About this file

This is a project manual and standard specifications document prepared by Horrocks Engineers for the Utah Department of Transportation (UDOT) to support construction of maintenance site improvements at a UDOT facility located at 1325 East Highway 90 in Brigham City, Utah. The project encompasses demolition of an existing evaporative pond, wash rack, sander storage rack, and asphalt pavement, followed by construction of new site features including asphalt paving, wash rack, material storage bin, sander storage rack, brine-mixing vault, and brine tank pad. The scope includes earthwork with pond excavation and site re-grading; utility work consisting of stormwater inlets, catch basins, storm drain piping, water supply piping, yard hydrants, sanitary sewer piping and structures; and various hardscape improvements such as curbs, gutters, and waterways. The project manual was issued July 21, 2021, and includes detailed specifications for divisions covering general requirements, site work, concrete, and structural steel. Construction is scheduled for March 2026 with a substantial completion deadline of June 15, 2026. A mandatory virtual pre-bid meeting is scheduled for March 31, 2026, at 2:00 pm, and bids must be submitted electronically through the UP3 system.

The contract will be awarded to the lowest responsive and responsible bidder, with UDOT reserving the right to evaluate contractor responsibility based on past performance on MS4 projects, requiring completion without excessive delays or warranty issues. The awarded contractor must provide performance and payment bonds upon contract execution. The specifications establish detailed measurement and payment procedures for various line items including mobilization, surveying, demolition, earthwork, erosion control, water distribution, sanitary sewer, storm drainage, base course, and asphalt paving, with payment made based on completion percentages and actual quantities. Funding sources and contract pricing details are not specified in this technical specifications document, though general contractual provisions address modifications, substitutions, quality control testing by an Owner-selected Construction Testing Laboratory at no cost to the contractor, and extensive closeout and warranty requirements. The contract incorporates American Public Works Association (APWA) specifications and DFCM General Conditions, with the most stringent requirements applying where conflicts occur.

UDOT Maintenance Site Improvements SECTION 01110 For Construction Brigham City Site July 2021

A. Substantial Completion. In the event that Contractor fails to substantially complete all of the work required herein by the Substantial Completion Deadline described above, then for each partial or complete day during which the work remains uncompleted thereafter, the Contractor agrees to pay UDOT $500 per day for 15 calendar days and $1,000 per day thereafter, which the parties believe, due to the difficulty of actually assessing the damages UDOT will suffer in the event of such a delay, is a fair estimate of the loss UDOT will suffer. The parties agree that the daily liquidated damages provided for herein is reasonable and fair, and is not a penalty. TIME IS OF THE

ESSENCE IN THIS AGREEMENT.

B. Final Acceptance. In the event that the Contractor fails to obtain Final Acceptance as defined in Section 01700 PROJECT CLOSEOUT within 30 days after the Substantial Completion Deadline, the contractor agrees to pay UDOT $500 per day, which the parties believe is a fair estimate of the loss UDOT will suffer. Unless otherwise agreed by UDOT by Change Order, no damages shall become due to Contractor for UDOT-caused delay.

B. A Change Order for delay will generally be accepted for delay so excessive and unreasonable that it is beyond the scope of the Contract or delay attributed to direct, active or willful interference by UDOT. The Change Order must be based upon actual damages sustained by the Contractor which are directly attributed to the delay.
