About this file

This is a Health Insurance Statement of Compliance Form issued by the State of Utah's Division of Facilities Construction and Management (DFCM), effective March 22, 2018 and revised July 28, 2025. The form requires employers, contractors, and subcontractors to certify that they offer qualified health insurance coverage to eligible employees and their dependents as defined under Utah Code 26B-3-909. The certification must be completed by an actuary, underwriter, or third-party administrator and submitted with contract documentation. The compliance requirement applies to prime contractors and design professionals with contracts valued at $2,000,000 or more, and to subcontractors and subconsultants with agreements valued at $1,000,000 or more.

The requirement does not apply if compliance would jeopardize receipt of federal funds, if the contract is sole source, or if it is an emergency procurement. Penalties for non-compliance are significant and escalating, ranging from a three-month suspension on first violation to potential debarment on the third or subsequent violation, as well as monetary penalties not to exceed 50 percent of the cost to purchase qualified health insurance coverage for affected employees. Contractors may also face civil liability to employees for uncovered health care costs and criminal penalties for intentionally circumventing requirements through change orders, contract modifications, or multiple contracts. This form is specifically referenced for the DFCM Construction Prequalified Roofing Stage II project at Snow College for a roof replacement with a construction cost estimate of $700,000.
