4. WORK TO BE DONE - The work to be done under this Contract by the awarded Contractor consists of furnishing any and all materials, equipment, and labor necessary for the successful construction of all work shown to be completed in the Contract Documents, hereinafter referred to as "the Work." This includes, unless specifically addressed otherwise in the Contract Documents or directed by the County Engineer, the Contractor providing and paying for all material, labor, tools, equipment, water, lights, power, transportation, and any other incidental expenses required to perform the Work; performing any work necessary to complete the Work before, during, or after regular working hours, weekends, or legal holidays without additional expense to the County; and providing for any and all other services, facilities, permanent or temporary, whatsoever necessary to execute, deliver, and complete the Work within the specified time.

11. BID OPENINGS - Bid Openings will be held virtually via WebEx at https://ccgagov.webex.com/meet/gosteen. All bidders submitting a Bid are requested to be present at the Bid Opening.

12. INTERPRETATION OF PROPOSAL AND DETERMINATION OF LOW BID - The County has established in the Proposal a Bid Form of the estimated quantities for each item scheduled to be completed under the Contract per the Contract Documents. The bidder is to insert a Unit Price, as a numerical dollar and cents amount, to be reimbursed to the bidder for the complete installation and acceptance of each unit should the bidder be awarded the Contract. The Unit Price shall then be multiplied by the estimated quantity resulting in the amount that is entered in the Estimated Cost column. The sum of the Estimated Costs is then inserted into the Estimated Total Price box. The Estimated Total Price will be used to compare Bids. If there is a mathematical error in the computation of the Estimated Cost for any item, the Unit Price will govern, and the error will be corrected by the County with the Estimated Total Price being adjusted accordingly. Upon opening of the Bids, Proposal Bid Form Unit Prices cannot be changed. Bidders should understand that the amount in the Estimated Total Price box is not likely the amount that the successful bidder will be paid. Payment will be made by the County at the contracted Unit Prices only on the basis of actual quantities installed and accepted by the County, and the actual quantities installed are likely to fluctuate over the course of the Contract.

If a Contract is awarded, it will be awarded by the County to the lowest responsible bidder. The County, in its sole discretion, will decide which bidder is the lowest responsible bidder.

13. RIGHT TO REJECT BIDS - The County reserves the right to reject any and/or all Bids and to waive any informalities. No Bids will be received after the scheduled closing time for receipt of Bids. Incomplete Bids will be subject to rejection. Any unauthorized conditions, limitations, or provisions attached to a Bid may, at the County's discretion, render it informal and be cause for its rejection. Any Bidder may withdraw their Bid, either personally or by written request, at any time prior to the scheduled closing time for receipt of Bids.

14. BID BOND - Each Bid must be accompanied by a Bid Bond or a Certified Check in an amount equal to ten percent (10%) of the amount Bid to guarantee that the successful bidder will, within ten (10) calendar days following the date of notification of Contract award, enter into Contract with the County for the performance of the Work as described in the Contract Documents and execute a satisfactory bond. If for any reason whatsoever a bidder withdraws their Bid after the opening of Bids, or refuses to execute the required Contract, the Bid Bond or Certified Check accompanying their Bid, and the monies payable thereon, shall be paid to the County as liquidated damages.

15. PERFORMANCE & PAYMENT BONDS - The successful bidder will be required to execute a

Performance Bond and a Payment Bond, each in favor of the County, each in an amount equal to one hundred percent (100%) of the Contract amount, and each to be in the form hereinafter set forth, as security for the faithful performance of this Contract, and for the payment of all persons performing labor and furnishing materials in connection with this Contract. The Surety on the Performance and https://ccgagov.webex.com/meet/gosteen
