(b) Amendments to solicitations.

If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).

(c) Submission, modification, revision, and withdrawal of proposals.

(1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror. Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.

(2) Offerors are responsible for submitting proposals, and any modifications or revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.

(3) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(4) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or

(5) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(7) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. (9) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.

(d) Offer expiration date.

Proposals in response to this solicitation will be valid for the number of days specified on the solicitation cover sheet (unless a different period is proposed by the offeror).

(e) Evaluation.

Proposals will be evaluated pursuant to FAR Part 15.101-1 Tradeoff Process, with emphasis placed on the evaluation factors criteria provided in the solicitation. The award decision will be based on a comparative assessment of proposals against all source selection criteria in the solicitation. Offers will be evaluated using the criteria listed in the "Evaluation Factors”.

The Source Selection Evaluation Board (SSEB) is responsible for conducting this source selection in accordance with the stated requirements of this Source Selection Plan (SSP) and the Request for Proposal (RFP). The evaluation of proposals shall be performed in accordance with the RFP to allow for a best value decision to be made. The Source Selection Authority (SSA) may use tradeoffs in the evaluation of technical and price.

Offerors shall submit responses to all evaluation factors provided in the solicitation. The Offerors shall also provide all pricing information necessary to provide a meaningful basis for the Government's analysis and evaluation of price for Project 626A4-18-105 Renovate Ward 1A. The Government does not intend to request certified cost or pricing data.

NOTE: In accordance with FAR 15.101-1(b)(2), all evaluation factors other than price, when combined, are approximately equal to price.

Each offeror's proposal shall be evaluated against the separate factors listed. These factors represent the key areas of importance and emphasis to be considered in the source selection decision by supporting meaningful comparison and discrimination between and among competing proposals. They will serve as the uniform baseline against which each offeror’s proposal is evaluated allowing the Government to make a best-value determination.

Ratings of each factor will be based on the assessed strengths, uncertainties, and deficiencies of the proposal. The factors are listed below as follows:

Factor 1 - Contractor Experience:

Offerors shall identify at least one (1) construction project exceeding $1 Million in magnitude within the past Ten (10) years that involved new construction or renovation to add new elevator(s) in a hospital. Offerors shall provide the following information for each project:

(1)Detailed project description of scope.
(2)Government or private sector Engineering point of contact (POC) information.
(3)Contract number
(4)Contract award value
(5)Location
(6)Contract duration - Period of Performance (POP) start date and end date.

Factor 2 – Past Performance The Government will evaluate the offeror’s past performance for the Experience factor to determine if the offeror has the ability to manage a large dollar elevator project without significant difficulty. To demonstrate past performance, offerors should attempt to provide at least one (1) Past Performance Questionnaire (PPQ) for the following technical factor:

(1) Factor 1 - Contractor Experience, NOTE: PPQs shall be sent directly to the Contracting Officer by the client(s)

Factor 3 – Price:

The offeror shall provide a price for Offer Item 1 (Base Offer) and Offer Item 2 (Deduct Alternate). The Government will evaluate offers for award purposes. The proposed price will be analyzed for reasonableness. It may also be analyzed for the different divisions of work to be performed, reflects a clear understanding of the requirement; and is consistent with the Offeror’s Technical Proposal. A detailed price breakdown is required and shall be provided on the “S02-Upgrade Elevators Proposal Breakdown Example” worksheet provided with the solicitation. If a detailed price breakdown is not included in the offeror’s price proposal, the contractor may be excluded from further consideration of contract award. Pricing will be evaluated in accordance with FAR 15.4 to determine reasonableness and evaluate potential performance risks. In this context, reasonableness will be determined by comparing offered prices with the Government estimate. This factor will be evaluated as either reasonable or unreasonable. The Government reserves the right to cancel subject RFP and re-solicit via another mechanism should a fair and reasonable price not be achieved, or reasonableness of price cannot be determined.

(f) Exchanges with Offerors The Government intends to make award without discussions. However, the Government reserves the right to hold discussions. If discussions are determined to be needed, the Government may establish a competitive range for the purpose of conducting discussions. Therefore, each initial offer shall contain the Offeror's best terms from a price and technical standpoint.

Notwithstanding, the Government may conduct discussions with all responsible Offerors who submit proposals and are considered within the competitive range. Offerors submitting proposals determined outside of the competitive range (lacking a reasonable chance of being selected for contract award) will be notified in writing.

A.Clarifications: Limited exchanges, between the Government and offerors that may occur when award without discussions is contemplated.
B.Communications: Exchanges between the Government and offerors after receipt of proposals, leading to establishment of the competitive range. Communications shall be held with offerors whose past performance information is the determining factor is preventing them from being placed within the competitive range. Communications may only be held with those offerors whose exclusion from, or inclusion in, the competitive range is uncertain. Such communications shall address adverse past performance information to which an offeror has not had a prior opportunity to respond; and these communications may be conducted to enhance Government understanding of proposals; allow reasonable interpretation of the proposal; or facilitate the Government's evaluation process. Such communications shall not be used to cure proposal deficiencies or material omissions, materially alter the technical or cost elements of the proposal, and/or otherwise revise the proposal.
C.Exchanges with offerors after establishment of competitive range / Discussions /Negotiations: Negotiations are exchanges, in either a competitive or sole source environment, between the Government and offerors, that are undertaken with the intent of allowing the offeror to revise its proposal. These negotiations may include bargaining. Bargaining includes persuasion, alteration of assumptions and positions, give-and-take, and may apply to price, schedule, technical requirements, type of contract, or other terms of a proposed contract. When negotiations are conducted in a competitive acquisition, they take place after establishment of the competitive range and are called discussions.
D.Competitive range: If award cannot be made on initial proposals and discussions are determined necessary, a competitive range will be established to include only those proposals that have a reasonable chance or award.
E.Strength: A proposal area which clearly exceeds the requirement resulting in a high level of confidence in the offeror's abilities.
F.Weakness: A proposal area which barely meets the requirement resulting in a low level of confidence in the offeror's abilities.
G.Deficiency: A proposal area which does not meet the requirement resulting in no level of confidence in the offeror's abilities.

(g) Contract award.

(1) The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value to the Government in accordance with the factors in the solicitation. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the offeror specifies otherwise in the proposal.

2.2 52.216-1 TYPE OF CONTRACT (APR 1984)

The Government contemplates award of a Firm-Fixed-Price contract resulting from this solicitation.

(End of Provision)

2.3 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.
