About this file
This is a Federally-Funded Projects Procurement Packet issued by Allegheny County Economic Development (ACED) in October 2025, establishing procurement guidelines and compliance requirements for projects funded through CDBG, CVCD, HOME, and HOME-ARP programs. The packet provides comprehensive procedural requirements for operating agencies executing federally-funded construction and professional services projects. Operating agencies must submit multiple documents including prevailing wage rate determinations (valid for 180 days), newspaper advertisements published at least three weeks before bid opening, notifications to five designated Section 3 referral agencies prior to bid advertisement, and records of all prospective and actual bidders. Bid opening procedures vary based on project funding: micro-purchases under $10,000 require no competitive quotes, quotations between $10,000 and $30,000 require three written quotes, sealed bids of $30,000 and above require public advertisement in the Pittsburgh Post-Gazette with public bid opening, and competitive proposals for professional services require three sources. A Notice to Proceed cannot be issued until the operating agency submits a request within ten days of contract award, triggering compliance staff review of bidding procedures and contractor documentation followed by operations staff verification of contract execution and scope alignment.
The packet mandates comprehensive contractor and subcontractor documentation including the Notice to Prime Contractors/Subcontractors, Award Verification Forms (PL3 for prime contractors, PL4 for subcontractors, PL5 for suppliers and professional services over $1,000), Schedule of Subcontractors (due within ten days of award), Agency/Prime/Subcontractor Verification agreements, and Fringe Benefit Letters. All contractors must submit weekly certified payrolls within seven days of the pay period with legally valid electronic signatures including dated timestamps, construction stoppage statements if work halts for six weeks or more, and final schedules of subcontractors upon project completion. Projects exceeding $200,000 in Section 3 assistance require compliance with Section 3 requirements including monthly employment and business utilization reports. The packet incorporates mandatory federal compliance language addressing Davis-Bacon Act prevailing wage requirements, Title VI Civil Rights protections, Executive Orders 11625 and 12138 regarding minority and female business enterprise utilization, Section 504 of the Rehabilitation Act, and Americans with Disabilities Act compliance. Operating agencies and contractors must display federal posters including WH-1321 (Davis-Bacon worker rights), OSHA 3165 (job safety), HUD 901 (equal employment opportunity), and the applicable wage determination at the work site, with all workers entitled to prevailing wages, overtime at time-and-a-half for hours exceeding 40 per week, and protection against retaliation for safety complaints or wage concerns.

Notice to Proceed Process
Effective October 1, 2014, all Operating Agencies are required to request a Notice to Proceed prior to the start of any project. The purpose of this requirement is to ensure that all appropriate Compliance documentation is received within the timeframe stated in the guidelines.
The process is simple; it requires O/A to request a Notice to Proceed, a review is performed by the Compliance and Operations staff, and based upon the review a Notice to Proceed is either issued or denied. The system is designed to work via email to expedite processing requests.
Process:
1. When O/A has awarded the contract (construction) or selected a firm/ vendor (non-construction) it will send a Notice to Proceed request to the Project Manager. This must be completed no more than ten (10) days after contract is awarded. Ideally this should be done via email however; it can be done via fax or mail.
2. The Project Manager gives the request to the appropriate Compliance staff person for review. Again, this should be done via email (simply forward the email to the Compliance staff person).
3. Upon receipt, Compliance staff will review the project to determine if all appropriate documentation has been received and will forward the request to Operations staff for their review. If all documents are received and correct, then a Notice to Proceed will be issued. If documentation is missing or incorrect the request will be denied. Compliance staff response will be via email to the Project Manager with copies to the Division Manager and Operating Agency.
THIS PROCESS WILL ONLY APPLY TO FEDERALLY-FUNDED PROJECTS.
Compliance staff will be reviewing:
Bidding procedure Contractor documentation (Schedule of Subs, Agreements, etc…)
Operations staff will be reviewing:
Contract execution status

While use of Form WH-347 itself is op. onal, covered contractors and subcontractors performing work on Federal or federally assisted construc on contracts are required by the DBRA regula ons and the contract clauses to submit payroll informa on on a weekly basis. The Copeland Act (40 U.S.C. § 3145) requires contractors and subcontractors performing work on Federal or federally financed construc on contracts to, on a weekly basis, “furnish a statement on the wages paid each employee during the prior week.” U.S. Department of Labor (DOL) Regula ons at 29 C.F.R. § 5.5(a)(3)(ii) require contractors and subcontractors to submit weekly cer fied payrolls to the appropriate Federal agency if the agency is a party to the contract (or, if the agency is not such a party, to the applicant, sponsor, owner, or other en ty, as the case may be, that maintains such records, for transmission to the Federal agency). Each cer fied payroll must be accompanied by a signed “Statement of Compliance” (e.g., page 2 of the WH-347 or another document with iden cal wording) indica ng that the cer fied payrolls are accurate and complete, and that each laborer or mechanic has been paid not less than the required Davis-Bacon prevailing wage rate(s) (including any fringe benefits) for the work performed. DOL and contrac ng agencies receiving this informa on review the informa on to determine whether workers have received legally required wages and fringe benefits.
Public Burden Statement We esti ate that it will take an average of 55 minutes to complete this collecti n, including me for reviewing instructi ns, searching exis ng data sources, gathering and maintaining the data needed, and comple ng and reviewing the collec on of informa on. If you have any comments regarding these es mates or any other aspect of this collec on, including sugges ons for reducing this burden, send them to the Administrator, Wage and Hour Division, U.S. Department of Labor, Room S3502, 200 Cons tu on Avenue, N.W. Title VII of the Civil Rights Act of 1964, as amended, protects applicants and employees from discrimination in hiring, promotion, discharge, pay, fringe benefits, job training, classification, referral, and other aspects of employment, on the basis of race, color, religion, sex (including pregnancy), or national origin. Religious discrimination includes failing to reasonably accommodate an employee’s religious practices where the accommodation does not impose undue hardship.
DISABILITY
Title I and Title V of the Americans with Disabilities Act of 1990, as amended, protect qualified individuals from discrimination on the basis of disability in hiring, promotion, discharge, pay, fringe benefits, job training, classification, referral, and other aspects of employment. Disability discrimination includes not making reasonable accommodation to the known physical or mental limitations of an otherwise qualified individual with a disability who is an applicant or employee, barring undue hardship.
AGE
The Age Discrimination in Employment Act of 1967, as amended, protects applicants and employees 40 years of age or older from discrimination based on age in hiring, promotion, discharge, pay, fringe benefits, job training, classification, referral, and other aspects of employment.
SEX (WAGES)
In addition to sex discrimination prohibited by Title VII of the Civil Rights Act, as amended, the Equal Pay Act of 1963, as amended, prohibits sex discrimination in the payment of wages to women and men performing substantially equal work, in jobs that require equal skill, effort, and responsibility, under similar working conditions, in the same establishment.
