About this file

This is a Health Insurance Statement of Compliance Form issued by the State of Utah's Division of Facilities Construction and Management (DFCM) for contractors and subcontractors participating in state construction projects. The form requires certification by an actuary, underwriter, or third-party administrator that employers maintain qualified health insurance coverage for eligible employees and their dependents as defined under Utah Code 26B-3-909. The compliance requirement applies to prime contractors on contracts valued at $2,000,000 or more and subcontractors on subcontracts valued at $1,000,000 or more, with specific exemptions for contracts that would jeopardize federal funding receipt, sole source contracts, and emergency procurements. The referenced project is the Department of Natural Resources Division of Wildlife Resources Mammoth Creek Hatchery Improvements (Project #27087520), a Stage II prequalified bidding opportunity with a construction cost estimate of $346,789.00 for remodeling and upgrades to an existing fish hatchery facility including office upgrades, lighting changes, generator upgrades, RV pad installation, mechanical upgrades, radon mitigation, and window upgrades.

Non-compliance with the health insurance requirement carries escalating penalties including three-month suspension on first violation, six-month suspension on second violation, debarment upon third or subsequent violation, and monetary penalties up to 50 percent of the cost to purchase qualified health insurance coverage for non-covered employees. Contractors and subcontractors may also face liability to eligible employees for health care costs that would have been covered by compliant insurance, and intentional circumvention of requirements through change orders, contract modifications, or multiple contracts constitutes an infraction. The compliance certification must be signed and dated by a qualified actuary or underwriter with appropriate credentials and company identification provided.
