Departmental Materials Specification DMS-8200

Construction Division 1 – 8 Effective Date: May 2017

DMS-8200

Traffic Paint Effective Date: May 2017

1. DESCRIPTION

This Specification governs the materials, composition, manufacture, and testing of traffic paint.

2. UNITS OF MEASUREMENTS

The values given in parentheses (if provided) are not standard and may not be exact mathematical conversions. Use each system of units separately. Combining values from the two systems may result in nonconformance with the standard.

3. MATERIAL PRODUCER LIST

The Materials and Pavements Section of the Construction Division (CST/M&P) maintains the Material Producer List (MPL) of all materials conforming to the requirements of this Specification. Materials appearing on the MPL, entitled “Traffic Paint,” require no further sampling and testing before use, unless deemed necessary by the Project Engineer or CST/M&P.

4. BIDDERS’ AND SUPPLIERS’ REQUIREMENTS

The Department will only purchase or allow on projects those products listed by producer and product code or designation shown on the MPL.

Use of pre-qualified product does not relieve the Contractor of the responsibility to provide product that meets this Specification. The Department may inspect or test material at any time and reject any material that does not meet the specifications.

5. PRE-QUALIFICATION PROCEDURE

5.1. Pre-Qualification Request. Submit a request for evaluation under DMS-8200 to DMS_Prequal@txdot.gov.

Include the following information in the request:

company name;

physical and mailing addresses;

contact person, phone number, and email address;

type of material;

written plant Quality Control (QC) and production procedures, as required by Article 6 of this Specification;

list of designated on-site QC personnel with copies of their qualifications and a detailed description of their QC-related experience, as required by Article 6; and brand names and characteristics of all raw materials proposed for use, in accordance with Article 8.

Construction Division 2 – 8 Effective Date: May 2017

5.2. Pre-Qualification Sample. CST/M&P will review the qualification request. If the documentation is complete, CST/M&P will contact the producer to request a qualification sample. Submit one gallon each of yellow and white traffic paint produced in accordance with this Specification for laboratory testing and evaluation.

Include the following with the sample:

current safety data sheet (SDS) that complies with OSHA Hazard Communication Standard 29 CFR 1910.1200, and a test report showing that the material meets the requirements of this Specification.

Submit all materials for pre-qualification at no cost to the Department.

5.3. Qualification Audit and Inspection. For products meeting the material requirements, CST/M&P will schedule an initial Department-directed plant audit to ensure full compliance with this Specification.

The producer must:

provide standard friction-seal pint cans for the sampling of raw materials and finished product, provide lined cans for sampling waterborne raw materials and finished paints to prevent rusting, allow the inspector free access to all areas where raw materials are stored and where finished products are manufactured and stored, and facilitate the inspector in performing his or her duties.

The Department’s authorized inspector may:

sample raw materials and finished paint in accordance with Tex-801-B;

at the Department’s discretion, witness the manufacturing in whole or in part; and verify documentation retention required by Article 7.

The Department may reject raw materials and finished products that fail to meet any requirements of this Specification. Rejected raw materials may result in rejection of any finished products made with those raw materials.

The Wet Standard prepared by the Department will be the standard used for final comparison and will determine final acceptance or rejection. Samples of these standards are available to the manufacturer. The judgment of the Director of CST/M&P will be final in all questions relating to the conformance of the products with the provisions of this Specification.

The Department will take samples after the manufacturer makes final adjustments to the batch. To establish or verify performance, CST/M&P will perform any or all tests required. In case of variance, the Department’s tests will govern.

5.4. Evaluation. CST/M&P will notify prospective bidders and suppliers after completion of material evaluation.

5.4.1. Qualification. The Department will list producers meeting the requirements of this Specification on the MPL.

CST/M&P reserves the right to perform additional audits (announced or unannounced) at its discretion for the producer to remain on the MPL.

Report changes in the composition or in the manufacturing process of any material to CST/M&P. Significant changes reported by the producer, as determined by the Director of CST/M&P, may require a re-evaluation of performance. The Department reserves the right to conduct whatever tests it deems necessary to identify a pre-qualified material and determine if there is a change in the composition, manufacturing process, or quality that may affect its durability or performance. Detected changes not reported to the Department may be grounds for removal from the MPL. In case of variance, the Department’s tests will govern.

Construction Division 3 – 8 Effective Date: May 2017

Producers listed on the MPL must annually attain and submit the following in order to maintain approval status:

a re-qualification sample, if no sample has been tested in the year since initial qualification or in any subsequent year thereafter; and the QC data associated with the re-qualification sample.

Failure to attain and provide the above may result in the removal from the MPL.

5.4.2. Failure. Producers not qualified under this Specification may not furnish materials for use on Department projects.

Producers failing to qualify may submit a request for re-evaluation after 6 months have elapsed from the date of the original request. CST/M&P may modify this time limit at its discretion. In the request for re-evaluation, document the cause of the issue and corrective action taken. If the producer was rejected for not meeting material requirements, provide a test report showing that all materials meet the requirements of this Specification. The Department reserves the right to perform any or all tests specified as a check on the tests reported by the producer. In the case of any variance, the Department’s tests will govern.

The Department normally bears the costs of sampling, testing, and inspection; however, the producer will bear the costs associated with materials or production facilities failing to conform to the requirements of this Specification. The Director of CST/M&P will assess this cost at the time of testing.

CST/M&P must receive a cashier’s check made payable to the “TxDOT Fund” before scheduling a replacement batch or new paints for inspection and manufacture. The producer may be required to reimburse the Department for the cost of storage and handling of paints failing to meet Specification requirements.

5.5. Inspection and Testing. The Department reserves the right to periodically perform additional plant audits (announced or unannounced) and evaluate the performance of materials at its discretion. CST/M&P will select random samples from materials submitted to the Department on contracts or direct State purchase orders.

Failure of production facilities or materials to comply with the requirements of this Specification as a result of periodic evaluation may be cause for removal of those producers from the MPL. In case of variance, the Department’s tests will govern.

Notify CST/M&P a minimum of 3 working days prior to the scheduled date of production.

5.6. Disqualification. Causes for disqualification and removal from the MPL may include, but are not limited to:

product or production facility fails to meet the requirements of this Specification, product does not perform as required in storage and use, falsification of documentation, producer fails to report any change in the formulation or production process of the material to CST/M&P, producer has unpaid charges for failing samples, producer fails to submit the annual re-certification sample and documentation, finished product does not meet specified shelf life, producer has not supplied traffic paint to Department projects or contracts for 2 years, or producer fails to notify CST/M&P a minimum of 3 working days prior to the scheduled date of production.

CST/M&P will remove disqualified producers from the MPL and will not allow submission of material for re-qualification for 1 year, at the discretion of the Department.

Construction Division 4 – 8 Effective Date: May 2017

5.7. Re-Qualification. Once the disqualification period established by CST/M&P has elapsed, producers disqualified and removed from the MPL may begin the re-qualification process by submitting a request in accordance with Section 5.1, including additional documentation identifying the cause of the problem and corrective action taken. The re-qualification process will then follow all subsequent Sections of Article 5.

The Department normally bears the costs of sampling and testing; however, the disqualified producer will bear the costs associated with re-qualification. The Director of CST/M&P will assess this cost at the time of re-evaluation, and amounts due will be billed to the producer.

6. QC AND PRODUCTION PROCEDURES

The producer has the discretion of the manufacturing procedures unless otherwise specified. The producer is responsible for ensuring that the proposed raw materials and manufacturing procedure produce a product meeting the Specification requirements. Submit and maintain the following plant-specific written QC and production procedures for acceptance that include the following, at minimum, to ensure product compliance with Department specifications:

procedures for verification of raw material quality;

batching procedures for ensuring mixing/batching operations are producing homogenous traffic paint in accordance with the material specification;

QC procedures for verification of Departmental material requirements;

procedures for handling material failing to meet specification requirements;

procedures for handling, storage, and shipment of finished traffic paint; and a list of designated on-site QC personnel with copies of their qualifications and a detailed description of their QC-related experience as related to the inspection duties listed above.

7. DOCUMENTATION

Maintain the following documentation, at a minimum, available on request:

all QC data for the raw materials used in the manufacture of Department traffic paint (minimum 1-year retention), all QC data for each batch produced (minimum 1-year retention), and shipping invoices for delivery of Department traffic paint to TxDOT projects or contracts (minimum 1-year retention).

8. RAW MATERIALS

8.1. Substitutions. The exact brands and types of raw materials used in the Wet Standard are listed to facilitate the selection of parallel materials equal in quality, composition, and physical and chemical behavior after aging in the finished product.

Since evaluation of the finished product containing questionable materials may require over 60 days, meeting the delivery schedule is the responsibility of the manufacturer.

The Director of CST/M&P will make the final decision as to the equality of materials. After the Department has agreed to the proposed brand names and types of raw materials, the Department will not allow substitution without prior approval.

8.2. Materials of Foreign Origin. Because of the limited information available on materials manufactured outside the continental limits of the United States, consider that evaluation of the finished product containing questionable materials may require more than 60 days.
