About this file

This document is Amendment No. 2 to a Department of Veterans Affairs (DVA) Request for Lease Proposals (RLP) for a Community Based Outpatient Clinic (CBOC) in Yukon, OK, with solicitation number 36C24W25R0097. The amendment addresses five key questions from potential offerors, including clarifications about submission requirements, seismic compliance, proposal formatting, facility security, and set-aside status. Notably, the solicitation was previously attempted as a Service-Disabled Veteran Owned Small Business (SDVOSB) set-aside, but was canceled due to pricing issues, and is now being issued as an open-market solicitation that still welcomes SDVOSB proposals.

The amendment provides specific details such as no requirement for a Phase I submission, no specialized seismic compliance needed, preference for separate technical and price proposal volumes, and no mandatory perimeter fence. While the previous solicitations (36C24W24L0078 and 36C24W25R0026) were canceled due to pricing and funding constraints, the current RLP utilizes the results of a Sources Sought Notice from November 7, 2024. The VA emphasizes that the open-market designation does not preclude Service-Disabled Veteran Owned Small Businesses from submitting proposals, and all other original requirements remain unchanged.

AMENDMENT NO. 2

Department of Veterans Affairs (DVA)

Yukon, OK – Community Based Outpatient Clinic (CBOC) VA Request for Lease Proposals

No. 36C24W25R0097 The purpose of this Amendment is to provide the following responses to requests for information:

Question 1: Is a Phase I required to be submitted as part of the initial submission?

Answer 1: No.

Question 2: Does this project require Seismic Compliance?

Answer 2: The delineated area does not fall within the zone requiring specialized seismic compliance outside of general building standards and codes.

Question 3: Is the submission required to be broken into a “Volume I Technical Proposal” and a “Volume II Price Proposal” or can everything be submitted together?

Answer 3: There is no required format for submission. Separate volumes would be preferred.

Question 4: Is a perimeter fence required at the facility?

Answer 4: The VA does not require a permanent perimeter fence as part of the final VA clinic. All offerors should verify local city codes and ordnances as to whether or not a fence would be required to meet any city requirements. Additionally, traffic deterrence measures in front of the facility, such as bollards or big rocks to prevent automobiles crashing into the facility may be required. These security issues will be resolved during design planning.

Question 5: Will this RLP be amended to a make it a Service-Disabled Veteran Owned Set Aside (SDVOSB)?

Answer 5: No. Generally, the “Rule of Two” requires that the CO set-aside a procurement for SDVOSBs, “if the contracting officer has a reasonable expectation that two or more small business concerns owned and controlled by Veterans will submit offers and that the award can be made at a fair and reasonable price that offers best value to the United States.” VAAR 802.101 (emphasis added).

Prior Request for Lease Proposal No. 36C24W24L0078 was posted on SAM.gov on July 16, 2024, as a SDVOSB set aside. The VA received final offers outside the range determined to be fair and reasonable and over the amount budgeted. Consequently, on October 21, 2024, RLP No.

36C24W24L0078 was canceled due to all offers being above the established fair and reasonable price resulting in the VA being unable to comply with FAR 15.402(a).

Thereafter, the VA determined that the SDVOSBs were unable to provide fair and reasonable pricing for this procurement.

The solicitation was re-issued beginning with Sources Sought Notice (SSN) No.

36C24W25R0026 posted on November 7, 2024, followed by RLP No. 36C24W25R0026 as an open-market solicitation. RLP No. 36C24W25R0026 was subsequently cancelled due to lack of funding.

SSN No. 36C24W25R0026 was posted on November 7, 2024, less than one year prior to the posting of the current RLP, with essentially the same requirements as that of the current RLP.

Therefore, it was determined the CO should utilize the results of SSN No. 36C24W25R0026 for the current RLP. The current RLP has been issued as an open-market solicitation.

The designation of this RLP as open-market does not preclude Service-Disabled Veteran Owned Small Businesses from submitting a proposal. The VA welcomes all proposals to this solicitation.

All other requirements remain unchanged.
