About this file

This is an Amendment to Solicitation for eye equipment being procured by the Department of Veterans Affairs Network Contracting Office (NCO) 15, located in Leavenworth, Kansas. The amendment extends the response deadline for quotes from the original date to August 10, 2026 at 4:00 PM CDT and provides all answered responses to bidders. No other terms or conditions from the original solicitation are changed.

The solicitation (36C25526Q0518) is unrestricted and not set-aside, as confirmed in the vendor Q&A responses. The Non-Manufacturer Rule (NMR) applies to this multi-manufacturer, brand-name-or-equal acquisition, with the NMR exception permitting small business awards. Authorized distributor letters must identify the vendor providing the quote as an authorized distributor of the brand being quoted. Past performance will be evaluated for the quoted vendor, and manufacturer names and model numbers may be included in non-priced technical submissions with identifying information redacted. The VA requires an all-or-none award for all CLINs with no partial awards acceptable. The equipment is intended for the Columbia VAMC new Rolla Community-Based Outpatient Clinic (CBOC).

36C25526Q0518 Vendors Q&A

1. The SF 1449 appears to mark the acquisition as unrestricted, while the continuation page states that it is intended as a Small Business Set-Aside. Which applies?

o This solicitation is unrestricted and is not set-aside.

2. NMR Waiver

The solicitation states there is no Nonmanufacturer Rule waiver. How should o erors apply the NMR to this multi-manufacturer, brand-name-or-equal requirement?

Meaning and application of the Non-manufacturer Rule “Exception” o The NMR rule applies on every supply buy unless you're awarding to the manufacturer, it's a service, or there's a class waiver. To award small businesses, the NMR "exception" will apply.

3. Must the authorized distributor letter name the prime o eror directly, or may it identify the supplying distributor or reseller supporting the prime?

o The LOS must identify the that the vendor providing the quote is an authorized distributor of the Brand they are quoting.

4. May the prime rely on relevant supplier or distributor past performance where the prime does not yet have comparable corporate past performance?

o Past performance is subject to review for the quoted vendor

5. For the non-priced technical submission, may manufacturer names, model numbers, and product literature be included to demonstrate compliance, provided pricing and o eror-identifying information are removed?

o Yes – If any pertinent information is needing to be redacted, the CO will complete this.

6. Does the VA intend to make one all-or-none award for all CLINs, or may partial awards be made?

o No partial awards are acceptable at this time.

7. Why is this unrestricted?

o Per the Market Research conducted by the Contracting O icer, including the information of no current NMR waiver and responses from previously posted Sources Sought and RFQ, this has been solicited as unrestricted.
