About this file
This is Amendment No. 4 to a Request for Lease Proposals (RLP) issued by the Department of Veterans Affairs for overflow parking at an Oklahoma City facility (RLP No. 34C24W26R0011). The amendment consists of answers to requests for information from potential offerors and clarifications on key lease requirements.
The amendment addresses three primary issues: (1) shell construction costs for the parking lot are the responsibility of the lessor and will not be reimbursed to the VA on Day 1 of occupancy; (2) offerors must obtain fee title to the property within 30 business days of lease execution, with any written agreement to acquire an interest being non-assignable; and (3) subleases are not permitted under this RLP. Regarding authorized representatives, the VA clarifies that while an offer may be submitted on behalf of a property owner by an authorized representative, the owner must serve as the actual offeror and must maintain current UEI, CAGE Code, and SAM.gov registration. Using the representative's own credentials constitutes submission of an independent offer rather than a representative offer. The amendment was prepared by Miranda Kloeppel, Lease Contracting Officer, and approved by William Maddox. Offerors must sign and return the amendment to MIRANDA.KLOEPPEL@VA.GOV to acknowledge receipt.

AMENDMENT NO. 4
Department of Veterans Affairs (DVA)
OKC Overflow Parking VA Request for Lease Proposals
No. 34C24W26R0011
Answers to Request for Information
Question 1: Prior answers to Request for Information mention that most of the build out of the parking lot is part of the shell rent. Does that mean, we will be reimbursed the shell construction cost (stone, asphalt, etc…) on Day 1 once the VA occupies the parking lot?
Answer 1: No. The shell is the responsibility of the Lessor.
Question 2: Refers to Question 38 of RLP Amendment No. 3 which states as follows:
Question 38: Could you please clarify if the offeror is required to own the property outright or provide proof of title within 30 days? Additionally, we would like to know if it is permissible for an offeror to lease the property from the current owner and subsequently sublease it to the Government, provided the offeror has documented authorization from the property owner to do so.
Answer 38: The VA requires the offeror own the property or be able to secure the property and show proof of title within 30 days. The VA will not accept a sublease.
Follow up question: Potential offeror has a few other VA parking leases that are subleases in other areas. Potential offeror is an authorized representative on behalf of the owners for these leases because the owners do not have a UEI, CAGE Code, or SAM.gov registration. Potential offeror has the UEI, CAGE Code, and SAM.gov registration and would like to know if they will be able to provide a quote on behalf of the owner as an authorized representative.
Answer 2: This RLP requires that if the offeror is not currently the fee owner, then the offeror obtain fee title within 30 business days of the execution of the lease.
See RLP No. 34C24W26R0011 Section 3.01 (G)(2) which states as follows: A written agreement to acquire an interest in the Property may not be assignable to any other person or entity. If the offeror is not currently the fee owner, the Lease will contain a requirement that the Lessor obtain fee title within 30 business days of the execution of the lease.
See also RLP No. 34C24W26R0011 Section 1.04 which states in part: The offered space…Shall not be a sublease.
You can submit an offer on behalf of an owner as an authorized representative, however, the owner would be the offeror which would require the owner have the UEI, CAGE Code, and SAM.gov registration in compliance with RLP No. 34C24W26R0011 Section 3.01 (J).
By using your UEI, CAGE Code, and/or SAM.gov registration you are not presenting an offer as an authorized representative but are instead presenting an offer of your own.
All other requirements remain unchanged.
