This document is an amendment to a Request for Lease Proposals (RLP) for a Department of Veterans Affairs (DVA) Community Based Outpatient Clinic (CBOC) in Stillwater, OK (Solicitation No. 36C24W24R0085).

The amendment addresses several clarifications and changes to the RLP, including the Building Specific Amortized Capital (BSAC) pricing, Tenant Improvement (TI) allowance, tax and operating cost adjustments, security requirements, janitorial staffing, and audio-visual systems. Specifically, the amendment confirms that the $12.00/ABOA BSAC can be added to the $338/ABOA TI allowance for a total of $350/ABOA. It also clarifies that tax and operating cost adjustments may be considered if included in the proposal. The amendment provides guidance on security requirements, stating that the government will work with the lessor to price and install the required duress alarm system. Lastly, it confirms that janitorial staff will be required on-site during clinic hours, but that the lessor will not be responsible for disposing of hazardous or pathological waste. Offers conforming to the amended RLP requirements are due by 3:00 PM Central Time on 8/30/2024.

AMENDMENT NO. 4

Department of Veterans Affairs (DVA)

Stillwater, OK – Community Based Outpatient Clinic (CBOC) VA Request for Lease Proposals

No. 36C24W24R0085

This is an eleven part / question amendment:

Question 1 (In Global RLP):

Section 1.10 B of the RLP calls for the security to be part of the Building Specific Amortized Capital (BSAC), section 3.09 of the RLP calls for a $12.00/ABOA for the BSAC.

Can you please confirm the $12.00/ABOA should be added to the BSAC on the 1364 and that the security countermeasures and pricing will be determined post award?

Answer:

$12.00 can be added to the 1364. Pricing will be determined post award. We are combining the $338 and $12 to equal $350 for TI cost.

Question 2 (In Global RLP):

Section 3.07 calls for a $317.20/SF TI Allowance. This contradicts section 1.08 of the lease template that states a $350.00/SF. Can you please clarify.

Answer:

Please change section 3.07 to $338. We arrive at $350 by adding $338 and the $12.00 for BSAC. In section 1.08 the total is $350.

Question 3 (In Global RLP):

Section 3.09 of the RLP provides the BSAC pricing. However, section 1.10 of the lease, the BSAC is not filled out. Can you please clarify.

Answer:

We do not separate our TI’s and BSAC. Therefore, our current practice is to have our TI amount available for lump sum distribution. If we go over our TI allowance the VA reserves the right to request any overages to be amortized in the shell rent. This will be negotiated after award and after the DID/CDs during TI negotiations.

Question 4 (In Exhibit A, Lease Template):

Section 1.13 has been modified and references section 2.07 that is intentionally deleted. Can you clarify will there be any real estate tax adjustments available throughout the 10-year term?

Answer:

The VA prefers firm fixed pricing but if tax adjustment and operation costs adjustments are in your proposal, then sections 1.12, 1.13, 1.14, 2.07 and 2.09 of the lease will remain in effect.

Question 5 (In Exhibit A, Lease Template):

Section 1.14 and Section 2.09 have been intentionally deleted. Section 3.11 of the RLP is unclear on adjustments for operations cost. Can you please clarify?

Answer:

See above answer to question 4.

Question 6 (In exhibit B, ASR):

Section 1.1.9 item 4 states Lessor to supply electric sit-to-stand desk options for all solid surface/built-it desk options. Can you please confirm that this will be a part of the furniture package and will not be the responsibility of the Lessor.

Answer:

It is the builders responsibility if it is in a built-in.

Question 7 (In exhibit B, ASR):

Section 4.1.6 states the Government shall provide a scope of work for the duress alarm.

Can you please confirm this is to be included as part of the BSAC allowance and will be finalized post award.

The GC will work with VA security official to price and install the VA approved alarm system.

Question 8 (In exhibit B, ASR):

Section 7.5 states Lessor shall provide an audio-visual systems. Since this to be Lessor provided, can you please provide a specification for this system.

Answer:

Audio-visual systems are not required to be installed by the lessor.

Question 9 (In exhibit B, ASR):

Section 8.2.2 states that Lessor shall not be responsible for disposing of hazardous or pathological waste. However, section 9.0.2.7 of the ASR states the Lessor shall be responsible for collecting of sharps containers and hazardous materials throughout all leaded space. Can you please confirm the Lessor shall not be responsible for disposing and or collecting of hazardous or pathological waste.

Answer:

Lessor housekeeping team will pick up sharps/biohazard for exam/lab areas and place in biohazard rooms. The VA will arrange contracted picked up of said items from the biohazard rooms.

Question 10 (In exhibit B, ASR):

Per section 9.0.2 of the ASR, can you clarify that janitorial maintenance staff will be required to onsite during clinic hours.

Answer:

Yes, this is minimal staffing to allow for daytime spill cleanup, general cleaning, restocking.
