A.1 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (OCT 2025) (DEVIATION)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

1. Technical Acceptability (Pass/Fail). The offeror must demonstrate that the proposed product/service meets each of the minimum requirements stated in the solicitation. Each requirement will be rated Pass or Fail. A rating of "Pass" requires the proposal to clearly show compliance with all stated minimum requirements. A rating of "Fail" on any minimum requirement will render the entire proposal technically unacceptable and ineligible for award. This factor is not scored comparatively. In addition, offerors shall provide the following documentation:

a. Signed SF-1449.

b. Completed price schedule using Excel document, “S02 - RFP Attachment - 36C25226R0071 LineItems.xlsx.” Column ‘O’ (UNIT PRICE) shall be completed by the offeror. Offeror shall return as an Excel document – no other file type is acceptable.

c. Documentation in accordance with VAAR 852.212-71 Gray Market and Counterfeit Items.

d. (Re-stated from the SOW 3.m.) The contractor shall provide all licenses (including third party licenses) in their proposal. Any offer that does not include provisions for the licensing (both primary and third party) required to meet the functional requirements of this SOW shall be rendered technically unacceptable.

2. Past Performance (Pass/Fail). The Government will evaluate the offeror's record of relevant past performance to determine whether it is acceptable. This factor will be rated Pass or Fail; no comparative assessment will be made. An offeror without a record of relevant past performance, or for whom past performance information is not available, will not be evaluated favorably or unfavorably and will be rated acceptable (Pass) on this factor. Offerors should identify relevant past or current contracts (Federal, State, local, or commercial) for efforts similar to this requirement, including any problems encountered and corrective actions taken.

3. Price. The Government will evaluate the total evaluated price for fairness and reasonableness in accordance with FAR subpart 15.4. Price will not be point-scored or rated; it will be used only to rank technically acceptable proposals from lowest to highest.

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
