The contractor is responsible for ensuring that the base rates proposed for personnel subject to the SCLS meet or exceed the corresponding minimum wages established by the Department of Labor (DOL) for the corresponding region (state/county) in which the task order is performed. At the time of TO proposal request, the contractor will be responsible for identifying any personnel subject to the SCLS, and their corresponding region (state/county). The Government will incorporate wage determinations on the base contract and/or task order(s) as applicable.

The Offeror shall:

· Identify all known places of performance in order for wage determinations to be incorporated into any resultant contract.

· Provide the rationale for exemption if an offeror believes any labor category is exempt from the Service Contract Labor Standards.

A final determination of Service Contract Labor Standards applicability for each labor category will be made prior to award and any wage determinations required will be included in the resultant contract Organization Conflict of Interest (OCI) Mitigation Plan:

In accordance with the Solicitation, OCI Mitigation Plan shall be submitted under this Volume. This shall include:

i. A statement with its offer which describes, in a concise manner, all relevant facts concerning any past, present, or currently planned interest (financial, contractual, organizational, or otherwise) or actual or potential organizational conflicts of interest relating to the services to be provided under this solicitation.

ii. Statements with its offer containing the same information for any consultants and subcontractors identified in its proposal and which will provide services under the solicitation.

iii. Relevant facts that show how its organizational and/or management system or other actions would avoid or mitigate any actual or potential organizational conflicts of interest.

iv. In the event that an OCI cannot be sufficiently mitigated, based on the information provided, the Offeror may be ineligible for award.

Subcontracting Plans:

Offerors designated as other than small businesses shall submit a Subcontracting Plan pursuant to FAR 52.219-9 and VAAR 852.219-70, with their proposal submission.

Offerors may submit approved commercial subcontracting plans or an individual plan if no approved commercial plan exists. (Offerors designated as small businesses may submit a subcontracting plan to demonstrate small business participation).

The Subcontracting Plan must be submitted with initial offer and approved prior to contract award. The Subcontracting Plan shall meet the minimum VA subcontracting goals set forth in the VA Socioeconomic Subcontracting Goals table below. If the Offeror proposes subcontracting goals that differ from those identified in the table below, the Offeror shall clearly identify why the goals are not attainable and describe how and why its proposed goals are set at levels that realistically represent the maximum practical small business subcontracting goals consistent with efficient contract performance.

A. EVALUATION APPROACH AND BASIS FOR AWARD

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government intends to conduct proposal evaluations using a three-phase approach. The following factors shall be used to evaluate offers:

PHASE I:

FACTOR 1 – Corporate Experience

PHASE II:

Minimum Requirements for Award

1) Cisco Gold Partner Status

2) Key Personnel

3) Original Equipment Manufacturer (OEM) Authorized Distributor/Reseller

PHASE III:

FACTOR 2 – Technical Factor Subfactors

1) Transition-In Approach

2) Technical Capability

3) Sample Task Order FACTOR 3 – Past Performance FACTOR 4 – Price FACTOR 5 – Veterans Involvement

The Technical Factor is significantly more important than the Past Performance Factor, which is significantly more important than the Price Factor, which is more important than the Veterans Involvement Factor. All technical subfactors are of equal importance.

Corporate Experience will not be considered as part of the best value trade-off and will only be considered as part of the advisory notices issued under Phase I.

Phase II Minimum Requirements are not part of the best value trade-off, as more fully discussed below.

Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options will not obligate the Government to exercise the option(s).

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

B. BASIS FOR AWARD

The VA intends to award one (single) Indefinite Delivery Indefinite Quantity (IDIQ), contract to an Offeror based on the proposal that is determined to be the best value to the Government. However, the Government reserves the right to make any number of awards, or no award, if considered to be in the Government’s best interest to do so.

Within the best value continuum, FAR 15.101 defines best value as using any one or a combination of source selection approaches.

Phase I:

Advisory Down-Select In Phase I, there will be an advisory down select based on corporate experience as defined below. Following this advisory down select, those offerors who choose to proceed will continue to Phase II.

Phase II:

Minimum Requirements for Award Proposals will be evaluated to determine if proposals meet minimum requirements for award. Proposals that meet minimum requirements for award will continue to Phase III and be assessed using the Best Value Tradeoff below.

Phase III:

Best Value Tradeoff In Phase III, the best value decision will be determined using an evaluation process of areas that include Technical, Past Performance, Price, and Veterans Involvement.

To receive consideration for award, a rating of no less than "Acceptable" must be achieved for the Technical Factor. The non-Price Factors combined are significantly more important than the Price Factor. Offerors are hereby notified that any resulting award may not necessarily be made to the lowest price offered or the most highly rated technical proposal.

Only Offerors that provide the necessary technical detail to ensure the Government has a complete understanding of the Offeror’s capabilities will be considered for award.

C. EVALUATION APPROACH

All proposals shall be subject to evaluation by a team of Government personnel. The Government reserves the right to award without discussions based upon the initial evaluation of proposals. The proposal will be evaluated strictly in accordance with its written content. Proposals which merely restate the requirement or state that the requirement will be met, without providing supporting rationale, are not sufficient.

Offerors who fail to meet the minimum requirements of the solicitation will be rated Unacceptable and thus, ineligible for award.

D. PHASE I - CORPORATE EXPERIENCE EVALUATION APPROACH

Corporate experience will be evaluated to determine the Government’s level of confidence in the Offeror’s ability to perform the work required by the PWS based on the Offeror’s documented relevant experience.

After the Government completes evaluation of all Corporate Experience Submissions, the highest rated Offerors will receive an advisory notification advising them to proceed to Phase II of the evaluation. Offerors who elect to continue their participation shall have 48 hours to provide written notification to VA of their intention after which they will be provided the due date for Phase II and Phase III proposal submissions.

Lower rated Offerors will be advised they are unlikely to be viable competitors, along with the general basis for that opinion. The intent of this advice is to minimize proposal development costs for those Offerors with little chance of receiving an award. However, the Government’s advice will be a recommendation only, and those Offerors may elect to continue their participation in the acquisition. At this phase, no competitive range will be established, and no discussions will be held, it is advisory only.

Offerors who elect to continue their participation shall have 48 hours to provide written notification to VA of their intention after which they will be provided the due date for Phase II and Phase III proposal submissions.

Failure to participate in Phase I of the evaluation precludes participation in Phase II and Phase III.

E. PHASE II - MINIMUM REQUIREMENTS EVALUATION APPROACH

In order to be considered for award, the contractor must meet the following minimum requirements below. If an acceptable rating is not met, the offeror will be deemed ineligible for award and will be removed from further consideration.

1. Cisco Gold Partner Status:

Cisco Gold Partner Status will be evaluated to ensure it meets the requirements of the Solicitation. The Government will verify Cisco Gold Partner Status utilizing the following link:

https://locatr.cloudapps.cisco.com/WWChannels/LOCATR/openBasicSearch.do Proposals that do not meet the requirements will be deemed as unacceptable and thus not considered for award.

2. Key Personnel:

Key Personnel will be evaluated to ensure that the proposed personnel meet the requirements of the Solicitation (Attachment C, Section 6.3). Proposals that do not meet the requirements will be deemed as unacceptable and thus not considered for award.

3. Original Equipment Manufacturer (OEM) Authorized Distributor/Reseller:

Proposals will be evaluated to confirm compliance with the OEM Authorized Distributor/Reseller submission requirements to ensure it meets the requirements of the Solicitation. Proposals that do not meet the requirements will be deemed as unacceptable and thus not considered for award. In the event the Offeror does not meet minimum requirements, the Offeror will be notified via email.

F. PHASE III- TECHNICAL FACTOR EVALUATION APPROACH

The evaluation process will consider the following:

a. Understanding of the Problem - The proposal will be evaluated to determine the extent to which it demonstrates a clear understanding of all features involved in solving the problems and meeting and/or exceeding the requirements presented in the solicitation and the extent to which uncertainties are identified and resolutions proposed.

b. Feasibility of Approach - The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The proposal will be evaluated to determine the level of confidence provided the Government with respect to the Offeror's methods and approach in successfully meeting and/or exceeding the requirements in a timely manner.

The Technical Factor rating will be expressed as an adjectival assessment of Outstanding, Good, Acceptable, Susceptible to Being Made Acceptable, or Unacceptable.

a. Outstanding - A proposal that meets or exceeds all of the Government’s requirements, contains extensive detail, demonstrates a thorough understanding of the problems, and is highly feasible (low risk).

b. Good - A proposal that meets or exceeds all of the Government’s requirements, contains at least adequate detail, demonstrates at least an understanding of the problems, and is at least feasible (low to moderate risk).

c. Acceptable - A proposal that at least meets all of the Government’s requirements, contains at least minimal detail, demonstrates at least a minimal understanding of the problems, and is at least minimally feasible (moderate to high risk).

d. Susceptible to Being Made Acceptable - An approach which, as initially proposed, cannot be rated Acceptable because of minor errors, omissions or deficiencies, which are capable of being corrected without a major rewrite or revision of the proposal. For award without discussions, proposals with this rating are considered “Unacceptable”.

e. Unacceptable - A proposal that contains a major error(s), omission(s) or deficiency(ies) that indicates a lack of understanding of the problems or an approach that cannot be expected to meet requirements or involves a very high risk; and none of these conditions can be corrected without a major rewrite or revision of the proposal. A proposal that fails to meet any of the Government’s requirements after the final evaluation shall be ineligible for award regardless of whether it can be corrected without a major rewrite or revision of the proposal.

G. PAST PERFORMANCE EVALUATION APPROACH.

Past performance (Prime & Subcontractor) will be evaluated to determine whether each reference is relevant (based on size, scope, and complexity as compared to this requirement), recent (within the past three years), and reflects performance which is satisfactory or better. The Offeror will be evaluated to determine the extent to which their performance demonstrates the likelihood of successful performance in providing requirements similar in size, scope, and complexity to this solicitation.

In the case of an Offeror without relevant or recent past performance, as indicated on Solicitation Attachment A or based on the determination of relevance by the Government, the Offeror may not be evaluated favorably or unfavorably and will be given a neutral rating.

Past Performance Factor Rating Definitions:

a. Low Risk: Little doubt exists, based on the Offeror’s past performance record, that the contractor can successfully perform requirements similar in size, scope, and complexity to this solicitation. The past performance is relevant, recent, and the CPARS/PPIRS or PPQs reflect satisfactory or better performance.

b. Moderate Risk: Some doubt exists, based on the Offeror’s past performance record, that the contractor can successfully perform requirements similar in size, scope, and complexity to this solicitation. The past performance is relevant and recent. The CPARS/PPIRS or PPQs may reflect minimally satisfactory performance.

c. High Risk: Significant doubt exists, based on the Offeror’s past performance record, that the contractor can successfully perform requirements similar in size, scope, and complexity to this solicitation. The past performance is relevant, recent, but the CPARS/PPIRS or PPQs may not reflect satisfactory performance.

d. Neutral: The Offeror has no relevant or recent past performance.

H. PRICE EVALUATION APPROACH

Price will be evaluated but not adjectivally rated.

The Government will conduct a price analysis to evaluate price reasonableness in accordance with FAR 15.404-1(b) based on the total proposed price for all Contract Line-Item Numbers (CLINs) for the base period of performance and all option periods together. Reasonableness may be determined based on pricing information submitted with the Offeror’s proposal and by comparison of 1) competitive offers received in response to the solicitation; 2) proposed prices against the Independent Government Cost Estimate (IGCE) and 3) any other price analysis technique authorized in FAR 15.404-1(b). For a price to be reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. Evaluation of options shall not obligate the Government to exercise the option(s).

Specifically, the Government will use the “Total Proposed Price” for evaluation purposes. Total Proposed Price will be calculated as follows:

I. Labor: Applies to the following CLINs, as detailed on individual Tabs, under Solicitation Attachment D, B Table for Offerors (Individual tabs will roll into the Main Pricing Sheet) 0001 Transition in 0002 Post Award Meeting 0003 Kick Off Meeting

0004/1001 - 6001Program Reviews
0005/1002 - 6002Other Deliverables Not Separately Priced 0006/1003 - 6003Inventory and Asset Management 0007/1004 - 6004Help Desk Support
0008/1005 - 6005Connected Care Technology Software and Mobile Medical Application Design, Development, Enhancement and Remediation
0009/1006 - 6006Infrastructure and Architecture Support 6108 Transition Out

To determine “Total Labor CLIN Price”, first the Government will determine the “Labor Category Total Price” by CLIN. This will be calculated by multiplying the proposed fully burdened labor rates by the Government provided total hours to obtain a total price for each labor category by CLIN (Rate x Hours = “Labor Category Total Price”). Then, the Government will sum all “Labor Category Total Prices” for each CLIN to arrive at the “Total Labor CLIN Price”.
