About this file
This document is Exhibit C - Federal Clauses and Certifications for the Utah Transit Authority (UTA), detailing federal requirements for a potential future federally-funded contract. The exhibit outlines comprehensive federal compliance requirements, including regulations related to civil rights, labor standards, environmental protections, and procurement guidelines. While UTA does not currently plan to use federal assistance dollars, the document mandates that federal certifications must be signed and submitted with any proposal, covering areas such as record retention, access to records, lobbying restrictions, debarment provisions, and telecommunications equipment restrictions.
The document emphasizes compliance with federal regulations across multiple domains, including prohibitions on discrimination, requirements for equal employment opportunity, safety standards, and restrictions on telecommunications equipment from specific foreign manufacturers. Key federal agencies referenced include the Federal Transit Administration (FTA), U.S. Department of Transportation, and various federal anti-discrimination enforcement bodies. The exhibit includes mandatory certification attachments covering Buy America requirements, debarment assurances, lobbying restrictions, and a prohibition on Diversity, Equity, and Inclusion (DEI) programs. Although no specific funding amount is mentioned, the document indicates potential future federal grant funding may be used for service orders, necessitating comprehensive federal compliance documentation.

SIMPLIFIED ACQUISITION THRESHOLD
Contracts for more than the simplified acquisition threshold, which is the inflation adjusted amount determined by the Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) as authorized by 41 U.S.C. § 1908, or otherwise set by law, must address administrative, contractual, or legal remedies in instances where contractors violate or breach contract terms, and provide for such sanctions and penalties as appropriate. (Note that the simplified acquisition threshold determines the procurement procedures that must be employed pursuant to 2 C.F.R. §§ 200.317–200.327. The simplified acquisition threshold does not exempt procurement from other eligibility or processes requirements that may apply. For example, Buy America’s eligibility and process requirements apply to any procurement in excess of $150,000. 49 U.S.C. § 5323(j)(13).)
