About this file

This file is a tailored set of instructions to offerors for commercial products and services, formatted according to FAR 52.212-1 standards and customized for a Mobile 1.5 Tesla MRI system lease requirement. The document serves as a template establishing the standard submission requirements and evaluation criteria that vendors must follow when responding to the Tomah VA Health Care System's solicitation for a fully operational mobile MRI trailer lease.

The instructions establish submission procedures, proposal format requirements, and terms applicable to commercial acquisitions under FAR Part 12 streamlined procedures. This tailored version is specific to the MRI equipment lease and maintenance services requirement, which includes transportation, delivery, installation, commissioning, preventive and corrective maintenance, equipment repairs, technical support, training, and software/firmware updates. As a template document rather than specific deliverable requirements, it does not detail unique pricing terms, response dates, or award dates beyond those referenced in the primary solicitation. The acquisition is a competitive Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside under NAICS code 532490, with a firm-fixed-price structure consisting of a twelve-month base period and four twelve-month option periods, plus a potential six-month extension. The contracting vehicle is a commercial acquisition through the Department of Veterans Affairs' Great Lakes Acquisition Center.

Attachment 2: Tailored FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (DEVIATION AUG 2025) Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The version of FAR 52.212-1 in the addendum is tailored for Simplified Acquisition Procedures and supersedes the current version of FAR 52.212-1 contained in the FAR.

The following provision is incorporated into 52.212-1 as an addendum to this solicitation:

52.212-1 Instructions to Offerors—Commercial Products and Commercial Services (DEVIATION AUG 2025)

(a) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. As a minimum, offers shall include—

(1) The solicitation number;

(2) The name, address, telephone number of the Offeror;

(3) The Offeror’s Unique Entity Identifier (UEI) and, if applicable, Electronic Funds Transfer (EFT) indicator;

(4) Information necessary to evaluate the factors contained in the provision at 52.212-2 or as described in the solicitation;

(5) Responses to provisions that require Offeror completion of information, representations, and certifications (other than those collected via the System for Award Management (SAM)); and

(6) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and any solicitation amendments.

(7) Quotation Submission Requirements. In addition to the information required above, the Offeror shall submit the following:

(i) Price. Complete the pricing schedule contained in Attachment 1 for CLINs 0001 through 0005. Quoted monthly unit prices and total prices shall be fully burdened and include all costs necessary to perform the requirements of the Statement of Work. Offerors shall not separately price the potential extension under FAR 52.217-8, Option to Extend Services. The Government will calculate the evaluated price of the FAR 52.217-8 option in accordance with Attachment 3.

The Offeror shall identify any assumptions upon which its quoted pricing is based. Any pricing assumption that conflicts with a requirement of the solicitation may render the quotation ineligible for award.

(ii) Technical/Quality. The Offeror shall provide sufficient information to demonstrate that its proposed mobile MRI system, mobile coach, equipment, services, and performance approach meet the requirements of the Statement of Work. The quotation shall clearly identify the specific equipment proposed and provide supporting documentation sufficient for the Government to evaluate the quotation. At a minimum, the quotation shall include:

(A) Proposed MRI System and Mobile Coach. Identify the manufacturer, model, field strength, bore size, table weight capacity, and configuration of the proposed MRI system and mobile coach. Provide manufacturer product literature, specification sheets, or equivalent technical documentation sufficient to demonstrate compliance with the minimum equipment requirements of the Statement of Work.

(B) Clinical Capabilities and Equipment. Identify the proposed software, clinical protocols, coils, contrast injector, patient positioning equipment, MRI-safe equipment, safety equipment, and other required accessories. Supporting documentation shall demonstrate that the proposed system provides the clinical capabilities and equipment required by the Statement of Work.

(C) Site Compatibility. Describe how the proposed mobile coach will interface with the Tomah VA site identified in the Statement of Work, including the existing concrete pad, available electrical service, physical access/interface, communications connections, and other applicable site requirements. Identify any contractor-furnished adapters, cables, equipment, or other items required for installation and operation.

(D) Delivery, Installation, and Commissioning. Describe the Offeror's approach and anticipated schedule for delivery, positioning, setup, installation/connection, commissioning, testing, and achieving readiness for clinical operation. Identify any actions, information, or support required from VA before the proposed system can become operational.

(E) Maintenance, System Availability, and Replacement Capability. Describe the Offeror's maintenance and technical-support approach and demonstrate its capability to meet the Statement of Work requirements for preventive maintenance, emergency service response, restoration of full operational capability within twelve (12) hours, provision of a fully operational replacement mobile MRI unit within forty-eight (48) hours when required, and minimum 98 percent monthly system uptime. The quotation shall describe how replacement-unit capability will be provided if required.

(F) OEM Support, Parts, Updates, and Accessories. Describe how the Offeror will provide OEM parts, required preventive maintenance and calibration, annual Medical Physicist testing, repair or replacement of contractor-furnished accessories, and required software/firmware updates and upgrades throughout the period of performance.

(G) Training. Describe how the Offeror will provide the applications, biomedical/Engineering, radiologist, and other training required by the Statement of Work, including the proposed training provider and method of delivery.

(H) IT, PACS, and Cybersecurity. Provide sufficient information to demonstrate the proposed system's compliance with the Statement of Work requirements for DICOM communication, VA PACS connectivity, ERA validation, operating-system requirements, remote diagnostic capability, software/firmware support, and applicable VA information-security requirements. Identify any proposed remote-access capability and describe how it will be provided.

(iii) Past Performance. The Offeror shall provide information for up to three (3) recent and relevant contracts or orders involving the lease and/or support of mobile MRI systems or substantially similar medical imaging equipment. For each reference, provide the customer/agency name, contract or order number, description of the products/services provided, period of performance, approximate contract value, and customer point of contact with telephone number and/or email address.

The Offeror may also provide a brief description of its performance under each reference, including information concerning system availability, maintenance and support performance, schedule performance, customer satisfaction, or other information relevant to successful performance of the current requirement.

The Government may consider information provided by the Offeror as well as information obtained independently from CPARS or any other reasonable source. An Offeror without a record of relevant past performance will not be evaluated favorably or unfavorably solely on that basis.

For purposes of this solicitation, recent means performed within the five (5) years preceding the solicitation closing date. Relevant means performance involving the lease and/or support of mobile MRI systems or other medical imaging equipment of similar complexity, scope, and support requirements.

(iv) Required Certification. The Offeror shall complete, sign, and return VAAR 852.219-75, VA Notice of Limitations on Subcontracting—Certificate of Compliance for Services and Construction, with its quotation.

(b) Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(c) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers and any modifications or revisions to the Government office designated in the solicitation by the time specified in the solicitation.

(2) Any offer, modification, or revision received after the time specified for receipt of offers is “late” and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.

(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(4) Offerors may withdraw their offers by written notice to the Government received at any time before award.

(d) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.

(e) Debriefings. If a postaward debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:

(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed Offeror’s offer.

(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.

(3) The overall ranking of all Offerors when any ranking was developed by the agency during source selection.

(4) A summary of the rationale for award.

(5) For acquisitions of commercial products, the make and model of the product to be delivered by the successful Offeror.

(6) Reasonable responses to relevant questions posed by the debriefed Offeror as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.
