1. OVERVIEW
1.1 Intent: The intent of this solicitation (please note that the words solicitation and request for proposal (RFP) may be used synonymously throughout the solicitation documents) is to select one contractor to provide professional construction services for Project Number 531-22-103, Add Parking on Parade Grounds, in accordance with the attached documents. The period of performance is 182 calendar days from issuance of the Notice to Proceed.
1.2 Method of Award: The Government intends to use the “Best Value” tradeoff process source selection approach in accordance with FAR 15.101-1. A firm fixed price award will be made to the responsible offeror whose offer/proposal is determined to be the best value to the Government based on all factors outlined in this Solicitation (36C26026R0046). The Government reserves the right to accept other than the lowest priced offer or to reject all offers. Setting aside for Service Disabled Veteran Owned Small Business (SDVOSB) firms that comply with regulations to meet our goals will fulfill the VA’s mission to meet socioeconomic goals.
1.3 Discussions: Government intends to make award to a responsible offeror without discussions; however, the Government reserves the right to conduct discussions with one or more Offeror(s) if deemed to be in the best interest of the Government. Therefore, prospective Offerors are strongly encouraged to make their best initial offer.
1.4 Unacceptable Proposal: Offerors must comply with all detailed instructions in this Solicitation for format and data content of the proposal. Proposals that do not comply with the detailed instructions for the format and data content of the proposal may be considered unacceptable and may render the Offeror ineligible for award.
2. INSTRUCTIONS FOR PROPOSAL PREPARATION AND SUBMISSION
These instructions prescribe the format and other essential information for preparation/ development and presentation of proposal data to ensure the submission of necessary information for the understanding and comprehensive evaluation of proposals. Carefully review this section prior to commencing proposal preparation. In order for proposals to receive full consideration for award, offerors should ensure that the information furnished in support of the proposal is factual, accurate, and complete.
Proposal shall be submitted in two (2) separate Volumes: Volume I – Technical Proposal and Volume II – Price/Cost Proposal with strict adherence to the format, data, and other requirements of this Solicitation.
Offerors shall complete in its entirety the “Offeror” portion of the Standard Form (SF) 1442. All pages of each proposal shall be appropriately numbered. For ease of reviews, consecutive page numbering is required.
Offerors responding to this Solicitation with a proposal/offer to provide the Work set forth in the Solicitation documents should limit submissions to data essential for evaluation of proposals, so that a minimum of time and monies will have been expended in preparing information required herein. However, failure to include all information requested may adversely affect the evaluation. A proposal that merely reiterates or promises to accomplish the requirements of the RFP may be considered unacceptable.
Offerors are reminded of their responsibility to submit a proposal that is orderly and sufficiently documented that will enable the Government to easily understand and perform a thorough and fair evaluation. All commitments made in the proposal may become a part of the resultant contract. The data submitted with each proposal should be complete and concise, but not overly elaborate. Excessive reliance on promotional brochures is discouraged. In order to be effectively and equitably evaluated, the proposals must include information sufficiently detailed to clearly address all of the evaluation criteria factors described in the Solicitation.
**ALL PROPOSALS MUST BE SUBMITTED ELECTRONICALLY; NO HARD COPY OR FACSIMILE PROPOSALS WILL BE ACCEPTED**
3. PROPOSAL EVALUATION
A firm fixed price award will be made to the highest technically rated qualified construction contractor at a fair and reasonable price whose offer conforms to the solicitation, and which results in the best value to the Government, all factors considered.
To arrive at a Best Value decision, the Source Selection Authority, using the SSEB documentation will integrate the evaluation of Technical Expertise (Technical), Past Performance, and Price.
Technical is significantly more important than Past Performance and, when combined, they are significantly more important than cost/price.
3.1.1 VOLUME I - Factor 1, Technical. Technical will be evaluated using the following criteria:
The Government will evaluate the prime contractor offeror’s experience required for this project with relation to storm drain installation and paving projects that are at a minimum similar in complexity and comparable size to the requirements of this project. Submit two (2) projects that best demonstrate both storm drain installation and grading/paving requirements; and descriptions of those projects that best demonstrates your expertise on projects that are similar in scope, magnitude, and complexity in a similar climate/environment to the RFP. The Government will evaluate the offeror’s experience on projects related to their expertise on projects similar in scope, magnitude, and complexity.
Projects submitted shall be completed within the past five (5) years of the date of issuance of this RFP. A project is defined as either construction under a single task order or individual construction contract. Higher ratings will be given to offerors showing demonstrated prime contractor successful experience on projects that include both storm drain installation and grading/paving requirements.
3.1.2 VOLUME I - Factor 2, Past Performance
Past performance is one indicator of an offeror’s ability to perform the contract successfully. The currency and relevance of the information, source of the information, context of the data, and general trends in contractor’s performance shall be considered.
The list of projects provided under Factor 1, Technical, will have past performance reviewed. Offeror shall provide past performance by using one or more of the following manners:
- Provide a printout of the final CPARS for the project.
- Complete in entirety the attached form titled “Past Performance Reference Form” to provide past performance reference information for all projects listed under Factor 1. Incomplete forms may result in the Past Performance Reference Form not being considered for evaluation.
While evaluating past performance, the Government evaluation team will not be limited to reviewing the past performance information provided in this proposal and reserves the right to review other available past performance information to assess past performance.
Please note, technical evaluators and the Contracting Officer can use their personal knowledge of the contractor’s prior VA contracts to assist with past performance evaluations.
If an offeror does not have any past performance, a neutral rating will be given for this evaluation factor.
Past performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. It considers each offeror’s demonstrated recent and relevant record of performance in supplying products and services that met the contract requirements. One performance confidence assessment rating is assigned for each offeror after evaluating the offeror's recent past performance, focusing on performance that is relevant to the contract requirements. (See FAR 15.202). There are two aspects to the past performance evaluation. Relevancy of contractual work performed; and how well the contractual work was performed as a confidence assessment.
Relevancy Rating: The offeror’s past performance will be evaluated to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. To be considered relevant, the work performed must be completed within the last 5-years. Relevancy rating will assess past performance effort involving similar scope and magnitude of effort and complexities that this solicitation requires.
Performance Confidence Rating. The offeror’s past performance evaluation will evaluate contractors to determine how well the contractor performed on the past performance contracts and the expectation that the offeror will be able to successfully perform the required effort for this project by rating a performance confidence assessment.
3.2 VOLUME II – Factor 3, Price Proposal: Price is not the only factor for this requirement. Price will be evaluated on the basis of its fair and reasonableness to the Government. “Best Value” means the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement. A firm fixed price award will be made to a qualified construction contractor at a fair and reasonable price whose offer conforms to the solicitation, and which results in the best value to the Government, all factors considered.
3.2.1 Offerors may be requested during the evaluation process to provide sufficient price information that will enable the Government to perform an accurate evaluation.
3.2.2 The Government will evaluate the total price. The intent is to award CLIN 0001, Item I (Project 531-22-103 Add Parking on Parade Grounds)
3.2.3 Prices will be evaluated for reasonableness utilizing one or more of the price analysis techniques set forth in FAR 15.404-1(b) and the following criteria:
· Total Price: The total evaluated price will be the sum of all Contract Line-Items.
· Reasonableness: A price is reasonable if, in its nature or amount, it does not exceed what would be incurred by an ordinarily prudent person in the conduct of normal competitive business.
3.2.4 Prompt payment discounts will not be considered in the evaluation of offers.
3.2.5 If no Offerors are within the available funding limitation, the VA reserves the right to enter into discussions with those Offerors who are determined to be within the competitive range, if a competitive range is determined in the interest of the VA, otherwise discussions will be with all Offerors.
3.2.6 If following the initial Non-Price and Price evaluations and/or receipt of Final Proposal Revisions, an offeror’s total evaluated price still exceeds the VA's funding limitation, the VA will no longer consider the offeror to be eligible for award.

3.2 52.209-13 VIOLATION OF ARMS CONTROL TREATIES OR AGREEMENTS—CERTIFICATION (NOV 2021) (DEVIATION NOV 2025)
(a) This provision does not apply to acquisitions at or below the simplified acquisition threshold or to acquisitions of commercial products and commercial services as defined in Federal Acquisition Regulation 2.101.
(b) Certification. [Offeror shall check either (1) or (2).] _____ (1) The Offeror certifies that—
(i) It does not engage and has not engaged in any activity that contributed to or was a significant factor in the President’s or Secretary of State’s determination that a foreign country is in violation of its obligations undertaken in any arms control, nonproliferation, or disarmament agreement to which the United States is a party, or is not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. The determinations are described in the most recent unclassified annual report provided to Congress pursuant to section 403 of the Arms Control and Disarmament Act (22 U.S.C. 2593a). The report is available at https://www.state.gov/bureaus-offices/under-secretary-for-arms-control-and-international-security-affairs/bureau-of-arms-control-verification-and-compliance/; and
(ii) No entity owned or controlled by the Offeror has engaged in any activity that contributed to or was a significant factor in the President’s or Secretary of State’s determination that a foreign country is in violation of its obligations undertaken in any arms control, nonproliferation, or disarmament agreement to which the United States is a party, or is not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. The determinations are described in the most recent unclassified annual report provided to Congress pursuant to section 403 of the Arms Control and Disarmament Act (22 U.S.C. 2593a). The report is available at https://www.state.gov/bureaus-offices/under-secretary-for-arms-control-and-international-security-affairs/bureau-of-arms-control-verification-and-compliance/; or
(2) The Offeror is providing separate information with its offer in accordance with paragraph (d)(2) of this provision.
(c) Procedures for reviewing the annual unclassified report (see paragraph (b)(1) of this provision). For clarity, references to the report in this section refer to the entirety of the annual unclassified report, including any separate reports that are incorporated by reference into the annual unclassified report.
(1) Check the table of contents of the annual unclassified report and the country section headings of the reports incorporated by reference to identify the foreign countries listed there. Determine whether the Offeror or any person owned or controlled by the Offeror may have engaged in any activity related to one or more of such foreign countries.
(2) If there may have been such activity, review all findings in the report associated with those foreign countries to determine whether or not each such foreign country was determined to be in violation of its obligations undertaken in an arms control, nonproliferation, or disarmament agreement to which the United States is a party, or to be not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. For clarity, in the annual report an explicit certification of noncompliance is equivalent to a determination of violation. However, the following statements in the annual report are not equivalent to a determination of violation:
(i) An inability to certify compliance.
(ii) An inability to conclude compliance.
(iii) A statement about compliance concerns.
(3) If so, determine whether the Offeror or any person owned or controlled by the Offeror has engaged in any activity that contributed to or is a significant factor in the determination in the report that one or more of these foreign countries is in violation of its obligations undertaken in an arms control, nonproliferation, or disarmament agreement to which the United States is a party, or is not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state.
