About this file
This Non-Collusion Affidavit document is required by Wormleysburg Borough for both the South Front Street Sewer Lining Project and the 2026 Street Rehab Project in Pennsylvania. The affidavit must be executed by the member, officer, or employee of the bidding firm responsible for making final pricing decisions and submitted with sealed bids prior to the bid opening deadline. For the sewer lining project, bids are due online by 2:00 PM on September 30, 2025, and for the street rehab project, bids are due by 2:00 PM on July 8, 2026. The affidavit certifies that bid prices have been developed independently without consultation or communication with competing bidders, that pricing information has not been disclosed to other potential bidders, and that no complementary or noncompetitive bids have been submitted. The document requires notarization and applies to all bidders, including joint venture partners who must each submit separate affidavits. Failure to submit a completed affidavit in compliance with the instructions will result in bid disqualification.
The affidavit is governed by the Pennsylvania Antibid-Rigging Act (73 P.S. § 1611 et seq) and requires bidders to represent that neither their firm nor its affiliates, subsidiaries, officers, directors, and employees are currently under investigation by any governmental agency or have been convicted or found liable in the past three years for any act involving conspiracy or collusion in public contract bidding. The signatory must examine the affidavit carefully and make diligent inquiry of all firm personnel involved in bid preparation and approval to ensure all statements are true and accurate. Misstatement of the affidavit is treated as fraudulent concealment and may subject bidders to criminal prosecution for bid rigging and efforts to restrain competition. The affidavit materials are provided as blank templates to be completed by bidders and notarized before submission with their respective bid proposals.
