The Contractor shall furnish all labor, tools, materials, and equipment to support installation of replacement and new Wi-Fi Access Points at Loch Raven VA Medical Center, in accordance with the SOW, specifications, and drawings attached hereto. Contractor will be responsible to coordinate and schedule the work to minimize to a short duration and shall be expected to plan work typically during duty hours of 8 AM to 4:30 PM eastern time except as noted in the general conditions and as approved by the Contracting Officer.

The NAICS Code for this procurement is 236220 Size standard: $45 million Magnitude of construction is between $0 and $25,000.

Pursuant to 38 U.S.C.8137(D), this requirement is 100% set aside for Service-Disabled Veteran Owned Small Business.

All SDVOSB's are required to be registered at www.sba.gov, as well as www.sam.gov, prior to the submission of the offer and at the time of award. All SDVOSB statuses will be verified. Note for Joint Venture (JV) Offerors: In accordance with VAAR 852.219-73(f) joint ventures may be eligible so long as the joint venture meets the requirements of 13 C.F.R. 128.402. In order to comply with 13 C.F.R. 128.402(e) JV offerors must include in their Volume I a certification, signed by an authorized official of each partner to the joint venture, stating that the parties to the joint venture (1) have entered into a joint venture agreement that fully complies with paragraph (c) of 13 CFR § 128.402 and (2) will perform the contract in compliance with the joint venture agreement. Failure to submit the certification will render the offeror ineligible for award.

CONSTRUCTION SCOPE OF WORK

EHRM NEXTGEN WIFI UPGRADES

PROJECT NAME: EHRM NextGen Wi-Fi AP Completion – Loch Raven, MD

1. GENERAL INTENT:

The Contractor shall furnish all labor, tools, materials, and equipment to support installation of replacement and new Wi-Fi Access Points at Loch Raven VA Medical Center 3901 Loch Raven Blvd Baltimore, MD.

The AT&T NextGen Wi-Fi Contractor is responsible for the bulk of the work under a separate OI&T contract. Please note that the scope of this work is limited and specifically as listed below.

2. STATEMENT OF WORK:

Provide and install conduit, raceways, horizontal and vertical penetrations, and fire stopping to support NextGen Wi-Fi installation on the Loch Raven campus as shown and described in the project drawings and specifications. AP 14, 15, 16, and 19 in the attached drawing require conduit to be ran for install. All horizontal or vertical penetrations made through walls or floors must be fire caulked and sealed. Any penetrations made through a wall or floor in an active user area must be properly corrected, which may include sanding, mudding, sealing, re-flooring, and/or re-painting.

Before work can be conducted in Building 4, the contractor must test for Asbestos. If asbestos is discovered, the contractor must generate an asbestos disposal plan to be reviewed by the VA IH team. Any waste generated from work conducted in Building 4 must be properly disposed of and follow the procedures outlined below.

Hazardous Waste (Includes but is not limited to Lead and Lead-Based Paint wastes, Dental Amalgam wastes) The contractor must dispose of all universal wastes as described above that does not remain intact as hazardous waste per EPA hazardous waste guidelines (40 CFR 260-299) and COMAR 26 Subtitles 13-18. The contractor must also dispose of all hazardous wastes per EPA hazardous waste guidelines (40 CFR 260-299) and COMAR 26 Subtitles 13-18. All required paperwork such as hazardous waste sampling and testing (e.g., EPA SW-846 TCLP); waste profiles, hazardous waste manifests and land disposal restriction (LDR) forms that go with the hazardous waste manifests will be filled out by a MD licensed, hazardous waste subcontractor. The contractor will schedule and coordinate hazardous waste removal with VAMHCS Safety personnel. Hazardous waste manifests will be signed by ONLY a VAMHCS employee with DOT RCRA training certification (please contact VAMHCS GEMS Manager) and a copy provided to VAMHCSGEMSProgram@va.gov. Final signed manifests must be received by the VAMHCS from the hazardous waste Treatment, Storage, and Disposal Facility within 45 days of waste shipment per EPA 40 CFR 263.20-.25 as well as Code of Maryland Regulations (COMAR) 26.13.03.06.

a. Comply with EPA and MDE requirements for proper handling (such as bagging, sealing and recycling) Mercury-Containing Devices (may include but are not limited to thermometers, manometers, pressure stats, gauges, float or level controls, load meters, supply relays, phase splitters, and sink traps) per 40 CFR 273 and COMAR 26.13.02.08, 26.13.10.06, 26.13.10.09 and 26.13.10.20, 26.13.10.21 and 26.13.10.26 or latest requirements.

b. All hazardous waste expected as a result of renovation, demolition or construction activities (including but not limited to mercury-containing dental amalgam wastes, fluorescent bulbs, electrical devices that contain PCBs) must be properly managed and disposed in accordance with EPA and MDE requirements per EPA 40 CFR 260-299 as well as COMAR 26.13.02.01, 26.13.02.08, 26.13.10.20, 26.13.10.21 and 26.13.10.26 or latest requirements.

c. Records of hazardous waste disposal (such as manifests, hazardous waste profiles, LDRs) must be provided by approved waste transporter and signed by an approved VAMHCS Manifest signer from the VAMHCS Safety Department. All records provided to COR and VAMHCS GEMS Coordinator at VAMHCSGEMSProgram@va.gov

d. All hazardous chemicals that need to remain at the job site must be stored and handled in accordance with EPA; MDE; OSHA and NFPA requirements.

ASBESTOS WASTE

The contractor must dispose of all asbestos waste per COMAR 26-11-21-08 ASBESTOS WASTE DISPOSAL:

· Waste Containing Asbestos Waste. A person who engages in or has engaged in an asbestos project shall comply with the following:

(1) Deposit all asbestos waste, including sealing tape, plastic sheeting, mop heads, sponges, filters, and disposable clothing, in plastic bags of at least 6 mils thickness and seal the bags.

(2) Clearly label the bags and any structural components wrapped in plastic as required in §A(3), of this regulation, as asbestos waste. In addition to any label required by 29 CFR Part 1910 or 40 CFR Part 61, affix a label including the following information:

(a) The number of the person's license to remove or encapsulate asbestos; and

(b) The date the bag was sealed.

(3) If large structural members containing asbestos cannot be bagged or placed in containers, wrap them in 6 mil plastic, and tape the plastic closed and label them as required in §A(2), of this regulation, before transporting them to the disposal site.

(4) Ensure that asbestos waste is segregated from other waste and kept in a secure area or securely locked containers.

B. Removing Asbestos Waste from the Project Site. A person who engages in or has engaged in an asbestos project shall comply with the following:

(1) Remove asbestos waste from the site of an asbestos project that is not subject to 40 CFR Part 61 not later than 24 hours after completing the asbestos renovation, demolition, or encapsulation project;

(2) Remove asbestos waste from the site of an asbestos project that is subject to 40 CFR Part 61 not later than 7 days after completing the asbestos renovation, demolition, or encapsulation project;

(3) After removing asbestos waste from the site of an asbestos project, dispose of the asbestos waste as provided in §D, of this regulation, or comply with interim storage requirements under §C, of this regulation.

C. Interim Storage.

(1) A person may not store asbestos waste unless:

(a) The person is licensed by the Department under this chapter;

(b) Less than 20 cubic yards of asbestos waste is stored;

(c) The asbestos waste is enclosed in rigid containers which are kept in a secure area; and

(d) The person has submitted a written application for and received Departmental approval under §C(2), of this regulation.

(2) The Department will incorporate any approval for interim storage of asbestos waste in the license granted under this chapter and may include reasonable conditions to ensure that the stored asbestos does not become a threat to the public health.

D. Transport and Disposal. A person who engages in or has engaged in an asbestos project shall comply with the following:

(1A) Prior to transport to approved disposal facility, Asbestos-containing waste MUST BE segregated from other wastes and identified as such (and stored per the requirements above).

(1B) Asbestos-containing waste manifests will be signed by ONLY a VAMHCS Safety

Department employee and a copy provided to the VAMHCS Industrial Hygienist and GEMS Manager for the specific VAMHCS facility. Final signed manifests must be provided to the VAMHCS.

(1) Transport and dispose of asbestos waste in a manner to prevent asbestos from becoming airborne. A person may not transport asbestos waste in an open vehicle.

(2) If disposing of asbestos waste within the State of MD, use a disposal facility authorized by the Department for that purpose.

(3) Within 10 days after disposal of asbestos waste, submit to MDE a copy of the disposal receipt or record of appropriate disposal showing the disposal facility and date.

Install Access Points to support EHRN NextGen Wi-Fi Upgrades on the Loch Raven VA campus as shown and described in the project drawings and specifications.

Work shall include:

1. Installation of four (4) Access Points (14, 15, 6, and 19). Access Points shall be provided by the VA, but the mounting brackets shall be provided by the Contractor.

2. Installation of approximately 400 linear feet of conduit, including junction boxes, pull cords, and fire stopping, throughout the Medical Center. Existing conduit paths between floors/IT rooms will not have the capacity for more cable and new conduit paths will need to be created.

3. Installation of approximately 400 linear feet of CAT 6A cable from APs to nearest IT rooms and terminating in a patch panel. For Building 1, that will be room 108 on the first floor of the Building 1 CLC Addition. For Building 4, that will be Room 110 in Building 4.

All noise generating work will be performed during business hours, Monday through Friday, 8 AM to 4:30 PM. Non-noise generating work can be completed outside of normal business hours.

3. PERIOD OF PERFORMANCE:

3.1 Work timelines and completion progress shall be communicated to the COR for tracking purposes.

3.2 Work described in Section 2 shall be completed within 45 days of the Notice to Proceed.

The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.

Union Rate Identifiers

A four-letter identifier beginning with characters other than ""SU"", ""UAVG"", ?SA?, or ?SC? denotes that a union rate was prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.

0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.

Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.

Union Average Rate Identifiers

The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for the classifications reflected union rates. EXAMPLE:

UAVG-OH-0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.

The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.

A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.

Survey Rate Identifiers

The ""SU"" identifier indicates that either a single non-union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SUFL2022-007 6/27/2024. SU indicates the rate is a single non-union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.

?SU? wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).

State Adopted Rate Identifiers

The ""SA"" identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)-(h). Example: SAME2023-007 01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.

The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the ?SA? identifier took effect under state law in the state from which the rates were adopted.

2.4 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

3.1 52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (JAN 2025)

(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 236220.

(2) The small business size standard is $45 Million.

(3) The small business size standard for a concern that submits an offer, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees, or 150 employees for information technology value-added resellers under NAICS code 541519, if the acquisition—

(i) Is set aside for small business and has a value above the simplified acquisition threshold;

(ii) Uses the HUBZone price evaluation preference regardless of dollar value, unless the offeror waives the price evaluation preference; or

(iii) Is an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.

(b)(1) If the provision at 52.204-7, System for Award Management, is included in this solicitation, paragraph (d) of this provision applies.

(2) If the provision at 52.204-7, System for Award Management, is not included in this solicitation, and the Offeror has an active registration in the System for Award Management (SAM), the Offeror may choose to use paragraph (d) of this provision instead of completing the corresponding individual representations and certifications in the solicitation. The Offeror shall indicate which option applies by checking one of the following boxes:
