B.2 STATEMENT OF WORK (SOW)
Reverse Osmosis System Lease with Maintenance and Water Quality Testing Service at
Margaret Cochran Corbin Manhattan VA Medical Center (VAMC).
A. BACKGROUND AND LOCATION:
Veterans Health Administration (VHA), VA New York Harbor Health Care, Margaret Cochran
Corbin VA Campus at 423 East 23rd Street, New York, NY 10010-5011 has a requirement for a contractor to provide, install, and maintain, under lease/rental arrangement, a critical water treatment system in the Sterile Processing Service (SPS) located at their Manhattan VA Medical
Center. The system must have a built-in means of redundancy, such that the backup system can be operated should the primary system be out of service.
B. SPECIAL CONSIDERATION:
The facility has an existing critical water system owned by the VA. This system is to be removed as part of this contract. During the removal process of the old system, the vendor must install and operate a temporary critical water system meeting all contract requirements until vendor’s permanent system can be installed.
C. SYSTEM REQUIRMENTS:
The system must produce water meeting all developed requirements from the Association for the Advancement of Medical Instrumentation (AAMI) ST108 Critical Water Quality Specifications, including but not limited to:
1. At a minimum, the system must incorporate the following technologies: appropriate pre-treatment including multi-media filter to remove suspended solids, water softener, carbon filter, reverse osmosis, ultraviolet light disinfection, deionization, endotoxin filtration.
2. System must have sufficient capacity to provide 30 gallons per minute of treated water and be equipped with a minimum 125-gallon treated water storage tank. The system shall provide recirculation at a rate of 3 to 5 feet per second as stipulated by AAMI
ST108.
3. System dimensions must within the 12’ x 15’ room designated.
4. System must provide acceptable quality Critical Water (as defined by AAMI ST 108) to various outlets in the existing SPS suite including decontamination sinks, washer disinfectors, spray nozzles and other devices designated.
5. Vendor must install sanitary water sampling ports at all critical locations including critical water supply and return points, upstream and downstream of RO tank.
6. The system must provide Critical Water meeting the quality requirements outlined in
Table 2 of AAMI ST 108. This includes, but is not limited to, specified quality requirements for pH, Conductivity/Resistivity, Total Alkalinity, Total Hardness, Heterotrophic Plate Count (HPC) Bacteria, Endotoxin, Color and Turbidity, Total Organic
Carbon (TOC), Endotoxin, and Ionic Contaminants (Aluminum, Chloride, Copper, Iron, Manganese, Nitrate, Phosphate, Sulfate, Silicate and Zinc).
7. System must provide water meeting the quality requirements of VHA Directive 1116(2)
“Sterile Processing Services” and Association for the Advancement of Medical
Instrumentation (AAMI) ST 108. The design criteria referenced in these standards shall be satisfied by the system provided by the vendor.
8. Vendor must provide delivery, uncrating, assembly, final electrical and plumbing connections, and all requirements for the commissioning of the critical water system.
D. MAINTENANCE REQUIREMENTS:
1. The Vendor must perform routine maintenance of the system at a minimum frequency of once per month. Additional service visits must be made at whatever frequency is needed to ensure that the system is operational and producing water at the specified rate and quality standards.
2. Monthly service visits must include loop sanitization using procedures stipulated by
AAMI ST 108. Additional service visits must be made for loop disinfection and related services at whatever frequency is required to ensure that the system is operational and producing water at the specified rate and quality standards.
E. EMERGENCY SERVICE:
The vendor must respond on-site to all emergency service calls within a maximum of 4 hours.
F. WATER QUALITY TESTING REQUIREMENTS:
1. The contract includes all water quality testing as required and stipulated by AAMI ST
108.
2. The Contractor must furnish all sample collection equipment. Bottles must be sterile, appropriate for the analysis, properly preserved and promptly transported to the laboratory after sample collection under strict chain of custody procedures by contractor.
3. All samples must be analyzed by a New York State Department of Environmental
Laboratory Approval Program (NELAP) certified laboratory with experience in microbial and chemical testing of potable water. The lab must also possess American Industrial
Hygiene Association (AIHA) accreditation under the Environmental Microbiological
Laboratory Accreditation Program (EMLAP).
G. BACTERIOLOGICAL SAMPLING:
1. Pursuant to AAMI ST 108, “Critical Water” (reference is made to the definition within the
AAMI standard) must be tested monthly for bacteria. Bacterial tests must be performed via the “Heterotrophic Plate Count” (HPC) methodology as outlined in AAMI ST 108.
Note: if bacterial results exceed the recommended threshold of 10 Colony Forming Units
Per Milliliter (CFU/ml), the outlets exceeding the threshold should be evaluated for potential sources of contamination. The frequency of sampling should be increased to weekly, until the situation is resolved (as indicated by a minimum of two consecutive rounds of testing with acceptable results).
2. The vendor’s employee performing sampling must collect samples utilizing the nomenclature and from locations stipulated by the VA.
3. Samplers utilize dedicated sterile bacteriological sampling bottles provided by the certified laboratory. Bottles must have a plastic tamper evident seal to ensure that they are sterile. The seal will only be removed immediately before sample collection. The volume of the sample container should be in the range of 100 to 300 milliliters.
4. The person performing the sampling must where a clean pair of nitrile gloves prior to collection. The gloves will need to be sterilized with Purell or other alcohol-based hand sanitizer.
5. Per the AAMI Directive, locations to be sampled for bacterial analysis must be flushed for a minimum of five (5) minutes prior to sample collection.
6. Following the initial flushing period, immerse the distal point tap/faucet/outlet/sprayer in a solution of minimum 70% alcohol for at least five (5) minutes. Following the alcohol immersion, run the tap again for at least 30 seconds prior to sample collection.
7. When opening the sampling bottle for sample collection, take care to ensure that the
“sample contact area of the cap” does not contact any surface. The caps should be set down on a clean surface, topside against the clean surface.
8. Fill the bottle without allowing the bottle to contact the faucet/distribution point in question. Do not overflow.
9. Following sample collection; immediately seal the bottle with the cap. Ensure the bottle is labeled in accordance with stipulated sampling nomenclature and any additional information required by the laboratory such as collection time.
10. As stipulated by AAMI; lab analysis should begin within 8 hours of sample collection.
Exceeding the 24-hour threshold will invalidate the results.
11. Immediately upon sample collection, samples must be put on ice or refrigerated such that temperature is maintained between 2°C and 8°C (35.6°F and 46.4°F). Samples should be delivered to the laboratory as soon as feasible following collection.
H. ANALYTICAL REPORTING:
1. Contractor must provide complete laboratory reports including VA stipulated sampling location nomenclature, results summary, chain of custody and original laboratory reports to SPS Chief and other designated VA representatives.
2. Any water quality issues/failures or AAMI guidelines exceedance must immediately be reported to SPS Chief, Engineering Chief, and Safety Manager.
I. ACTION RESPONSE FOR EXCEEDING WATER QUALITY GUIDELINES:
1. If water quality leaving the vendor’s leased/rented treatment system is found to be “out of range” as defined in AAMI ST 108, the vendor is responsible for promptly making all needed corrections at no cost to the VA. This may include but is not limited to flushing and resampling, filter changes, sanitization, and other preventative measures. Following response actions, the vendor must perform resampling to verify that acceptable water quality is being provided.
2. During the period between the receipt of the “out or range” results and the verification of restoration of compliant water quality, the vendor will activate the redundant (backup) critical water system as referenced herein.
3. If water quality at outlet (distal) points are found to be out of range (as defined in AAMI
ST 108) while water quality leaving the vendor’s rented/leased system is in range, the vendor must make specific recommendations to the VA in order address the nonconformance. If the exceedance results from contamination in the VA’s piping distribution system, the vendor is to advise the COR of the result and offer suggestions to VA as to how to respond. The COR may request that the vendor perform additional distribution system flush-out sanitization under corresponding CLIN. Upon completion of additional sanitization, the vendor will be requested to provide additional sampling.
J. CERTIFICATION REQUIREMENTS:
1. The Environmental Microbiology Laboratory Accreditation Program (EMLAP).
2. Environmental Laboratory Accreditation Program (ELAP).
K. OTHER RELATED SERVICES: (Not Included in SOW)
Any services not expressly stated in this statement of work are not authorized and may be added only after written modification from the contracting officer unless they are inclusive to the requested services. No other person, including the COR or any other VA personnel are authorized to request additional work be performed by the contractor. Any additional services performed that are not authorized by the contracting officer will be considered inclusive.

(B) The date of the first written demand for payment, including any demand for payment resulting from a default termination.
(vi) The interest charge shall be computed for the actual number of calendar days involved beginning on the due date and ending on—

In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the
Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

(i) Any such clause is unenforceable against the Government.
(ii) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement.
