One (1) The purpose of this amendment is to address question asked during the question-and-answer period.
In addition, the amendment removes from PWS, Section D. - Other Administrative Information Subtitle 5 - Rates, Subsection e.
Clause FAR 52.211-11 - Liquidated Damages-Supplies, Services, or Research and Development has been added to the solicitation.

Questions and Responses 36C25025R0037 – Paratransit Transportation Services
Question 1: Pages 16-18: Staff Certifications and Licenses: Could you confirm whether copies of all personnel certifications (e.g., first aid, defensive driving, abuse prevention training) must be included in the proposal submission, or if these can be provided upon contract award?
Answer 1: VA does not require these to be included in the proposal submission.
Question 2: Page 78: Can the IHCS please identify if they would like each factor separated or combined into one file. (i.e. Technical, Past Performance, Price OR one file)
Answer 2: Refer to section E.2 Proposal Submission Information and Evaluation Criteria for specification on submission requirements.
Question 3: Page 25: Concierge service is required – will the VA consider making this a separate line item?
0. This is a fixed cost to the contractor, where facilitating trips is variable. It is impossible for our team to incorporate this into a variable pricing format.
0. Please also identify how many company representatives will need to be present at the hours listed in the RFP.
Answer 3A: VA will not consider a separate line item for the Concierge service.
Answer 3B: The PWS does not specify the number of personnel. It is the Contractors responsibility to determine this as a requirement is performance based.
Question 4: Page 5 of 96, under 6. SUBMISSION OF OFFER: it states, 10.) Offerors shall submit a list of vehicles and proof of insurance with their offer. Failure to submit proof of registration with offer will result in the offer being not technically unacceptable/non-responsive and will no longer be considered.
11.) Offerors shall submit a list of all vehicle VINs, documentation of insurance coverage and milage with offer. Failure to submit proof of registration with offer will result in the offer being not technically unacceptable/non-responsive and will no longer be considered.
Question: With this solicitation being issued as an SDVOSB set-aside, the only company that can provide these requested items is the incumbent contractor. As such, this gives an unfair advantage to the incumbent contractor and should be eliminated from the solicitation. It is customary for bidders to show their plan for acquiring vehicles after award for a Paratransit contract. The incumbent is the only company that can provide this information with their proposal. Please consider removing numbers 10 and 11 from page 5 of 96.
Answer 4: B.1 Contract Administration Data, 6 – Submission of Offer, section 10 & 11 remain a requirement upon offer submission.
Question 5: Page 9 of 96 states: “This procurement is intended for a multiple award.” Question: Nowhere else in the solicitation does it reference that there may be multiple awards. Is it the intention of the VA to make multiple awards? If so, how many?
Answer 5: This procurement is intended for multi-award.
Question 6: Does the applicant have to be a company owned by a disabled veteran? And is there a chance if the contract was not awarded to be opened for non veteran owned companies?
Answer 6: This contract is set-aside for SDVOSB.
Question 7: Will drivers or attendants need any medical certifications or training beyond CPR, such as first aid or specific patient care protocols?
Answer 7: Refer to B.5 Performance Work Statement (PWS), Section 6 – Standards for Driver Training.
Question 8: Are there specific performance metrics, such as on-time percentage or reporting requirements, that will be part of the evaluation criteria?
Answer 8: refer to the QASP in section D.
Question 9: Will there be an opportunity for a site visit or further discussion to assess the specific transportation needs at the medical center?
Answer 9: No
Question 10: Where can I find the rate sheet of the contract? I saw the examples given in the contract and I do understand the way of calculation/invoicing but was hoping to locate the rate sheet of all the transportation billing codes.
Answer 10: 60% of trips originate and terminate within a 100-mile radius. The remainder is 100-150 miles. Less than 1% are above 150 miles.
Question 11: Will drivers or attendants need any medical certifications or training beyond CPR, such as first aid or specific patient care protocols?
Answer 11: Refer to B.5 Performance Work Statement (PWS), Section 6 – Standards for Driver Training.
A.1 52.211-11 LIQUIDATED DAMAGES—SUPPLIES, SERVICES, OR RESEARCH AND DEVELOPMENT (SEPT 2000)
(a) If the Contractor fails to deliver the supplies or perform the services within the time specified in this contract, the Contractor shall, in place of actual damages, pay to the Government liquidated damages of per calendar day of delay.
(b) If the Government terminates this contract in whole or in part under the Default—Fixed-Price Supply and Service clause, the Contractor is liable for liquidated damages accruing until the Government reasonably obtains delivery or performance of similar supplies or services. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
(c) The Contractor will not be charged with liquidated damages when the delay in delivery or performance is beyond the control and without the fault or negligence of the Contractor as defined in the Default—Fixed-Price Supply and Service clause in this contract.
