Contractors shall follow Davis-
Bacon Wage Determination - General Decision Number: CA20200001 09/04/2020
12) QUESTION: In paragraph 4.11 of the solicitation is Specifically states that “Contractor shall provide space that meets the standards outlined in the PACT Space module Design
Guide. The VA’s response to questions in the original Q&A states that the contractor does not need to comply with the on-stage/off-state design and the PACT Zone requirements which are both part of the PACT Space module design. Please confirm if the contractor does or does not need to comply with the PACT Space Module Design
Guide as shown in the solicitation.
ANSWER: The contractor does not need to comply with the on-stage/off-stage portion of the design.

SECTION C: CONTRACT CLAUSES – Updates
Added by Full Text
FAR 52.222-6 CONSTRUCTION WAGE RATE REQUIREMENTS (AUG 2018)
(a) Definition.—“Site of the work”—
(1) Means—
(i) The primary site of the work. The physical place or places where the construction called for in the contract will remain when work on it is completed; and
(ii) The secondary site of the work, if any. Any other site where a significant portion of the building or work is constructed, provided that such site is-
(A) Located in the United States; and
(B) Established specifically for the performance of the contract or project;
(2) Except as provided in paragraph (3) of this definition, includes any fabrication plants, mobile factories, batch plants, borrow pits, job headquarters, tool yards, etc., provided-
(i) They are dedicated exclusively, or nearly so, to performance of the contract or project; and
(ii) They are adjacent or virtually adjacent to the “primary site of the work” as defined in paragraph (a)(1)(i), or the “secondary site of the work” as defined in paragraph (a)(1)(ii) of this definition;
(3) Does not include permanent home offices, branch plant establishments, fabrication plants, or tool yards of a Contractor or subcontractor whose locations and continuance in operation are determined wholly without regard to a particular Federal contract or project. In addition, fabrication plants, batch plants, borrow pits, job headquarters, yards, etc., of a commercial or material supplier which are established by a supplier of materials for the project before opening of bids and not on the Project site, are not included in the “site of the work.”
Such permanent, previously established facilities are not a part of the “site of the work” even if the operations for a period of time may be dedicated exclusively or nearly so, to the performance of a contract.
(b)
(1) All laborers and mechanics employed or working upon the site of the work will be paid unconditionally and not less often than once a week, and without subsequent deduction or rebate on any account (except such payroll deductions as are permitted by regulations issued by the
Secretary of Labor under the Copeland Act (29 CFR Part 3)), the full amount of wages and bona fide fringe benefits (or cash equivalents thereof) due at time of payment computed at rates not less than those contained in the wage determination of the Secretary of Labor which is attached hereto and made a part hereof, or as may be incorporated for a secondary site of the work, regardless of any contractual relationship which may be alleged to exist between the Contractor and such laborers and mechanics. Any wage determination incorporated for a secondary site of the work shall be effective from the first day on which work under the contract was performed at that site and shall be incorporated without any adjustment in contract price or estimated cost.
Laborers employed by the construction Contractor or construction subcontractor that are transporting portions of the building or work between the secondary site of the work and the primary site of the work shall be paid in accordance with the wage determination applicable to the primary site of the work.
(2) Contributions made or costs reasonably anticipated for bona fide fringe benefits under section 1(b)(2) of the Construction Wage Rate Requirements statute on behalf of laborers or mechanics are considered wages paid to such laborers or mechanics, subject to the provisions of paragraph (e) of this clause; also, regular contributions made or costs incurred for more than a weekly period (but not less often than quarterly) under plans, funds, or programs which cover the particular weekly period, are deemed to be constructively made or incurred during such period.
(3) Such laborers and mechanics shall be paid not less than the appropriate wage rate and fringe benefits in the wage determination for the classification of work actually performed, without regard to skill, except as provided in the clause entitled Apprentices and Trainees.
Laborers or mechanics performing work in more than one classification may be compensated at the rate specified for each classification for the time actually worked therein; provided that the employer’s payroll records accurately set forth the time spent in each classification in which work is performed.
(4) The wage determination (including any additional classifications and wage rates conformed under paragraph (c) of this clause) and the Construction Wage Rate Requirements
(Davis-Bacon Act) poster (WH-1321) shall be posted at all times by the Contractor and its subcontractors at the primary site of the work and the secondary site of the work, if any, in a prominent and accessible place where it can be easily seen by the workers.
(c)
(1) The Contracting Officer shall require that any class of laborers or mechanics which is not listed in the wage determination and which is to be employed under the contract shall be classified in conformance with the wage determination. The Contracting Officer shall approve an additional classification and wage rate and fringe benefits therefor only when all the following criteria have been met:
(i) The work to be performed by the classification requested is not performed by a classification in the wage determination.
(ii) The classification is utilized in the area by the construction industry.
(iii) The proposed wage rate, including any bona fide fringe benefits, bears a reasonable relationship to the wage rates contained in the wage determination.
(2) If the Contractor and the laborers and mechanics to be employed in the classification
(if known), or their representatives, and the Contracting Officer agree on the classification and wage rate (including the amount designated for fringe benefits, where appropriate), a report of the action taken shall be sent by the Contracting Officer to the Administrator of the:
Wage and Hour Division
U.S. Department of Labor
Washington, DC 20210
The Administrator or an authorized representative will approve, modify, or disapprove every additional classification action within 30 days of receipt and so advise the Contracting
Officer or will notify the Contracting Officer within the 30-day period that additional time is necessary.
(3) In the event the Contractor, the laborers or mechanics to be employed in the classification, or their representatives, and the Contracting Officer do not agree on the proposed classification and wage rate (including the amount designated for fringe benefits, where appropriate), the Contracting Officer shall refer the questions, including the views of all interested parties and the recommendation of the Contracting Officer, to the Administrator of the
Wage and Hour Division for determination. The Administrator, or an authorized representative, will issue a determination within 30 days of receipt and so advise the Contracting Officer or will notify the Contracting Officer within the 30-day period that additional time is necessary.
(4) The wage rate (including fringe benefits, where appropriate) determined pursuant to paragraphs (c)(2) and (c)(3) of this clause shall be paid to all workers performing work in the classification under this contract from the first day on which work is performed in the classification.
(d) Whenever the minimum wage rate prescribed in the contract for a class of laborers or mechanics includes a fringe benefit which is not expressed as an hourly rate, the Contractor shall either pay the benefit as stated in the wage determination or shall pay another bona fide fringe benefit or an hourly cash equivalent thereof.
(e) If the Contractor does not make payments to a trustee or other third person, the Contractor may consider as part of the wages of any laborer or mechanic the amount of any costs reasonably anticipated in providing bona fide fringe benefits under a plan or program; provided, That the
Secretary of Labor has found, upon the written request of the Contractor, that the applicable standards of the Construction Wage Rate Requirements statute have been met. The Secretary of
Labor may require the Contractor to set aside in a separate account assets for the meeting of obligations under the plan or program.
