About this file

This is an amendment to a federal contract solicitation that modifies the technical and management capability evaluation criteria for medical grade gas supply.

Amendment 2 adds two specific capability demonstration requirements for offerors who are not the manufacturer of the medical grade gases. Non-manufacturer quoters must identify their medical grade gas manufacturer sub-contractors and provide evidence of those manufacturers' state-required licensing, permits, or registrations for the states where contract performance will occur. Additionally, non-manufacturer quoters must provide either manufacturer-approved language for inclusion in their product service agreement with the manufacturer or a copy of a previously executed agreement demonstrating authorization to resell medical grade gases under federal contract, alternatively acceptable as a letter from the manufacturer affirming authorization to resell the gas under this specific contract. The amendment establishes that failure to provide either type of evidence may render a quote incomplete, giving the government discretion to decline further evaluation or award consideration of incomplete submissions.

AMENDMENT 2 – ATTACHMENT B

Section 3 - Solicitation Provisions, E.1 Instructions to Offeror, 3.0 Award Basis, Factor 1:

Technical and Management Capability, iii. Capability to Perform is hereby amended to include subtext a. and b.:

iii. Capability to Perform –

Offeror must demonstrate that it currently possesses the personnel, equipment, standards, work processes, licenses/permits/certifications and general resources to accomplish all the requirements of the Performance Work Statement by the time of offer submission.

a. If the Quoter is not the manufacturer, the Quoter must identify the medical grade gas manufacturer(s) that will be used as sub-contractors and produce evidence of the manufacturer(s)’ licensing, permits or registrations as required by the states in which this contract is performed. Failure to provide this evidence may render the quote incomplete, and the government reserves the right to not further evaluate incomplete quotes or consider them for award.

b. In the event the Quoter is not the manufacturer, the Quoter must provide manufacturer-approved language that will be included in its product service agreement between the Quoter and the manufacturer (or a copy of a previously executed agreement under a different acquisition between the quoter and manufacturer of the medical gases) that affirmatively demonstrates that the quoter will be (or has been) authorized by the manufacturer to resell the manufacturer’s medical grade gases under a federal contract. In lieu of this language, a letter from the manufacturer affirmatively indicating that it will authorize the quoter to resell the gas under this contract will be acceptable. Failure to provide this evidence may render the quote incomplete, and the government reserves the right not to further evaluate incomplete quotes or consider them for award.
