About this file

This is a Vendor Questions and Answers document for Solicitation No. 36C25626Q0900, addressing 24 vendor inquiries regarding regulated medical waste collection, transportation, treatment, and disposal services for the Department of Veterans Affairs.

The contract covers four service locations: Fayetteville VHSO (approximately 13 full 96-gallon containers per business day, priced at 13,800 units over five years under CLIN 0001) and three Community-Based Outpatient Clinics (CBOCs) in Fort Smith, Springfield, and Joplin (4,800 units over five years under CLIN 0002). Unit prices under CLINs 0001 and 0002 must be all-inclusive, covering containers, collection, transportation, manifests, treatment, and final disposal. A separate CLIN for emergency services has been added to the revised Price/Cost Schedule per Amendment 0001. The contractor must furnish and maintain sufficient quantities of reusable 96-gallon and 28-gallon containers without fixed initial inventory requirements specified by the Government. The contract requires daily Monday-through-Friday pickups at Fayetteville with next-business-day container return, pickup locations at combination ground-level and loading-dock areas, and 24-hour emergency response capability with qualified personnel onsite within two hours of notification. All offerors must submit complete quotations for all CLINs and service locations; partial quotations will not be accepted. The contractor must possess all required state transporter permits, vehicle approvals, and regulatory authorizations prior to performing activities and maintain them throughout contract performance. A transition period extends from award through October 31, 2026, with full performance at all locations commencing no later than November 1, 2026. The scope is limited to trace chemotherapy waste handled as regulated medical waste and excludes bulk chemotherapy waste, RCRA hazardous pharmaceutical waste, and other hazardous waste streams requiring separate transportation or disposal services.

Solicitation No. 36C25626Q0900

Vendor Questions and Answers

1. SOW Section 5, Pages 7–8, and Price Schedule, Pages 15–16:

The SOW estimates approximately 13 full 96-gallon containers per business day at the Fayetteville VHSO. Over the five-year ordering period, this appears to exceed the estimated quantity of 13,800 EA under CLIN 0001. Please confirm which estimated quantity offerors should use for pricing and operational planning.

Answer: Offerors shall use the estimated quantity of 13,800 each under CLIN 0001 for the purpose of completing the Price/Cost Schedule and for the Government’s price evaluation. Section 5 of the Statement of Work has been revised to clarify that container quantities may vary based on actual usage. Please refer to Amendment 0001 for the updated information.

2. SOW Section 5, Pages 7–8, and Price Schedule, Pages 15–16:

Based on the stated pickup frequencies and estimated quantities for Fort Smith, Springfield, and Joplin, the calculated five-year quantity appears to differ from the 4,800 EA listed under CLIN 0002. Please confirm that 4,800 EA is the quantity the Government will use for price evaluation.

Answer: Offerors shall use the estimated quantity of 4,800 each under CLIN 0002 for the purpose of completing the Price/Cost Schedule and for the Government’s price evaluation. Section 5 of the Statement of Work has been revised to clarify that container quantities may vary based on actual usage. Please refer to Amendment 0001 for the updated information.

3. Price Schedule, Pages 15–16:

Please clarify which costs must be included in CLIN 0001 and CLIN 0002. Should the unit prices include containers, collection, transportation, manifests, treatment, and final disposal?

Answer: Yes. The unit prices proposed under CLIN 0001 and CLIN 0002 shall be all-inclusive and cover all costs necessary to perform the applicable regulated waste services in accordance with the Statement of Work.

4. Price Schedule, Page 16:

Please clarify what services and expenses should be included in the CLIN 0003 monthly service price for Fort Smith, Springfield, and Joplin that are not already included in the CLIN 0002 per-container price.

Answer: CLIN 0003 has been revised. The unit price under CLIN 0002 shall be all-inclusive and include all costs necessary to perform the applicable routine regulated waste services for Fort Smith, Springfield, and Joplin in accordance with the Statement of Work. See Amendment 0001 for the revised Price/Cost Schedule.

5. SOW Section 8, Pages 9–10:

The SOW requires 24-hour emergency service and states that emergency services will be ordered under the applicable emergency-services contract line item, if applicable. However, the pricing schedule does not include a separate emergency-service CLIN. Please explain how authorized emergency services will be ordered, priced, and paid.

Answer: The Price/Cost Schedule has been revised to include a separate CLIN for emergency services. See Amendment 0001 and the revised Price/Cost Schedule for details.

6. SOW Section 5, Page 7:

Please provide the current or anticipated initial inventory of 96-gallon reusable containers required at the Fayetteville VHSO to support daily service and the next-business-day return requirement.

Answer: The Government has not established a fixed initial inventory quantity of 96-gallon reusable containers for the Fayetteville VHSO. The contractor shall furnish and maintain a sufficient quantity of containers to meet the daily service and next-business-day return requirements in accordance with the Statement of Work.

7. SOW Section 5, Pages 7–8:

Please provide the anticipated number of red and yellow 28-gallon containers required at each CBOC, including the desired allocation between the two colors.

Answer: The Government has not established a fixed quantity or allocation of red and yellow 28-gallon containers for each CBOC. The contractor shall furnish and maintain sufficient quantities and appropriate container types to meet the regulated waste requirements of each location in accordance with the Statement of Work.

8. SOW Sections 3 and 7, Pages 5–9:

Please provide the available historical breakdown of containers requiring autoclave treatment versus incineration at each location.

Answer: The Government does not have reliable historical quantities by treatment method to establish an anticipated allocation between autoclave and incineration.

Offerors shall use the estimated quantities identified in the Price/Cost Schedule for pricing purposes. Actual quantities and treatment methods may vary based on facility requirements and the applicable waste stream.

9. SOW Section 1, Page 5:

Please confirm whether sharps will be packaged inside the 28-gallon or 96-gallon regulated medical waste containers or whether the contractor must provide a separate reusable sharps-container program.

Answer: No. The contractor is not required to provide a separate reusable sharps-container program. Sharps waste shall be collected, transported, treated, and disposed of as part of the regulated medical waste services required by the Statement of Work and applicable regulatory requirements.

10. SOW Sections 3(D) and 7, Pages 6 and 8–9:

Will the Government accept electronic manifests and electronic signatures, or must the contractor provide printed documentation at each pickup?

Answer: Required manifests and pickup documentation shall comply with all applicable regulatory requirements. Electronic manifests and electronic signatures are acceptable as long as they meet all federal, state, and local regulatory standards, as well as the requirements outlined in the Statement of Work.

11. Incumbent information:

For acquisition planning and price-development purposes, please identify the current incumbent contractor, current contract number, and current unit prices for the services being recompeted. If available, please also provide the most recent contract pricing schedule or bid abstract.

Answer: The current incumbent contractor is Hamilton Alliance, Inc, contract number 36C25626P0443. Incumbent unit pricing and detailed pricing information will not be provided in response to this solicitation, and no bid abstract is available.

Offerors are responsible for developing their quotations based on the requirements of the solicitation.

12. I would like to request clarification regarding the volume of pathological waste.

While the solicitation includes estimated total pickup quantities for regulated medical waste, it does not specify the volume or proportion of pathological waste within those figures.

Could the Government provide historical or estimated volumes (or percentages) of pathological waste generated at each service location? Alternatively, could you confirm whether such data is available? This information is crucial for accurate planning and pricing.

Answer: The Government does not have reliable historical data or separate estimated container quantities or percentages for pathological waste by service location. Offerors shall base their pricing and operational planning on the estimated quantities provided in the Price/Cost Schedule and on the requirement to treat and dispose of each waste stream in accordance with the solicitation and applicable regulatory requirements. The estimated quantities are provided solely for pricing purposes and do not represent a guaranteed minimum or maximum quantity of pathological waste.

13. For the Fayetteville VHSO location at 1100 North College Avenue, would the VA permit the contractor to place a 53-foot enclosed trailer on site for regulated medical waste storage and service the trailer once weekly, instead of performing daily Monday-through-Friday pickups using reusable 96-gallon four-wheel containers?

If this alternative is acceptable, please confirm whether it would replace the requirement that approximately thirteen (13) full 96-gallon containers be collected each business day and that removed containers be cleaned, sanitized, and returned by the next business day.

The proposed alternative would apply only to the Fayetteville VHSO location.

Services at Fort Smith, Springfield, and Joplin would remain in accordance with the solicitation.

Answer: No. The proposed use of an on-site 53-foot enclosed trailer with once-a-week service at the Fayetteville facility is not acceptable. Offerors shall submit their quotations based on the requirements outlined in the Statement of Work.

14. Waste Segregation

Will VA personnel segregate and clearly identify each 96 gallon and 28 gallon container by waste stream prior to contractor pickup, including containers requiring autoclave treatment versus incineration?

Is the contractor expected to perform any sorting or segregation of waste after collection?

Answer: The contractor is not required to open containers or sort individual waste items after collection. The contractor remains responsible for determining and performing the appropriate treatment and disposal methods for each waste stream in accordance with the Statement of Work and applicable regulatory requirements.

15. Loading and Pickup Configuration

At Fayetteville, Fort Smith, Springfield, and Joplin, are the regulated medical waste containers picked up at ground level, loading dock level, or a combination of both?

Is the contractor expected to provide all equipment necessary to move the containers from the designated pickup area into the transport vehicle?

Answer: Pickup locations are a combination of ground-level and loading-dock areas. The contractor shall furnish all labor, equipment, and resources necessary to perform the collection and loading services required by the Statement of Work.

16. Trailer Use

Would a fully enclosed commercial trailer that meets all applicable DOT, state, and solicitation requirements for regulated medical waste transportation be considered an acceptable transport vehicle under this requirement?

Answer: The contractor is responsible for ensuring that any vehicle or trailer used in the performance of the contract is suitable and legally authorized for the transportation of the applicable regulated waste, in accordance with the Statement of Work and all applicable federal, state, and local regulatory requirements.

17. Treatment Facility Location

May regulated medical waste collected from the Arkansas locations be transported to a properly permitted treatment or transfer facility located in Missouri, provided the contractor complies with all applicable Arkansas, Missouri, federal, and transportation requirements?

Answer: The contractor is responsible for determining the appropriate transportation, treatment, and disposal methods in accordance with the Statement of Work and all applicable federal, state, local, and regulatory requirements.

18. Partial Quotes and Multiple Awards

Will the Government accept quotes for individual CLINs or make multiple awards?

Specifically, may an offeror quote CLIN 0001 without quoting CLINs 0002 and 0003, or quote CLINs 0002 and 0003 without CLIN 0001?

Because CLINs 0002 and 0003 combine Fort Smith, Springfield, and Joplin, would the Government also consider quotes for individual CBOC locations or combinations of locations, such as Springfield and Joplin only?

Answer: No. The Government intends to make a single award for the entire requirement. Offerors must submit a quotation for all CLINs and all required service locations. Partial quotations will not be accepted.

19. Arkansas Mobilization Period

Arkansas requires commercial medical waste transporters to obtain the applicable state authorization before transporting regulated medical waste.

Would the government allow a newly awarded contractor to begin service at the Springfield and Joplin, Missouri locations on October 1, 2026, while allowing up to 45 calendar days to complete Arkansas permitting before beginning service at Fayetteville and Fort Smith?

If so, would the existing provider continue Arkansas service during that transition period?

Answer: No. The Government would not establish different performance start dates by service location. The solicitation has been amended to provide a transition period from the date of award through October 31, 2026, with full performance at all contract locations beginning no later than November 1, 2026. See Amendment 0001.

20. Timing of State Permit Requirements

Must all required state transporter permits and vehicle approvals be held when the quote is submitted, at the time of award, or only before service begins at the applicable location?

Answer: The contractor shall possess all required licenses, permits, registrations, vehicle approvals, and other regulatory authorizations prior to performing the activities for which the authorizations are required and shall maintain them throughout contract performance.

21. Fayetteville Estimated Quantity

The Statement of Work estimates approximately thirteen full 96 gallon containers per business day at Fayetteville.

The pricing schedule lists 13,800 units under CLIN 0001 for the five year period.

Thirteen containers per business day appears to result in a higher five year quantity.

Please confirm which quantity offerors should use when developing pricing.

Answer: The SOW estimates approximately 13 full 96-gallon containers per business day at the Fayetteville VHSO. Over the five-year ordering period, this appears to exceed the estimated quantity of 13,800 EA under CLIN 0001. Please confirm which estimated quantity offerors should use for pricing and operational planning.

22. CLIN 0003 Monthly Service

Please clarify what services and costs the Government intends offerors to include under CLIN 0003, "Monthly Service for Ft. Smith, Springfield, and Joplin CBOCs."

Specifically, which costs should be included in the monthly service charge versus the per container charges under CLIN 0002?

Answer: CLIN 0003 has been revised. The unit price under CLIN 0002 shall be all-inclusive and include all costs necessary to perform the applicable routine regulated waste services for Fort Smith, Springfield, and Joplin in accordance with the Statement of Work. See Amendment 0001 for the revised Price/Cost Schedule.

23. Emergency Response Requirement

The Statement of Work requires qualified personnel to be onsite within two hours of notification when an onsite emergency response is required.

Given the distance between the listed facilities, would the Government allow either:

a. Different emergency response times based on facility location, particularly for Fayetteville and Fort Smith; or

b. A properly licensed and qualified subcontractor to provide emergency response coverage when necessary?

Answer: The two-hour emergency response requirement will not be revised and applies to all service locations as specified in the Statement of Work. The contractor is responsible for determining the resources necessary to meet the requirement and for ensuring compliance with all applicable contract requirements, including VAAR 852.219-75.

24. Chemotherapy Waste

Please confirm whether the chemotherapy waste expected under this contract is limited to trace chemotherapy waste handled as regulated medical waste.

Does the Government anticipate any bulk chemotherapy waste, RCRA hazardous pharmaceutical waste, or other waste requiring separate hazardous material transportation or disposal requirements?

Answer: Yes. The chemotherapy waste included in this requirement is limited to trace chemotherapy waste as identified in the Statement of Work. Bulk chemotherapy waste, RCRA hazardous pharmaceutical waste, and other hazardous waste streams requiring separate hazardous-waste transportation, treatment, or disposal services are not included in the scope of this requirement.
