About this file

This is a Health Insurance Statement of Compliance Form issued by the State of Utah's Division of Facilities Construction and Management (DFCM) in connection with a construction project at Southern Utah University for multipurpose electrical upgrades (Project #27093730). The form requires certification from an actuary, underwriter, or third-party administrator that the contractor maintains qualified health insurance coverage as defined under Utah Code 26B-3-909 for eligible employees and their dependents. The compliance requirement applies to prime contractors on projects with aggregate contract amounts of $2,000,000 or more and subcontractors on agreements of $1,000,000 or more, though exemptions exist for sole source contracts, emergency procurements, and situations where compliance would jeopardize federal funding.

Non-compliance with the health insurance requirement carries escalating penalties beginning with a three-month suspension from state contracting on a first violation, progressing to a six-month suspension on a second violation, and potential debarment on subsequent violations. Additionally, monetary penalties may reach up to 50 percent of the cost to purchase qualified health insurance coverage for affected employees, and contractors or subcontractors are liable to employees for uncovered health care costs. The statute prohibits the use of change orders, contract modifications, or multiple contracts to circumvent the health insurance requirements, with intentional circumvention classified as an infraction. For the referenced Southern Utah University electrical upgrades project with a construction cost estimate of $413,678, this compliance requirement would not apply due to the project cost falling below the $2,000,000 threshold for prime contractors.
