About this file
This is a Trench Safety Affidavit compliance document for a Florida state and local contract opportunity related to Pond Improvements at Cadillac Drive and RJ Conlan. The document requires bidders to acknowledge that all costs for complying with the Florida Trench Safety Act (90-96, Laws of Florida), effective October 1, 1990, are included in their bid prices. Bidders must provide assurance that if awarded the contract, they or any subcontractors performing trench excavation work will comply with applicable trench safety standards. The document includes a table for bidders to identify and summarize trench safety measure costs, including unit of measure, quantity, unit cost, and extended cost for each safety measure. Occupational Safety and Health Administration excavation safety standards under 29 CFR 1926.650 Subpart P will be in effect throughout the construction period. Failure to complete the affidavit will result in the bid being declared non-responsive.
The affidavit specifies that compliance with all applicable OSHA regulations is a mandatory requirement of the contract and remains the contractor's responsibility. The document explicitly states this is not a pay item, and its purpose is solely to disclose information on costs associated with trench safety measures and ensure bidders have considered these costs in their bid price. Contractors will not receive additional payment if actual quantities differ from those estimated or if they employ safety measures different from those listed. An authorized signature and date are required to acknowledge the bidder's understanding and acceptance of these trench safety compliance requirements.
