B.3 PERFORMANCE WORK STATEMENT (PWS)
SHREDDING CONTRACTUAL SERVICES
1. GENERAL: This is a services contract to provide services to shred and dispose of all sensitive paper materials and media destruction at the Department of Veterans Affairs (VA) Central Virginia VA Healthcare System (CVHCS) in Richmond, Virginia. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
a. Description of Services/Introduction: The contractor shall provide all labor, personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform shredding and disposal of all sensitive paper materials and media destruction as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.
b. Background: CVHCS requires services to shred and dispose of all sensitive paper materials and media destruction. The Contractor is responsible for providing all personnel, equipment, tools, materials, vehicles and other items and services necessary to perform shredding services to include the CBOCs located in Emporia, Fredericksburg (Southpoint, Mary Washington, and Massaponax), Charlottesville, and Henrico, VA. Confidential materials shall be handled according to applicable local, state and federal regulations. The Contractor shall be a full-service shredding contractor who can demonstrate expertise and qualifications in confidential document destruction management.
c. Objectives: The objective of this service is for the Contractor to shred and dispose of all sensitive paper materials and media destruction safely and in compliance with all applicable local, state and federal regulations.
d. Period of Performance: The period of performance shall be for one (1) Base Year of 12 months and four (4) 12-month option years. The Period of Performance reads as follows:

e. Place of Performance: The work to be performed under this contract will be performed at:

2. SCOPE. The CVHCS requires services to shred and dispose of all sensitive paper materials and media destruction. Media Destruction includes floppies, tapes, DVD’s, CD’s, VHS, VIC cards, printer ribbons, memory cards, super disks, 35mm film and x-rays. The contractor is responsible for providing all personnel, equipment, tools, materials, vehicles and other items and services necessary to perform shredding services at the CVHCS to include the Community Based Outpatient Clinics (CBOCs) located in Fredericksburg (Southpoint, Mary Washington and Massaponax), Emporia, Henrico and Charlottesville, VA. Confidential materials shall be handled according to applicable local, state and federal regulations.
3. SPECIFIC REQUIREMENTS:
1. All paper and media shall be shredded on site. Written approval from the Contracting Officer (CO) shall be required prior to any material that is not completely shredded shall be allowed to be transported off site.
a. All shredded material received at the Contractor’s facility for further destruction shall be destroyed within 48 hours in accordance with NIST Records Management regulations.
2. All functions provided by the Contractor shall meet the standards IAW VA Directive 6371, Destruction of Temporary Paper Records and follow the National Institute of Standards and Technology (NIST) Special Publication 800-88 (NISTSP 800-88) Guidelines for Media Sanitization. Contractor shall provide a certificate of destruction directly after service to include date, signature, amount shredded and HIPPA disclaimer to the COR.
3. All loads leaving the VA facilities must be secured and sealed before transportation. All VA material arriving at the Contractor destruction facility must be shredded material.
4. All breaches of security will be reported to the VA immediately. Documentation of Chain of Custody of all materials removed from any VA campus is required.
5. Contractor will submit all required reports in a timely matter. All required reports will be submitted to the COR no later than 10 days after the close of the month for monthly reports, or by the required timeframe provided by the report.
6. The Contractor shall monitor all shred containers at the CVHCS and CBOCs for damage. Contractor shall report damage to the COR and report underutilized containers so the COR for reutilization if needed.
a. Damage report will be provided as needed or within 7 days.
b. Underutilization report will be provided monthly to the COR.
7. The Contractor shall provide all necessary locked collection bins and containers. All the collections bins and containers shall have a keyed lock to limit access. All containers shall be like keyed.
a. The Contractor shall supply the Contracting Officer Representative (COR) with 1 key to facilitate opening containers if needed.
b. The Contractor shall supply the COR with extra keys upon request, the COR will be responsible for all keys issued to the CVHCS.
8. If additional collection containers are required, they shall be provided by the Contractor through a bilateral contract modification.
4. QUALITY CONTROL: The Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program (QCP) is the means by which he/she assures himself/herself that his work complies with the requirement of the contract. The QCP is to be delivered within 30 days after contract award or with the contractors proposal if it is an evaluation factor, three copies of a comprehensive written QCP shall be submitted to the CO and COR within 5 working days when changes are made thereafter. After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.
5. Media Sanitization and Disposal Compliance:
The Contractor documents/records shall show that the Contractor sanitized information system media, both paper and digital, using approved equipment, techniques and procedures, prior to disposal or release for reuse and are consistent with current VA media sanitization procedures and NISTSP 800-88, Guidelines for Media Sanitization. The Contractor shall maintain records or documents that show that the media sanitization control responsibility has been assigned and specific actions taken to ensure the implementation of this control.
The Contractor documents/records shall show that they consistently apply media sanitization and disposal on an ongoing basis. Records cannot be sold advantageously or otherwise salvaged; the records may be destroyed by pulping or shredding or other suitable means following NISTSP 800-88 guidelines.
6. Media Transport Compliance:
All breaches of security will be reported to the VA immediately.
Documentation of Chain of Custody of all materials removed from any VA campus is required. The Contractor documents/records shall show that the unit restricts the pickup, receipt, transfer, and delivery of information system media (paper and electronic) to authorized personnel. The Contractor shall maintain a list of personnel that have been authorized for the pickup, receipt, transfer, and delivery of information system media to determine if access is appropriately restricted. The Contractor shall maintain records or documents that show that the media transport control responsibility has been assigned and specific actions taken, to ensure the implementation of this control. The VA requires that the Contractor control MODERATE and HIGH-impact information systems media (paper and electronic) and restricts the pickup, receipt, transfer, and delivery of such media to authorized personnel. When anomalies or problems are encountered by the Contractor in the implementation of the media transport control, these are documented and the resulting information is used to improve the control.
7. Additional Requirements:
1. VA Handbook 6300.1 “Records Management Procedure” shall be applicable to all record/microfiche destruction. The procedure reads: “The authorized destruction of records that are classified or otherwise restricted from disclosure by statute, such as Privacy Act of 1974 or Title 38 USC, must be witnessed by a Federal employee or a contractor employee. If a contract is used to dispose restricted VA records, the facility Records Officer must authorize the use of a contractor or subcontractor employee to witness the destruction.
The Contractor must provide documentation that the contractor employee is authorized to witness destruction of the record. Resale of VA records for use as records or documents is prohibited.
8. Confidentiality of Material Destruction: Contractor personnel shall maintain the confidentiality of the material to be destroyed. Any contractor personnel found to be reading any of the CVHCS materials shall be promptly removed from the government premises. The person(s) involved shall not be allowed to return to the CVHCS for any future service requests.
B.3.1: VHA Supplemental Contract Requirements for Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors
| 1. | Contractor employees who work in or travel to VHA locations must comply with the following: |
| a. | Documentation requirements: |
| 1) | If fully vaccinated, shall show proof of vaccination |
| i. | NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination |
| 2) | If unvaccinated and granted a medical or religious exception, shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor’s order or an FDA approved over-the-counter test. |
| 3) | Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel. |
| 4) | Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information. |
| 2. | Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the following website: COVID-19 Screening Tool. Regularly check the website for updates. |
| a. | Contractor employees who work away from VA locations, but who will have direct patient contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information. |
| 3. | Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.” |
B.4 SPECIAL CONTRACT REQUIREMENTS
9. COORDINATION.
a. Hours of Operation: Services shall be provided each Wednesday between the hours of 8:00 a.m. – 3:30 p.m. at the CVHCS and biweekly at the CBOCs. If the regularly scheduled shredding day falls on a national holiday, the Contractor can perform the service either the day prior to or the day after the holiday and shall inform the CVHCS Contracting Officer Representative (COR) of the revised shredding day.

2. When New Year’s Day, Juneteenth National Independence Day, Independence Day, Veterans Day or Christmas Day falls on a Sunday, the following Monday is observed; if it falls on Saturday the preceding Friday is observed.
c. Collection Methods: The collection method should complement the CVHCS current process. Contracts should limit inference with patient care.
d. On-Site Reporting: All Contractor personnel must first report to the Office of Police to sign in and get a contractor badge which must be worn while on station. Personnel must return badge and sign out upon exiting station.
e. Identification of Contractor Employees: All Contractor personnel must present themselves in clean and neat uniform with an employee ID and a clearly display the contractor badge. Contractors must conduct themselves in a professional and courteous manner.
A. Audits:
1. Audits will be conducted on a regular basis by the CVHCS Informational Security Officer and Privacy Officer. Upon request, they will have access to Contractor’s training records, operation process, storage, transportation and destruction documents, policies and procedures.
B. Personnel Screening Compliance:
1. The Contractor’s records/documents must show that they appropriately screen individuals requiring access to the CVHC’s information and information systems prior to authorizing access.
2. The Contractor must maintain records or documents that show that the personnel screening control responsibility has been assigned and specific actions taken to ensure the implementation of this control.
3. The Contractor documents/records must show that they consistently conduct personnel screening for positions within their working unit on an ongoing basis.
4. When anomalies or problems are encountered by the Contractor in the implementation of the personnel screening control, these are documented, and the resulting information is used to improve the control.
5. VA requires that all personnel be subject to an appropriate background screening prior to permitting permanent access to VA information and information systems, in accordance with requirements contained in VA Directive and Handbook 0710, VHA Personnel Suitability and Security Program, and VA Handbook 0735, Homeland Security Presidential Directive 12 (HSPD-12) Program.
10. BACKGROUND INVESTIGATIONS
All contractor employees are subject to the same level of investigation as VA employees who have access to VA Sensitive Information. The level of background investigation commensurate with the level of access needed to perform the statement of work is: Low Risk, Tier 1. The Contractor shall bear the expense of obtaining background investigations. If the investigation is conducted by the Office of Personnel Management (OPM) through the VA, the Contractor shall reimburse the VA within 30 days. Upon award, the CO shall provide the Contractor with detailed instructions on fulfilling security requirements.
11. CONTRACT ADMINISTRATION DATA
a. Notwithstanding the Contractor's responsibility for total management during the performance of this contract, the administration of the contract will require maximum coordination between the Government and the Contractor.
b. The Contracting Officer is the only person authorized to approve changes or modify any of the requirements of this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitments or issue changes that shall affect price, quantity or quality of performance of this contract.
c. The COR shall be responsible for the overall technical administration of this contract as outlined in the COR Delegation of Authority.
d. In the event the contractor effects any such change at the direction of any person other than the contracting officer without authority, no adjustment shall be made in the contract price to cover an increase in costs incurred as a result thereof.

14. INVOICES
The contractor shall submit payment requests in electronic form via VA's Electronic Invoice Presentment and Payment System http://www.fsc.va.gov/fsc/einvoice.asp. Invoices shall be submitted monthly in arrears. The following information must be included on all submitted invoices. Invoices submitted without the following information may be rejected for payment. Invoices shall include at a minimum:

· Date of Service
· All invoices submitted must be accompanied by copies of all certificates of destruction for that billing period.
15. GEMS:
The CVHCS has a Green Environmental Management System (GEMS). The CVHCS is committed to protecting and improving the environment.
Our goals are:
· Taking a leadership role in environmental stewardship by providing a clean and safe environment in our community;
· Conserving natural resources and supporting their sustainability by upgrading our environmental systems;
· Reducing the use of hazardous products and the generation of wastes;
· Purchasing renewable, reusable, recyclable and recycled products;
· Working to constantly improve the immediate and long term environmental impacts of the products, services and processes used by the CVHCS. The Contractor must follow the spirit of GEMS and recycle all applicable material. The Contractor will follow the GEMS guidelines provided by the CVHCS GEMS coordinator.

C.1 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.2 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

(a) Definition. As used in this clause— United States or its outlying areas means—

(a) Pursuant to 38 U.S.C. 8127(k)(2), the offeror certifies that—
(1) If awarded a contract (see FAR 2.101 definition), it will comply with the limitations on subcontracting requirement as provided in the solicitation and the resultant contract, as follows:

(3) If VA determines that an SDVOSB/VOSB awarded a contract pursuant to 38 U.S.C. 8127 did not act in good faith, such SDVOSB/VOSB shall be subject to any or all of the following:
(i) Referral to the VA Suspension and Debarment Committee;
(ii) A fine under section 16(g)(1) of the Small Business Act (15 U.S.C. 645(g)(1)); and
(iii) Prosecution for violating section 1001 of title 18.
(b) The offeror represents and understands that by submission of its offer and award of a contract it may be required to provide copies of documents or records to VA that VA may review to determine whether the offeror complied with the limitations on subcontracting requirement specified in the contract. The Contracting Officer may, at their discretion, require the Contractor to demonstrate its compliance with the limitations on subcontracting at any time during performance and upon completion of a contract if the information regarding such compliance is not already available to the Contracting Officer. Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed.
(c) The offeror further agrees to cooperate fully and make available any documents or records as may be required to enable VA to determine compliance with the limitations on subcontracting requirement. The offeror understands that failure to provide documents as requested by VA may result in remedial action as the Government deems appropriate.
(d) Offeror completed certification/fill-in required. The formal certification must be completed, signed, and returned with the offeror’s bid, quotation, or proposal. The Government will not consider offers for award from offerors that do not provide the certification, and all such responses will be deemed ineligible for evaluation and award.
