36C24625B0001 10-01-2024

X X X The purpose of this amendment is to post answers to received questions.

The bid due date is NOT extended. The bid due date remains November 14th, 2024, at 4:00pm EST.

Contracting Questions

1) Can you please confirm if the GC is required to self perform 35% of the construction activities for the bid to be accepted. If yes, does the 25% represent the $ value of the project? Can you please clarify that the 25% self performance requirement is an error? Is 15% performance acceptable?

A: IAW 13 CFR 121 and NAICS code 236220, this project is classified as General Construction. Therefore, the prime must comply with VAAR 852.219-73 (3) and cannot pay more than 85% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not certified SDVOSBs listed in the SBA certification database.

2) Is this a tax-exempt project?

A: No. See FAR 52.229-3 (incorporated by reference)

3) If tax-exempt, will the government provide the prime contractor with a tax-exempt certificate for use by subcontractors and vendors?

A: This is not a tax-exempt project.

4) In the event of contract modifications, should contractors apply bond premiums to the individual modification or wait until the end of the job where the VA issues a final modification to reimburse contractors for bond overruns for all mods?

A: The VA will not reimburse contractors for after contract closeout. As per FAR 52.243-4 (incorporated by reference) “(f) No proposal by the Contractor for an equitable adjustment shall be allowed if asserted after final payment under this contract.” Any increases in bond premiums must be included the contractor’s proposal for modification. See VAAR 852.243-70 Construction Contract Changes.

5) Please confirm the requirements of an Itemized Schedule of Values or is a CSI Division breakdown adequate at the time of bid? A Schedule of Values can be provided post-award. Also, please confirm that copies of all subcontractor quotes are required.

A: Yes, an itemized schedule of values and subcontractor quotes are required. As stated in NOTE 1, “Bidders must submit an Itemized Schedule of Values Cost breakdown in their bid in sufficient detail to permit a complete analysis of labor, materials, equipment, transportation, supervision, disposal costs, overhead, and profit. This breakdown shall cover all work involved in accordance with (IAW) the Statement of Work (SOW). If an Itemized Schedule of Values Cost breakdown is not provided, the bidder’s or offeror’s bid will be deemed non-responsive.”

6) Please confirm the project schedule is to be “cost loaded”.

A: Yes. Bids must include all costs both direct and indirect.

Personnel Questions

7) Are we required to have a Virginia General Contractor’s license in order to work on the Richmond campus?

A: While the contractor is required to build to accepted VA codes (See PG-18-3) and must provide all required licenses and permits as per FAR 52.236-7, a Virginia General Contractor’s license is not required.

8) Can the Superintendent be shared across multiple projects, or should they only be dedicated full-time to this project?

A: No, the superintendent cannot be shared across multiple projects. As stated in 01 45 00 3.1 General Requirements, “The project superintendent maintains a physical presence at the site at all times…” [emphasis added]. If the superintendent moved to a different location to supervise another project, that would violate the terms of the contract.

9) Can the Superintendent fulfill the Quality Control Manager (QCM) role? (Can the superintendent dual hat as the QCM?) Please confirm the CQC System Manager should be a separate individual from the prime contractor superintendent or can the superintendent dual role and fulfill the requirements of the CQC System Manager if qualified to do so.

A: As stated in 01 45 00 3.4 Quality Control Organization, “The CQC staff will be subject to acceptance by the Contracting Officer […].” Upon the recommendation of the project COR, the CO will not accept the Superintendent fulfilling the Quality Control Manager role.

10) If the Super cannot fulfill this role, the average ADDITIONAL cost for a dedicated QCM is approximately $[redacted] per month (salary, labor burden, per diem, housing, company vehicle, monthly return trips home, company phone, etc). We expect this project to be 14 months long, and the bid is expected to increase by ($[redacted] x the number of months we expect). Please confirm a dedicated QCM is still required.

A: As stated in 01 45 00 3.4 Quality Control Organization, a Quality Control Manager is required for this project.

11) If the QCM is required to be onsite, should they be assigned to this project only, or can they be assigned to another project as well?

A: As stated in 01 45 00 3.4 Quality Control Organization, “This CQC System manager is on the site at all times during construction and is employed by the General Contractor.” (emphasis added)

12) Can a subcontractor fulfill the QCM role with periodic visits?

A: As stated in 01 45 00 3.4 Quality Control Organization, “This CQC System manager is on the site at all times during construction and is employed by the General Contractor.” (emphasis added)

13) Can the Superintendent fulfill the Site Safety & Health (SSHO) role? Please confirm the SSHO should be a separate individual from the prime contractor superintendent or can the superintendent dual role and fulfill the requirements of the SSHO if qualified to do so.

A: Yes, the SSHO must be a separate person. As per 01 35 26 1.7(c) Site Safety and Health Officer, “…the SSHO has [to] be a separate qualified individual from the Prime Contractor’s Superintendent and/or Quality Control Manager with duties only as the SSHO.”

14) If the Superintendent cannot fulfill this role, the average ADDITIONAL cost for a dedicated SSHO is approximately $[redacted] per month (salary, labor burden, per diem, housing, company vehicle, monthly return trips home, company phone, etc). We expect this project to be 14 months long, and the bid is expected to increase by ($[redacted] x the number of months we expect). Please confirm a dedicated SSHO is still required.

15) If the SSHO is required to be onsite, should they be assigned to this project only, or can they be assigned to another project as well?

A: As per 01 35 26 1.7(d) Site Safety and Health Officer, “The SSHO or an equally-qualified Designated Representative/alternate will maintain a presence on the site during construction operations in accordance with FAR Clause 52.236-6: Superintendence by the Contractor.” (emphasis added)

16) Can a subcontractor fulfill the SSHO role with periodic visits?

A: As per 01 35 26 1.7(d) Site Safety and Health Officer, “The SSHO or an equally-qualified Designated Representative/alternate will maintain a presence on the site during construction operations in accordance with FAR Clause 52.236-6: Superintendence by the Contractor.” (emphasis added)

17) Is tuberculosis testing required before contractors can commence work onsite?

A: Yes. As per 01 35 26 1.13 Tuberculosis Screening, “Contractor shall provide written certification that all contract employees assigned to the work site have had a pre-placement tuberculin screening within 90 days prior to assignment to the worksite and been found have negative TB screening reactions.

18) Are any AISC substitute certifications acceptable instead of AISC certification?

A: No. Section 01 45 35 2.1 Fabricators Special Inspection does not allow for any alternative certifications.

19) The referenced specification calls for a commercial photographer to document construction through an online interface. Please confirm this requirement or can progress photos be taken by the prime contractor’s superintendent and submitted electronically? / Section 01 00 00-35 C. states that photos shall be taken by a “professional photographer”. Will this be a requirement?

A: Section 01 00 00 1.22 Photographic Documentation C clearly states, “Images shall be taken by a commercial photographer […].”

Time/Hours

20) What trades or scopes will be required to perform off-hours work for work scopes that must be performed? / Does the VA require any scope of work in this project to be performed outside of regular work hours?

70) Please confirm if 96% of the preexisting signs will be reused as indicated or if additional demolition and replacement are required for signs that may not meet current specifications.

A: All current signs in the work area are to be replaced and old existing signage to be turned over to VA.

71) The manual specifies subsurface printed glyphs, but the current restroom signs have raised glyphs. Should we proceed with the raised glyph design, or must we follow the subsurface printing as per the manual?

A: All Signage is to follow direction given on drawing page AW-601 and related specifications. Do not match/reuse any existing signage or existing signage templates from the demolition areas.

Toilets

72) Will the VA allow contractors to use VA indoor restrooms? Can Porta Johns be placed within a 100’ radius of the job site if required?

A: Use of a portable toilet for this project may not be feasible as this would require a laydown area or other facility prior approved/established space be provide/identified which has not been nor sought/authorized for the project per the provided plans. Shared use of restrooms will be designated and approved by VA/COR in writing and must follow all VA guidelines on care and use of shared restrooms.

A: Parking authorization is made per specification section 01 00 00 1.5 E / 1.6 N. Contractor conditional parking allowance/use can only occur after receipt of the Facility/COR authorization of the parking arrangement for the project. Typical expectation is for workers to be shuttled to/from the building from offsite.

Additional

74) As indicated by the phasing in the Scope, we are required to maintain hospital accessibility to the portions of Rad Oncology Laboratory not under construction. What does that mean, and does it apply to the other adjacent services?

A: It means that the adjacent areas are going to continue to provide care for patients. Thus, all egress routes, construction pathways, and work that impacts patient care (vibration or loud noises) must be contained, scheduled, and completed to minimize impacts to patient care and must be approved by the COR in writing IAW drawings page GI-111 phasing and ICRA requirements, VA and all construction/Hospital safety guidelines.

75) What are the ICRA requirements during construction times? How much of the loud construction or demo transport is expected to be accomplished after hours or on weekends?

A: It is for the contractor to diagnose what work as described in GI-111 note #9 should be scheduled/completed after hours if work vibrations or noise can affect patient care services. Prior to work commencing plan must be sent to COR/CO for approval in writing. If during completion of work, the noise and/or vibrations impact patient care during the day Contractor will be contacted by COR to correct situation immediately IAW provided drawing package, ICRA and VA guidelines.

76) Since the outages will most likely impact the rest of Radiation Oncology how much coordination is required to install the new power panels and plumbing tie ins?

A: Outages must be approved in writing by COR. Outages may require after hours to avoid impact to patient care services IAW the provided drawing package.

77) Where is the T.I.L. (Technical Information Library) for the standards and specifications that is listed in the Scope of Work?

A: It is found on the internet at https://www.cfm.va.gov/til/
