About this file
This is an amendment document issued by American Legion Post 673 in Ashley Borough, Luzerne County, Pennsylvania, modifying the terms of a construction contract for a new 3,276 square foot building project. The amendment addresses the time of completion requirements and establishes that the successful bidder must submit a schedule for completion and begin work upon receipt of the Notice to Proceed. The contract specifies that work must be completed within the established contract time frame, with all work subject to liquidated damages provisions.
The liquidated damages have been set at $1,200.00 per day and can only be waived by the Owner (American Legion Post 673 Official) in cases of reasonable or extenuating circumstances that receive formal approval. This amendment clarifies the financial penalties associated with project delays and establishes the circumstances under which such penalties may be relieved, providing clear accountability mechanisms for both the contractor and the project owner.
