SECTION I. DETERMINATION STATEMENT

1. This acquisition is to provide preventative maintenance for the regional office’s audio and visual components.

2. The Federal Acqusition Regulations (FAR) subpart 7.503(c) list of positions identified as inherently and closely related inherently governmental functions has been considered as part of the requiring activity office’s determination.

3. Responses provided in the tables below confirm that the services to be procured do not include work that must be reserved for performance by Federal employees and confirm that the Government will be able to manage the contractor consistent with its responsbility to perform all inherently governmental functions and maintain control of its mission and operations.

SECTION II. INHERENTLY GOVERNMENTAL FUNCTIONS

An inherently governmental function (IGF) is defined in the Federal Activities Inventory Reform Act of 1998 (FAIR), P.L. 105-270 § 5 as a function that is so intimately related to the public interest as to require performance by Federal Government employees. If any of the boxes in the below IGF Confirmatory Statements table are checked as ‘Yes’, then the services cannot be contracted out. The services must be performed by a Federal employee.

A function meeting either of the following tests should be considered inherently governmental.

Test 1: Nature of the Function

A function may be classified as inherently governmental based strictly on its uniquely Governmental nature without regard to the type or level of discretion associated within the function. Examples of functions that are inherently governmental are officially representing the United States in an inter-governmental forum or body, arresting a person, and/or sentencing a person convicted of a crime to prison.

Test 2: The Exercise of Discretion.

A function requiring the exercise of discretion shall be deemed inherently governmental if the exercise of that discretion commits the Government to a course of action where two or more alternative courses of action exist and decision-making is not already limited or guided by existing policies, procedures, directions, orders, and other guidance that: (1) identify specific ranges of acceptable decisions or conduct concerning the overall policy or direction of the action; and (2) subject the discretionary decisions or conduct to meaningful oversight and, whenever necessary, final approval by agency officials.

SECTION III. SERVICES CLOSELY ASSOCIATED WITH INHERENTLY

GOVERNMENTAL FUNCTIONS

Closely Associated with Inherently Governmental Functions (IGF) are functions that are not generally considered to be IGF but may approach being in that category because of the nature of the function and the risk that the performance may impinge on Federal officials' performance of an IGF.

In determining whether a function is closely associated with an IGF, the nature of the function and the risk that performance may impinge on Federal officials' performance of an IGF is analyzed. Agencies should in-source closely associated with Governmental functions to the maximum extent practicable.

SECTION IV. CRITICAL FUNCTIONS

Critical Function as defined in OFPP Policy Letter 11-01 section 3. Definitions means a function that is necessary to the agency to be able to effectively perform and maintain control of its mission and operations. Typically, critical functions are recurring and long-term in duration. An agency must have sufficient internal capability to control its mission and operations and must ensure it is cost effective to contract for such critical services.

An inherently Governmental function is a function that is so intimately related to the public interest as to require performance by Federal Government employees.

OFPP 11-01, Performance of IGF and critical functions, provides the following examples of work that is inherently governmental. If the services to be contracted involve any of the following functions listed below, then the function must be performed by Federal Government employees.

It is required to the maximum extent practicable to minimize reliance on contractors performing work closely associated with IGF. OFPP 11-01 provides the following examples of work that is closely associated with IGF that may be performed by either Federal employees or contractors.
