About this file

This file is a template for industry questions and answers related to a federal contract opportunity for laparoscopic insufflators. The document captures seven questions from potential offerors along with corresponding government responses addressing solicitation requirements and evaluation criteria.

Key clarifications provided by the government include: this solicitation will result in a single firm-fixed-price requirements contract award; offerors may propose any product solution meeting salient characteristics in Attachment B, not limited to specific brand versions or release dates; the VA will not award products subject to FDA recalls or known safety issues, requiring offerors to complete Attachment J certification affirming no outstanding recalls; all proposed items must be new OEM equipment with no refurbished, remanufactured, or gray market items permitted; evaluation subfactors address system interoperability with different vendor ECU units and intensity level adjustments for smoke evacuation; and because this is a total Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside (per SF1449 Block 10), all competing offerors must already be certified SDVOSBs, with no separate SDVOSB evaluation preference factors or price credits applied.

Attachment G- Template for Industry Questions
Item (Add rows as needed)RFQ Section (A,B,C,D,E)Document (PWS, RFQ Attachment A, E.1 Quote Submission Instructions, etc.)RFQ Pageparagraph/ sectionQuestions:Government Response:
1Is this a single or multi vendor award? This solicitation will result in a single award requirements contract.

Section E.6, Basis for Award, states: “The Government intends to award a single requirements contract with Firm-Fixed Price (FFP) orders…” 2 The brand name unit you are requesting for BNOE was released in 2012- there is newer technology available – should we be responding with the newest technology/version for each brand? The solicitation does not direct Offerors to propose any specific version of a product. Offerors are permitted to propose any product solution that meets all salient characteristics listed in Attachment B.

Section E.5 (Volume I – Technical Factor) states:

“Offerors may propose any product solution or configuration so long as they meet all the salient characteristics.”

(Page 31–32)

3Is the VA permitted to award FDA “recalled” product for a National Contract ?No. The VA will not award any product that is subject to an FDA recall or that has a known safety issue. The solicitation now requires Offerors to submit Attachment J – Certification of Recall or Safety Issues, affirming that all proposed items have no outstanding recalls and no known safety issues. In addition, the Government will independently verify this information. If the Government identifies that a proposed item is subject to a recall or safety issue—even if the Offeror’s certification states otherwise—the proposal will be rated Unacceptable and will not be eligible for award.
4If there are active or inactive FDA recalls will those need to be disclosed in the response?Yes. Offerors must disclose any recall or safety issue by completing Attachment J – Certification of Recall or Safety Issues. The certification requires Offerors to affirm that no proposed items have outstanding recalls or known safety issues. If an Offeror is unable to make this certification (i.e., if any proposed item currently has, or previously had, a recall that has not been fully resolved), the proposal will be considered Unacceptable.

Additionally, if the Government identifies an active or unresolved recall—whether or not it was disclosed—the proposal will be ineligible for award.

5Should the system have the ability to communicate with different vendors/brands of ECU units to increase and decrease smoke evacuation when the ECU units are triggered ?See Evaluation Subfactors, Section E.6
6Should the unit have different intensity levels to adjust for efficient smoke evacuation?See Evaluation Subfactors, Section E.6
7Will SDVOSB evaluation factors be considered? Veterans Preference Factor (per 852.215-70) WITH a 10% price credit evaluation factor. This requirement is a Service‑Disabled Veteran‑Owned Small Business (SDVOSB) set‑aside, as indicated in Block 10 of the SF1449.

(Page 1)

Because this is a total SDVOSB set‑aside, no SDVOSB evaluation preference factors or price credits are applied. All Offerors must already be certified SDVOSBs to compete
