All American Express Solutions LLC, the incumbent contractor who successfully completed the previous contract awarded in November 2024 with no performance issues, is the intended awardee. The contracting officer determined that awarding to this SDVOSB would prevent service lapses in critical patient services. This is a short-term 6-month sole source contract. Market research was conducted on SAM.gov, VA ADDS UP, and Procure Sight, revealing similar contracts awarded to multiple SDVOSBs across various NCOs. The award notice will be publicized to the GPE per FAR 5.203-5, with the J&A publicized after contract award per FAR 6.305. Future acquisitions will include additional market research to promote maximum competition.

Justification and Approval (J&A) For

Other Than Full and Open Competition

Acquisition Plan Action ID: 629-26-1-244-0005

1. Contracting Activity: Department of Veterans Affairs, VISN 16, New Orleans Medical Center Department of Veterans Affairs, Network/Program Contracting Office 16, located at 1515 Poydras Street, New Orleans, LA 70112

Purchase Request (VA2237): 629-26-1-244-0005

2. Nature and/or Description of the Action Being Approved:

This requirement is to establish a Courier Service for Southeast Louisiana Veteran Health Care System

(SLVHCS). A fully licensed courier company shall provide delivery between Southeast Louisiana Veterans Health Care System (SLVHCS) located at 2400 Canal St, New Orleans, LA 70119 and five (5) VA Community-Based Outpatient Clinics (CBOC) located at:

VA Outpatient Clinic Slidell- 60491 Doss Dr Ste B Slidell, LA 70460 Baton Rouge South- 7850 Anselmo Lane, Baton Rouge, LA 70810 VA Outpatient Clinic Hammond- 1131 S. Morrison Blvd, Hammond, LA 70403 VA Outpatient Clinic Slidell- 60491 Doss Dr Ste B Slidell, LA 70460

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

Service is needed to transport routine labs, soiled and clean supplies, equipment and instruments;

with hotshot availability for emergency deliveries between the Southeast Louisiana Veterans Health Care System (SLVHCS) and each of the Community-Based Outpatient Clinics (CBOC) clinics. The courier company shall arrive at the VA Community-Based Outpatient Clinics (CBOC) daily to pick-up labs, soiled supplies, and equipment to transport to Southeast Louisiana Veterans Health Care System (SLVHCS) in New Orleans, LA the same day per required schedule. Clean containers of equipment and instruments and soiled containers of equipment and instruments must never be transported together in the same containers. Contractor to furnish all labor, material, supervision, transportation, vehicles, licenses, registrations, training certification documentation and other items necessary to perform courier services as outlined below. Containers to transport the supplies, equipment and instruments will be provided by the Southeast Louisiana Veterans Health Care System (SLVHCS). Unscheduled courier services will be needed twenty-four hours seven days a week.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38

U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR 819.7009 (DEVIATION)- up to $5,000,000. Check the specific VAAR clause used below:

(X) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business; or ( ) 819.7009 Sole source awards to a certified veteran-owned small business

5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

All American Express Solutions LLC, has previously fulfilled this contract for the Government.

Their past performance history is suitable, their prior experience represents the best value to the Government. IAW VAAR 819.7003 (Deviation).

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies:

IAW VAAR 819.7008, it was determined by the CO that the best business decision, to prevent a lapse in critical patient services, would be to sole source this contract to and SDVOSB. The award notice will be publicized to the GPE IAW FAAR 5,203-5. The justification and approval will also be publicized after contract award IAW FAR 6.305.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

Based on market research and analyzing historic contracting pricing in relation to contract number 36C25625P0254, the contracting officer has determined the anticipated amount will be fair and reasonable.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market Research was conducted on SAM.gov, the VA ADDS UP Market Research Application, and the Procure Sight market research application. Results showed similar contracts awarded to multiple SDVOSBs in various NCO’s. However, to prevent lapse in service, a short term 6-month sole source contract is being established.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: This contract was also awarded to All American Express Solutions LLC, in November of 2024 under contract number 36C25625P0254. Resulting in All American Express successfully completing all tasks listed in the SOW with no performance issues being submitted from the COR.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

All American Express Solutions LLC – The contracting officer made the decision to proceed with this requirement under the SDVOSB sole source authority cited above, as such, All American Express is willing to complete all tasks listed in the SOW.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

Additional market research will be conducted to remove all barriers to promote competition to the maximum extent in the future.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
