About this file

This is an Amendment to a federal solicitation (36C24626Q0873) for medical grade gas cylinder lease services at the Asheville Veterans Affairs Medical Center (VAMC), issued by the Department of Veterans Affairs Network Contracting Office 6 in Hampton, Virginia. The amendment extends the offer due date to August 21, 2026, at 10:00 AM EDT and updates the cost/price schedule, adds insurance clauses, amends instructions to offerors, and provides responses to vendor questions.

The solicitation requires supply of various medical grade gases and related cylinder rental services for a one-year base period (October 1, 2026 – September 30, 2027) with four one-year option periods. Line items include oxygen medical grade cylinder refills (3,360 units annually), cylinder rentals for sizes A through E (1,692 units) and larger sizes (816 units), oxygen cylinders with regulators (7,200 units), and specialty gases including helium, nitrogen, carbon dioxide, nitrous oxide, argon, and specialized lung diffusion gas mixtures. NAICS Code 325120 (Industrial Gas Manufacturing) applies. Deliveries are required Tuesdays and Thursdays in morning hours to the warehouse dock area on an FOB Destination basis. The government will evaluate offers using a modified lowest price technically acceptable (LPTA) basis, considering technical capability (including three years' experience and two similar contracts), past performance, and price. Offerors must possess all required federal, state, and local licenses and certifications for medical gas distribution at the time of proposal submission and provide proof of insurance per FAR 52.228-5 and supplemental insurance requirements. Subcontracting exceeding 50% of total labor effort renders offers non-compliant. Emergency delivery services are available as a separate line item.

Attachment A SECTION 3 - SOLICITATION PROVISIONS, E.1INSTRUCTIONS TO OFFERORS, 3.0 AWARD BASIS is hereby Amended to read:

“By submission of its quote, the quoter accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The Government will evaluate each quote for completeness and compliance with all instructions of this solicitation. Quotes will be evaluated based on the factors outlined below.

FACTOR 1: Technical and Management Capability.

The quote will be evaluated based on how well the proposed services meet and/or exceed the requirements in the performance work statement. The Government reserves the right to select a quote that provides benefit to the Government that exceeds the minimum requirements of the solicitation but is not required to do so. The Government will evaluate the quoter’s ability to meet the following requirements of the solicitation:

i. The Government will evaluate the Quoters demonstrated capability to provide Medical Grade Gas supplies as a primary business function. The Government will assess whether Medical Grade Gas supplies are clearly established as the quoter’s principal line of business. The Government will evaluate any proposed subcontracting and determine whether the level of subcontracted work presents a pass-through risk. Quotes proposing subcontracting exceeding 50% of total labor effort will be considered non-compliant and may be rejected.

ii. Provide/submit a detailed technical and management approach for completing all requirements of the STATEMENT OF WORK (SOW). This comprises management and operation (safety procedures, staff training plans etc.) to include start up time needed between notice of award and start of service.

iii. Capability to Perform - Offeror must demonstrate that it currently possesses the personnel, equipment, standards, work processes, licenses/permits/certifications and general resources to accomplish all the requirements of the Performance Work Statement by the time of offer submission.

iv. Experience: For each contract provided in response to this factor, the offeror shall explain in a detailed narrative how the characteristic of the selected contract relates to the services required by this solicitation. Contractor must have and show three years of experience relating to Medical Grade Gas Cylinder Lease. Provide at least two (2) similar contracts undertaken within the past three years.

Factor 2: Past Performance Past performance information will be utilized to determine the quality of the contractor’s past performance as it relates to the probability of success of the required effort. The Government will evaluate customer satisfaction, responsiveness to customer needs, and past demonstration of meeting delivery schedules and the delivery of quality services. Emphasis will be on recent, relevant past performance in the previous 3 years. Recent is defined as work performed within the last three years. Relevant is defined as work similar in size and scope of the work described in the Performance Work Statement (PWS).

Past performance information is one indicator of a quoter’s ability to perform the contract successfully. Current and relevant information, source of information, context of data, and general trends in Contractor’s performance shall be considered as it pertains to the performance of work described in this solicitation. Quoters may provide information on problems encountered on identified contracts and the quoter’s corrective action. The Government shall consider this information as well as information obtained from any other sources when evaluating the quoter’s past performance.

Since the Government may not necessarily interview all of the sources provided by the quoters, it is incumbent upon the quoter to explain the relevance of the data provided. Quoters are reminded that the Government may elect to consider data obtained from other sources.

Quoters with no relevant past performance or whom information is not available, shall not be evaluated favorably or unfavorably on past performance, but may be considered less favorably than a quoter with favorable performance history.

Factor 3: Price Prices shall be submitted in accordance with the Price Schedule contained in the Solicitation. Total price will be evaluated by the Government. In evaluating the quoter’s proposed price for this project, the Government concern includes determining price reasonableness.

Reasonableness determinations will be made by determining if competition exists, by comparing proposed cost/price with established commercial prices, other contract vehicles, and/or by comparing proposed cost/price with the Independent Government Cost Estimate (IGCE). The IGCE is not releasable to the public.”

B.2 PRICE/COST SCHEDULE has been updated.

Vendors’ Questions:

1. As the NAICS for this RFQ is 325210 Industrial Gas Manufacturing, please confirm whether this is a Service Contract or a Supply Contract.

This solicitation is for Supply of Medical Grade Gas.

2. The solicitation identifies NAICS 325120 and consists primarily of medical gas products and cylinder-related CLINs. Section C.7 incorporates VAAR 852.219-76, "Certificate of Compliance for Supplies and Products." However, Section E.1 instructs offers to submit VAAR 852.219-75, "Certificate of Compliance for Services and Construction.” These two requirements appear inconsistent. Please clarify.

This is a Supply Contract. VAAR 852.219-76 “Certificate of Compliance for Supplies and Products” is the correct Clause applicable to this solicitation.

Section E.1 is hereby Amended to replace Clause 852.219-75 with Clause 852.219-76.

3. Please confirm the contract resulting from this solicitation will be FOB Destination. The contract resulting from this solicitation will be FOB Destination.

4. Will the contract resulting from this solicitation include any CUI (or any other term/acronym that refers to sensitive contract material within in the VA) – as it pertains to a Cybersecurity Maturity Model Certification (CMMC) for federal contractors?

Clause 52.228-5- Insurance – Work on a Government Installation and CL-120 Supplemental Insurance Requirements are hereby added to Solicitation 36C24626Q0873 and resulting Contract.

5. Will the GOV please add a CLIN for an Annual Audit for the VAMC as there are actual costs associated with having the Prime Contractor send a POC each contract year to perform cylinder audits (travel, lodging, etc.)?

No. Please reference SOW 4.0. The Government does not pay for vendor travel to conduct onsite inventories.

6. What is the GOV’s rationale for evaluating on an LPTA basis in awarding work as critical as the distribution of medical-grade oxygen, a prescription drug, to a VA Medical Center?

SOLICIATATION 36C24626Q0873, SECTION 3 - SOLICITATION PROVISIONS, E.1INSTRUCTIONS TO OFFERORS, 3.0 AWARD BASIS has been Amended.

7. How is the GOV going to validate that offerors are properly insured for NAICS 325120/221210 – the actual requirement for this work to comply with the RFQ?

The assigned COR and myself, the Contracting Officer, will ensure insurance compliance. All licensures must be possessed and provided at the time of offer submission. Additionally, Clause 52.228-5- Insurance – Work on a Government Installation and CL-120 Supplemental Insurance Requirements are hereby added to Solicitation 36C24626Q0873 and resulting Contract.

8. How do offerors confirm to the GOV that they have the correct type of Liability Insurance, and does this need to be affirmed at the time of bid submission (if not, an awarded firm could be turned down or not be able to afford this coverage in the amounts the GOV requires, respective to NAICS 325120)?

Clause 52.228-5- Insurance – Work on a Government Installation and CL-120 Supplemental Insurance Requirements are hereby added to Solicitation 36C24626Q0873. Offeror must possess and provide proof of insurance at the time of offer submission.

9. Please confirm the GOV POC who enforces and ensures post-award compliance with FAR 52.212-4 (Contract Terms and Conditions—Commercial Products and Commercial Services) as well as VAAR 852.219-76 (Limitations on Subcontracting for Supplies and Products/Certificate of Compliance)?

The assigned COR and Myself, the Contracting Officer, will ensure compliance with FAR 52.212-4 and VAAR 852.219-76.

10. To ensure uninterrupted delivery of medical-grade gases to the VAMC and to avoid post-award delays that could impact patient care, will the GOV revise the solicitation to require SDVOSB offerors to submit, with their proposal submission, evidence that they currently hold all applicable federal, state, and local licenses required for the distribution and delivery of medical-grade gases, including gases classified as prescription drugs, as a definitive responsibility criterion? Please see Amended SECTION 3 - SOLICITATION PROVISIONS, E.1INSTRUCTIONS TO OFFERORS, 3.0 AWARD BASIS.

11. Given that medical oxygen and other medical-grade gases are life-sustaining products regulated as prescription drugs, does the GOV intend to limit competition to offerors that are already legally authorized to distribute and deliver such products at the time proposals are submitted, in order to avoid delays in commencement of performance following award? The Offeror must possess and provide all required licenses/permits/certifications as referenced in Section 3, E.1, 3.0, Factor 1, iii at the time of submitting the Offer in accordance with requirements in the SOW.

12. Will the status of an offerors’ license (in this case, a registered wholesaler of drugs and/or devices in the state of North Carolina) be evaluated as a definitive responsibility criterion during the consideration of offers?

Yes. The Offeror must have all licenses/permits/certifications as referenced in Section 3, E.1, 3.0, Factor 1, iii, at the time of submitting Offer.

13. How will the GOV evaluate a proposal submitted by an offeror that does not possess an active and applicable medical gas distribution license at the time of proposal submission but proposes to obtain or rely upon such licensure after award?

The Offeror must possess and provide all required licenses/permits/certifications as referenced in Section 3, E.1, 3.0, Factor 1, iii at the time of submitting the Offer in accordance with requirements in the SOW. If the Offeror is determined not to be technically acceptable and/or have the capability to performance the SOW, the offer will not be eligible for award.

14. Will the GOV please confirm that the required federal and state of North Carolina licenses and certifications applicable to the SDVOSB offeror must be provided in the name of the Prime Contractor at the time of bid submission (and cannot be delegated to a subcontractor), which is required of an SDVOSB offeror in order to comply with the applicable federal, state, and local regulations in order to meet the requirements of the Statement of Work in this RFQ (wholesale distribution of medical-grade oxygen/compressed gases where medical-grade oxygen is defined by the FDA as a prescription drug)?

The Offeror must possess and provide all required licenses/permits/certifications as referenced in Section 3, E.1, 3.0, Factor 1, iii at the time of submitting the Offer in accordance with requirements in the SOW. If the Offeror is determined not to be technically acceptable and/or have the capability to performance the SOW, the offer will not be eligible for award.
