AMENDMENT NO. 7
Department of Veterans Affairs (DVA)
Norman, OK – Community Based Outpatient Clinic (CBOC) VA Request for Lease Proposals
No. 36C24W24R0018
This amendment is to provide answers of clarification to the following questions concerning RLP No. 36C24W24R0018:
Question 1: Is an edited Lease Design Narrative available for this project?
Answer 1: No, the supplied SEPS plan is a preliminary plan and will be refined during the build out.
Question 2: Are canopies required? If so, what are the design requirements?
Answer 2: No
Question 3: Is a separate dental equipment room required? What are the space and technical requirements for the dental equipment room?
Answer 3: A dental equipment room of 80-100 sq ft is required and will be included in the
ABOA sq ft. The room will require a mini-split HVAC and additional sound barriers in the walls. Mechanical room equipment will be ordered by VA and General Contractor to ensure specific design for compressed air, water, etc. is followed.
This space will also need a water heater for eye wash stations to have tepid water of 80-100 degrees Fahrenheit.
Question 4: A reception space was not identified in the Program for Design. Will this function be performed by another staff member in another space?
Answer 4: The reception is included in the Veterans welcome area.
Question 5: Per Exhibit B 7.5.1 it indicates all AV equipment to be provided by Lessor.
Typically, VA CBOCs are AV rough-in only and equipment is provided by the VA.
Please confirm displays, projectors, speakers, mic, etc. to be provided by the Lessor.
Answer 5: This project requires rough in data, electrical and HDMI set up.
Question 6: Per Exhibit B 7.6 – Lessor will provide a certified cabling system to support the wireless access points. Will the VA provide the wireless heat map identifying the wireless access point locations through a VA approved contractor like ATT? Shall the public WiFi network only be required to cover the lobby area and lessor areas and not VA clinical areas?
Answer 6: VA will supply guest and VA secure WiFi per their IT service and contracting. The General Contractor will be responsible for the placement of all needed data access and cabling throughout the space to allow for these systems to function. The placement of the data access and cabling will be determined during build out.
Question 7: Per Amendment 3 – Emergency Generator is required to cover dental and procedure rooms. Do you want the emergency generator to cover IT and Security equipment as well to extend operation beyond battery backup.
Answer 7: The generator will be used as a safety precaution in the event a patient is on the table or in an invasive procedure during the power outage. Additionally, a generator will be used in the supply and sterile rooms for temperature/humidity monitoring and reduction in potential lost product during power outages. An emergency generator for IT and Security equipment is not required.
Question 8: Does the VA require a “Dark Skies” component to exterior lighting?
Answer 8: Not required.
Question 9: Are EV charging stations or infrastructure to support EV charging stations required? If yes, how many locations?
Answer 9: Not required.
Question 10: How many receptionist/check in stations are desired?
Answer 10: One check in with 3-4 receptionists. In addition to the check in there will also be a single check out for return appointment scheduling.
Question 11: Will there be a queuing system and who is responsible for providing?
Answer 11: There will not be a queuing system.
Question 12: Can a previously completed Past Performance Questionnaire, Past and Present
Performance Questionnaire, Performance Confidence Survey, Past Performance Survey, ORP Past Performance Questionnaire, or CPARS be submitted, as long as it represents the project being presented for past performance evaluation in this proposal response and also presents the same data requested in the solicitation?
Answer 12: Yes
Question 13: Please confirm the broker commission fee percentage?
Answer 13: The VA is not using a broker for this project so no broker commission fee will apply.
Question 14: Is a land lease acceptable?
Answer 14: No, section 3.06 D states in pertinent part:
If the Offeror is not the fee simple owner at the time of award, the parties agree that within 30 days after execution of this Lease, Offeror will demonstrate it has obtained satisfactory title showing fee simple ownership of the property. Fee simple title must be free of any encumbrances that may limit the rights, responsibilities, or liabilities of the parties to this Lease. Offeror’s failure to provide evidence of fee simple ownership within the specified timeframe shall give VA an immediate right to terminate the Lease for default. If a termination for default occurs due to the Offeror’s failure to provide fee simple ownership within the specific timeframe, the Offeror will not be entitled to any payment whatsoever arising under or related to the Lease.
Question 15: Would a 30-day due date extension please be considered?
Answer 15: No additional extensions will be considered.
Question 16: Section 5.02 of the RLP indicates that the Swing Space was deleted from the RLP, however these requirements still exist in the L100 Lease Template. Please confirm the Swing Space will not be required for this opportunity.
Answer 16: Swing Space will not be required in new build. In the event you are presenting an existing building we will consider using swing space in the new lease.
Question 17: Please provide the current Design Basis Threat (DBT) or current ISC DBT as it relates to blast resistance of windows, façade, and structure.
Answer 17: Not required.
Question 18: Does the requirement for acceptable fragment retention film or preferred glazing systems in Exhibit C – Facility Security Level Requirements Section 2.1 apply to all exterior glazing systems?
Answer 18: No, only those that will be identified during the design phase.
Question 19: Please confirm that the Green Building Rating requirements only apply to the building interiors.
Answer 19: See RLP Section 3.10 paragraph 2.
Question 20: Section 2.03 and 2.04 of the RLP indicates Seismic Safety has been deleted from the RLP, however, these requirements are included in section 1.07 of the Lease agreement under Seismic Form C. Please confirm if this form is required for this opportunity.
Answer 20: It is not required.
Question 21: We are assuming we will use the new codes (Building Code and FGI guidelines) that will become in vigor in 2024. Would you please confirm? (Section 3.06) Answer 21: The most current government/state approved building codes should be used.
Question 22: Would you please confirm if this RLP will be considered CUI? The clause in the
GSA Template L-100 document for Norman, OK includes CUI designation on the documents.
Article 6.21 includes language that will be included in all subcontracts; per section 8 of that clause must be included (including, offerors, bidders, awardees, first tier consultants, contractors, subcontractors, suppliers, etc.
designating the documents be marked and handled as CUI. If it is, we will need further directions on how this is to be handled and also highlighted in yellow.
Please review and advise on what you want us to do. There are also FAR regulations that are required to be included in all subcontracts and first tier subcontracts as stated in GSA form 3516 and GSA form 3517B (6.21). See highlighted below; the Lease agreement also included flow down terms and conditions required for subcontract and first tier subcontractors those too are highlighted in yellow. Again, would you please confirm the extent of compliance with these requirements? Would you please provide the CUI category and CUI distribution list if the efforts are indeed to be handled and marked as CUI?
Answer 22: We only give the Lease and/or drawings associated with the Lease to those that have a need to know. We are only level 2 security, and we don’t feel most of this clause as quoted will apply.
Question 23: Will the TIA be amortized or paid in lump sum at substantial completion?
Answer 23: We plan to pay the TIA in lump sum but will keep all clauses dealing with amortization in the Lease at this time.
All other requirements remain unchanged.
