The purpose of this amendment is to provide clarification/correction to the following questions (refer to attached) and extend the due date of the solicitation to May 23, 2022.
**TIME FOR QUESTIONS IS CLOSED**
Yamil O. Gomez
Contracting Officer
Q1. Questions 86, In Factor 1 Subfactor (b) 5, Please confirm that a CV or resume is all that is required of proposed staffing (not licenses or transcripts).
A1. Please refer to the solicitation Factor 1, subfactor (b): management, experience, and Staffing, number 5, letters a and b, page 180.
a. Key Personnel List. Provide a list of the names of the qualified physicians, physician assistants, nurse practitioners, and other primary care provider staff intended to be utilized in the performance of this contract and/or describe the mechanism used to provide qualified physicians, physician assistants, nurse practitioners, and primary care provider staff to perform the contract work.
b. List the number of administrative support staff and describe the level of training and experience that will be utilized to meet the administrative support functions of this contract, including such functions as patient scheduling, medical record documentation, record processing and reporting
Q2. Questions 17, The PACT Module Design Guide recommends a ratio of approximately 3 Exam
Rooms per teamlet, please clarify the desired ratio for patient care exam/consult rooms per PACT teamlet for each clinic.
A2. Please refer to the solicitation section 4.9, page 97 regarding the requirements.
Q3. Question 2, the government referred to section 7.2.1.3. Section 7.2.1.3.4 clearly states that “This list will include the names of all Veterans who are assigned to the Contractor’s site of care in PCMM and have had at least one (1) qualifying encounter with
Contractor’s PCP within the previous 12 months.” This means that if the incumbent is unsuccessful, the new contractor will NOT have seen ANY patients in the last 12 months and that the new contractor will have to vest every existing enrollee starting day one.
--We do not think that is the VA’s intention, so please confirm the VA’s intention.
--If the new contractor does not inherit the previous contractor’s last vesting visits, please confirm the contractor will not be held to Mission Act appointing standards until the VA’s newly created backlog in appointing is cleared.
--If the new contractor does not inherit the previous contractor’s last vesting visits, please confirm that the VA will handle all medication management for patients until patients are vested by the new contractor.
A3: Yes, the new contractor will inherit the billable roster, and then each month the contractor is to send an updated roster identifying any new additions or removals to the COR who will verify.
Q4. In the answer to Question 11, the government was asked to provide the most recent three months’ billing enrollment numbers for each clinic, but specifically did not answer, instead referring bidders to the estimated amount. The actual billing enrollment numbers is traditionally answered during Q&A and serves to level the playing field among all bidders. Without this information the incumbent has an unfair advantage, because it knows the actual numbers rather than the estimates, which may or may not be accurate.
Please provide the most recent three months’ billable enrollment numbers for each
CBOC.

Q5. In A79, the government clarified that the startup period is 90 days. Given the nationally acknowledged supply chain issues, this is a completely unrealistic expectation for anyone but the incumbent, which can continue seeing patients in existing clinics until construction is complete. Please allow contractors to present a six month rolling start-up plan for the clinics so that the RFP does not unfairly favor the incumbent and shut out competition.
A5: Start-up is 90 days
Q6. The government has separate CLINs for Primary Care and Mental Health.
a. Can the same patient be billed for each line item if they are using both services?
A6. Refer to solicitation section 7.2.1 Billable Roster.
b. Is a mental health patient automatically placed on the mental health roster?
A6. Refer to solicitation section 7.2.1 Billable Roster.
Q7. In the answer to Q46, the Government states that a Doctor of Osteopathy is not acceptable for the role of a physician under this contract. This decision significantly reduces the availability of qualified physicians who are universally accepted at other
CBOCs and by the VA itself (see 38 USC Sec. 7402(b), which states that to be eligible to be appointed to a physician position with the VA, a person must hold a degree of doctor of medicine or of doctor of osteopathy . . .”). Restricting the physician position to only doctors of medicine seems like an unnecessary restriction that will limit the pool of eligible caregivers, which could both reduce the level of care and increase the cost of hiring physicians, and also has the impact of limiting competition. Please confirm that
Doctors of Osteopathy are eligible to be used in these CBOCs, just as they are eligible for physician positions with the VA itself.
A7. Yes.
Q8. With regard to the answer to question 70, if the VA is requiring a Regional Operations
Director or a Regional Medical Director, please provide the qualifications for these positions.
A8. Qualifications for Regional Medical Director or Physician Director, please Refer to
Section 2.2 of the Solicitation, pages 23-24. For Regional Operations Director or
Administrative Associate, please refer to Section 2.3.4 of the solicitation, page 28.
Q9. In order to give contractors time to update pricing and their proposals, please extend the proposal due date for 30 days after all questions have been answered.
A9. Solicitation was extended until May 16th and on this amendment is hereby extended until May 23rd.
Q10. The Answer to Q64 regarding the Rule of Two analysis and its result states that the answer is “proprietary information, source selection sensitive. The Government did the due diligence, and this solicitation was issued as a result of it.” The VA (not any private company) is required to conduct a Rule of Two analysis, so the answer of whether the VA did so cannot be proprietary. Also, as the VA is required to conduct the analysis, the answer as to whether such analysis is done does not seem to be protected source selection sensitive information. Please confirm that the VA conducted a Rule of
Two analysis with regard to this solicitation.
A10. Yes
Q11: Yes. The Answer to Q65 regarding the review of the VIP database and its result states that the answer is “proprietary information, source selection sensitive. The
Government did the due diligence, and this solicitation was issued as a result of it.” The VA (not any private company) is required to review the VIP database, so the answer of whether the VA did so cannot be proprietary. Also, as the VA is required to do the review, the answer of whether or not the review was done does not seem to be protected source selection sensitive. Please confirm that the VA reviewed the VIP database for VA-verified SDVOSB concerns with regard to this solicitation.
A11: Yes.
Q12. The Answer to Q67 regarding the bundling analysis and its result states that that the answer is “proprietary information, source selection sensitive. The Government did the due diligence, and this solicitation was issued as a result of it.” The VA (not any private company) is required under FAR 7.107-2(a) to conduct a consolidation analysis, so the answer of whether the VA did so cannot be proprietary. Also, as the VA is required to conduct the analysis, the answer as to whether such analysis is done is unlikely to be protected source selection sensitive. Please confirm that the VA did the steps required by FAR 7-107-2(a) with regard to this solicitation.
A12. Yes
Q.13. Given the significance of continuing questions and the need for contractors to update their locations and proposal information based on those answers, please extend the proposal due date to 30 days after final questions are answered.
A13. Solicitation was previously extended until May 16th and on this amendment is hereby extended until May 23rd. Time for question are already closed on April 25th.
