About this file

This document is a Justification for Other Than Full and Open Competition for UNICOR's Cumberland Sign Factory. The solicitation (SV0193-26) seeks Avery Dennison Reflective Material for a two-year Indefinite Delivery/Indefinite Quantity (IDIQ) contract, with an estimated total value of $128,362. The materials include various brown and white reflective sheeting and application tape in different sizes, used for signage by federal agencies including Army Corps of Engineers and National Park Service.

The justification emphasizes that Avery Dennison is the only manufacturer capable of meeting the specific color and reflective quality requirements. Previous contracts have been held by Avery Dennison, and the Cumberland Sign Factory plans to post a SAM.gov announcement to solicit potential sources. The contracting officer notes that while other vendors exist, they are merely resellers, and Avery Dennison remains the sole manufacturer meeting the precise specifications needed for safety and conformity in federal signage applications.

2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED MEETING THE

AGENCY’S NEEDS.

These item(s) have been on contract #14600000124 for the past three years and will be solicited again for a two-year contract. This material is used for signage by multiple federal agencies (Army COE, NPS) that are Unicor customers. Their requirement specifies Avery Dennison Engineering Grade Retroreflective Sheeting as the only brand that has demonstrated the properties with the specific color needed. Color match and reflective qualities are needed for safety and conformity.

3. DEMONSTRATE THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE

AUTHORITY CITED.

Avery Dennison is the manufacturer of these products. They have formulated the color that is used and have tested their material to determine that it meets agency requirements.

Army Corps or Engineers documentation states, “Those manufacturers wishing to demonstrate the capability to meet Corps standards must provide proof of capabilities to the District Sign Program Manager.” Currently, Avery Dennison is the only manufacturer on the list for this color and product.

4. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED

FROM AS MANY POTENTIONAL SOURCES AS IS PRACTICABLE, INCLUDING

WHETHER A SAM.GOV ANNOUNCEMENT WAS OR WILL BE PUBLICIZED AS

REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES.

Previous solicitations posted on SAM.gov have yielded other vendors, but they are just reselling the product that we buy directly from the manufacturer. Currently, Avery Dennison is the only manufacturer of this material. A SAM.gov posting will be made to solicit these products from as many companies as possible to determine the best source for purchase.

5. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED

COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.

The Cumberland Sign Factory has had past contracts for this material and we will have an open solicitation for anyone that can provide these items.

6. DESCRIPTION OF THE MARKET SURVEY CONDUCTED AND THE RESULTS, OR A

STATEMENT OF THE REASONS A MARKET SURVEY WAS NOT CONDUCTED.

A market survey was not conducted as the requirement is for Brand Name and color which research will not change. These are catalog items and a posting on SAM.gov should inform the market of the opportunity to provide these items.

7. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION, SUCH AS:

The use of other than full and open competition is for the brand name only.

8. LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN

INTEREST IN THE ACQUISITION.

Avery Dennison (incumbent contract holder) 207 Goode Ave.

Glendale, CA 91203

9. STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE

OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT

ACQUISITION FOR THE SUPPLIES OR SERVICES IS REQUIRED.

The Cumberland Sign Factory will continue to monitor customer requirement changes that would affect the Brand Name requirement.

10. CONTRACTING OFFICER CERTIFICATION THAT THE JUSTIFICATION IS

ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING OFFICER’S
