About this file

This is a Special Provisions document for Contract MS-944 issued by Myerstown Borough in Pennsylvania, detailing mandatory requirements for bituminous paving and roadway improvement work. The project encompasses approximately 5,775 square yards of milling and 490 tons of bituminous wearing course, with all work to be completed by October 1, 2026. Contractors must notify the Municipality five working days prior to project start and are responsible for providing traffic control and safety devices in compliance with current MUTCD standards. The contract requires submission of Form CS-4171 Certificate of Compliance and TR-465 Daily Bituminous Mixture Certification for all materials, along with Bills of Lading for each bituminous material shipment. Key specifications include power brooming of the roadway prior to work commencement, tack coat application per Section 460 or 409 of Specifications 408, prime coat installation per Section 461, bituminous seal on abutting pavement and curbs, and full-width pavement placement in a single pass with tapering of the final three feet to curb.

The contractor is responsible for all defects occurring within one year of application and must complete testing in accordance with Specification Form 408 Section 409, excluding superpave volumetric testing. Oil samples must be collected from each distributor truck—one quart each morning and afternoon—witnessed and retained by the Municipality, and at least three random stone samples must be taken on-site under municipal observation. Liquidated damages are assessed at $250 per calendar day for work not completed by the deadline. The Municipality reserves the right to limit work completion, procure materials best suited to their requirements, make awards based on aggregate totals of like items, and inspect all completed work. Contractors must notify all residents of pending work and provide final completion certification and notice of completion upon project conclusion. Future contract awards will be based on the quality of work as determined by the Municipality.
