About this file
This is a Campaign Contribution Disclosure Form for a Request for Proposal issued by the State of New Mexico, Department of Public Safety, for Financial Audit Services. The RFP solicits sealed proposals from Independent Public Accountants (IPAs) to perform annual audits of the Department of Public Safety's financial statements for four fiscal year-ends: June 30, 2027; June 30, 2028; June 30, 2029; and June 30, 2030. Qualified IPAs must be listed on the New Mexico Office of the State Auditor's approved audit firm list and in good standing to be eligible for consideration. The audits must be conducted in accordance with Generally Accepted Governmental Auditing Standards (GAGAS/Yellow Book), Generally Accepted Accounting Principles (GAAP), Governmental Accounting Standards Board (GASB) Statements, CFR 2 Part 200, and the Requirements for Contracting and Conducting Audits of Agencies (2.2.2 NMAC).
Prospective contractors are required to disclose all campaign contributions exceeding two hundred fifty dollars ($250) in the aggregate over the two-year period prior to proposal submission to applicable public officials, specifically the Governor of New Mexico and Lieutenant Governor. The disclosure must identify the contributor, their relation to the prospective contractor, the date and amount of contributions, and their nature and purpose. Prospective contractors who have made no contributions meeting the threshold must submit a signed statement confirming this. The form must be included in all RFP responses and filed by every prospective contractor regardless of contribution history. Failure to submit a fully completed disclosure statement or provision of campaign contributions during the procurement process may result in cancellation of the solicitation or termination of any executed contract.

Pursuant to the Procurement Code, Sections 13-1-28, et seq. A prospective contractor submitting a disclosure statement pursuant to this section who has not contributed to an applicable public official, whose family members have not contributed to an applicable public official or whose representatives have not contributed to an applicable public official shall make a statement that no contribution was made.
A prospective contractor or a family member or representative of the prospective contractor shall not give a campaign contribution or other thing of value to an applicable public official or the applicable public official’s employees during the pendency of the procurement process or during the pendency of negotiations for a sole source or small purchase contract.
Furthermore, a solicitation or proposed award for a proposed contract may be canceled pursuant to Section 13-1-181 NMSA 1978 or a contract that is executed may be ratified or terminated pursuant to Section 13-1-182 NMSA 1978 if a prospective contractor fails to submit a fully completed disclosure statement pursuant to this section; or a prospective contractor or family member or representative of the prospective contractor gives a campaign contribution or other thing of value to an applicable public official or the applicable public official's employees during the pendency of the procurement process.
The state agency or local public body that procures the services or items of tangible personal property shall indicate on the form the name or names of every applicable public official, if any, for which disclosure is required by a prospective contractor.
