Bonding Interested parties are advised that, based on the estimated magnitude of this project being between $100,000.00 and $250,000.00, there are two potential scenarios for bonding. As such, bonding related matters’ requirements are as set forward IAW FAR 28.102, Performance and payment bonds and alternative payment protections for construction contracts and FAR 28.101 Bid guarantees.
If an interested party’s offer in response to this RFP that is valued at $150,000.00 or higher, a bid bond shall be required pursuant to FAR 28.101-1 since, pursuant to FAR 28.102-1(a) a bid bond is required. If an award is issued, performance and payment bonding shall be required within 10 days of award.
If an interested party’s offer is $149,999.99 or lower, a bid bond is not required per FAR 28.101-1 and FAR 28.102-1(b). If an award is made to their offer, acceptable payment protection as outlined in FAR 28.102-1(b) shall be provided within 10 days of notice of award.
EVALUATION FACTORS
The following information will be evaluated:
Factor 1: Technical Experience Offeror shall provide at least three (3) but no more than five (5) examples of technical experience.
a. The Offeror shall demonstrate recent and relevant experience in construction, building not less than 500 square foot wood framed structure(s) which include power, communications, HVAC, and security features, in a non-residential environment.

d. In describing the projects, provide specific details of the requirement(s) to demonstrate applicable construction experience. General statements claiming experience providing services that do not include specific references to prior contract work, or that do not include the information required below, are not acceptable.
e. If subcontractors were used as part of the proposed team to demonstrate experience, describe their role(s) and the percentage of work they performed/are performing.
Factor 2: Past Performance Offerors may submit up to three (3) past performance references on the provided form of work as a prime contractor responsible for managing multiple subcontractors and coordinating with multiple stakeholders.
The Government will review reasonable avenues to obtain past performance information such as reviewing CPARS, contact public and private offices who have done business with the offeror, references given in the proposal, etc.
a. In describing the effort, provide specific details of the requirement to demonstrate relevancy. General statements are not sufficient.
b. It is the offeror’s responsibility to ensure they provide correct and current contact information for their reference(s) for them to be considered. The Government will not research to obtain correct and current information if not provided.
c. If the Offeror has no verifiable past performance identified in evaluation, Offeror will be given a neutral past performance rating.
Factor 3: Price Offerors are required to review to ensure their price(s) are complete and accurate prior to submitting to the government. If there is an assumed mistake in proposal, the company will be offered to 1) perform at the original price, or 2) withdraw their proposal submission.
Factor 4: Evaluation Factor Commitments Offerors eligibility under VAAR 852.215-70 will be evaluated. EVALUATION PROCESS
The Government may reject any or all proposals. Any informalities or minor irregularities in received proposals may be waived at the Government’s discretion. The Government intends to make one award to the proposal that offers the overall best value to the Government and may award to other than the lowest price offeror but also reserves the right to make no award if no proposal is found to be of best value to the Government. The Government intends to award without discussions but reserves the right to determine discussions necessary. The Government further reserves the right to make no award if at any point during solicitation or evaluation, it is determined that there is insufficient funding to proceed since this project does not include additive or deductive options.
The following definitions apply:
Recent – within the last five calendar years for technical experience and within the last six years for past performance.
Relevant – a construction or alteration, of completed commercial, industrial, educational, or healthcare related space with a minimum contract value of $100,000.00.
Experience- whether offerors have performed similar work before.
Performance- how well offerors perform/execute contracted work.
Technical, Past Performance, and Price are worth substantially the same as each other. Evaluation Factor Commitments is worth substantially less than any other factor.

The Government will assess Technical Experience as follows:
· Outstanding– Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.
· Good- Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh weaknesses. Risk of unsuccessful performance is low.
· Acceptable – Proposal meets requirements and indicates an adequate approach and understanding of requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.
· Marginal – Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses not offset by strengths. Risk of unsuccessful performance is high.
· Unsatisfactory- Proposal does not meet requirements and contains one or more deficiencies. Proposal is not awardable.
The Government will assess Past Performance as follows:
· Substantial Confidence- Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
· Satisfactory Confidence- Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
· Limited Confidence- Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
· No Confidence- Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
· Unknown (Neutral) Confidence- No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
Price will be evaluated on a basis of reasonableness only.

2.7 VAAR 852.239-75 INFORMATION AND COMMUNICATION TECHNOLOGY ACCESSIBILITY NOTICE (FEB 2023)
(a) Any offeror responding to this solicitation must comply with established VA Information and Communication Technology (ICT) (formerly Electronic and Information (EIT)) accessibility standards. Information about Section 508 is available at http://www.section508.va.gov/.
(b) The Section 508 accessibility standards applicable to this solicitation are stated in the clause at 852.239–75, Information and Communication Technology Accessibility. In order to facilitate the Government’s determination whether proposed ICT supplies meet applicable Section 508 accessibility standards, offerors must submit appropriate VA Section 508 Checklists, in accordance with the checklist completion instructions. The purpose of the checklists is to assist VA acquisition and program officials in determining whether proposed ICT supplies, or information, documentation and services conform to applicable Section 508 accessibility standards. The checklists allow offerors or developers to self-evaluate their supplies and document—in detail—whether they conform to a specific Section 508 accessibility standard, and any underway remediation efforts addressing conformance issues.
(c) Respondents to this solicitation must identify any exception to Section 508 requirements. If an offeror claims its supplies or services meet applicable Section 508 accessibility standards, and it is later determined by the Government, i.e., after award of a contract or order, that supplies or services delivered do not conform to the described accessibility standards, remediation of the supplies or services to the level of conformance specified in the contract will be the responsibility of the Contractor at its expense.
