Bid Bond Summary
This is a Bid Bond form (EJCDC No. 1910-28-C, 1996 Edition) for Wormleysburg Borough's infrastructure projects in Pennsylvania. The document serves as a standardized bid security instrument applicable to two municipal solicitations: the South Front Street Sewer Lining Project with bids due September 30, 2025, at 2:00 PM, and the 2026 Street Rehab Project with bids due July 8, 2026, at 2:00 PM. The sewer lining project encompasses 1,744 linear feet as the base bid with an optional 961 linear feet in alternates, while the street rehabilitation project includes milling, wearing course installation (330 tons), drainage pipe replacement, and curb ramp replacement. Prospective bidders must submit bids online through PennBID, with questions accepted only through the online platform by specified deadlines (September 25, 2025, at 5:00 PM for the sewer project and July 6, 2026, at 4:00 PM for the street project). Bids remain open for 60 days following bid opening, during which time bids may not be withdrawn.
The bid bond requires a penal sum equal to ten percent of the total bid amount, issued by a surety licensed to conduct business in Pennsylvania. Upon bid acceptance, successful bidders must furnish additional bonds including a warranty bond at ten percent and performance and payment bonds at one hundred percent of the contract price. The contract is subject to multiple regulatory compliance requirements including the Pennsylvania Prevailing Wage Act, Federal OSHA standards, Pennsylvania Act 229 of 2002, the Pennsylvania One Call Act, Pennsylvania Human Relations Act, non-discrimination in employment regulations, and the Public Works Employment Verification Act. Bidders must submit non-collusion affidavits, experience questionnaires, and public works employment verification forms. Wormleysburg Borough reserves the right to accept or reject any or all bids.

Surety waives notice of and any and all defenses based on or arising out of any time extension to issue Notice of Award agreed to in writing by OWNER and Bidder, provided that the total time for issuing Notice of Award including extensions shall not in the aggregate exceed 120 days from Bid due date without Surety's written consent.
