About this file
This document is a compilation of Requests for Information (RFI) responses related to VA solicitation 36C24226B0057 for Buffalo VAMC Fuel Oil Tank Replacement Project (528-18-110). The project scope includes removal of three existing 40,000-gallon underground storage tanks (USTs) and one 7,500-gallon spill connection tank, replacement with modern tanks, and installation of updated monitoring/control systems. Current fuel inventory across the three tanks totals approximately 46,012 gallons of No. 2 fuel oil, with approximately 75 gallons consumed monthly for boiler operations. The contractor must maintain a 16,000-gallon temporary fuel oil supply throughout the project duration and manage disposal of existing fuel and potentially petroleum-impacted soil (estimated 200 cubic yards), with disposal facility selection being the contractor's responsibility.
The contract duration is 420 calendar days from Notice to Proceed, with physical onsite construction anticipated to begin in Spring 2027 and award anticipated October 1, 2026. Key operational constraints include boiler shutdown limitations: up to two boilers for longer than 24 hours during cooling season (May-late September), but only one boiler for periods exceeding 12 hours during heating season (September-May). The contractor must provide full-time Site Safety and Health Officer (SSHO) and Quality Control Manager positions as separate staff members from the project superintendent. Bid Deduct No. 1 (ECC/Office Work) is explicitly excluded from the base contract scope and should not be priced. Building automation integration is limited to control points associated only with installed equipment (approximately 100 points per RFI response). Loading dock access must remain unobstructed Monday-Friday 6:30 AM to 4:00 PM, with shutdowns requiring minimum four-week advance notice. Temporary fuel tank capacity must be 16,000 gallons with usable capacity of 15,200 gallons at 95% fill level. Bid deadline was extended to September 4, 2026.

RFI 85. With regards to Section 52.219-14 “Limitations on Subcontracting”. Do these limitations preclude the use of a NON similarly situated entity, as a 1st Tier subcontractor?
a. If a subcontractor is not similarly situated (e.g., it is not a small business concern with the same program status as the prime contractor, or it is not small under the assigned NAICS code), then 52.219‑14 would limit the prime contractor’s ability to pay it more than 50% of the government’s total contract value. This means the clause does not preclude using a non‑similarly situated entity as a first‑tier subcontractor — it simply caps the allowable payment to that entity at 50% of the government’s total contract value. A non‑similarly situated first‑tier subcontractor can still be used, but the prime contractor must ensure that the total payments to such entities do not exceed the 50% cap. If the cap is exceeded, the clause could trigger compliance issues or require renegotiation of subcontract terms.
RFI 86. Per previous RFI answer the following answer in part stated "Deduct No.1 is not included in the contract as stated." The current solicitation 1442 however still includes the below bid item. Should this bid item be left blank or will a new 1442 be issued?
a. This bid can be left blank and does not need to be priced as it WILL NOT be part of this construction effort.
RFI 87. Drawings AE-303, AE-304, AE-402, AE-403, and AE-404 are referred to, but it appears these drawings are not in the bid documents. Can you please confirm if these drawings are needed to have a set of complete bid documents?
a. Please review the location of the drawing references. References are in areas detailed “Work in this area is removed as part of bid deduct no.1” and are not required.
RFI 88. Please confirm fire alarm contractor is responsible for all graphics and software development to the designated monitor, systems integrator is not to provide graphics and software as stated?
