About this file

This document is a comprehensive procurement compliance package from the Quaker Valley Council of Governments (QVCOG) and Allegheny County Economic Development for federally-funded projects, containing detailed instructions and forms for contractors bidding on construction and service contracts. The instructions cover electronic bid submission through PennBid.net, requiring contractors to follow specific community specifications, provide bid bonds of 10% of the bid amount, and maintain bid firmness for 90 days. Successful bidders must furnish performance and labor bonds for 100% of the contract price, provide a two-year maintenance bond, and submit certificates of insurance with minimum coverage levels including $1,000,000 for automobile and general liability and $500,000 for workers' compensation.

The procurement package includes multiple compliance forms mandated by federal funding requirements, such as Affirmative Action/MWBE Certification, M/W/DBE/VOSB Solicitation statements, and payroll documentation. The project is partially funded through the U.S. Department of Housing and Urban Development (HUD), which necessitates compliance with federal statutes, including weekly payroll reporting, Davis-Bacon Act wage requirements, and specific minority and veteran-owned business participation goals. Contractors must register in the System for Award Management (SAM) to obtain a Unique Entity Identification Number, and the bid award is contingent upon HUD fund release. The documentation emphasizes good faith efforts to meet contract goals of 13% Minority Business Enterprise (MBE), 2% Women Business Enterprise (WBE), and 5% Veteran-Owned Small Business (VOSB) participation.

SAM.gov or call 1-866-606-8220 for further information. The UEID number must be renewed on a yearly basis. Proof of registration is mandatory, to be considered for funding.

SPECIAL NOTICE TO BIDDERS

Although QVCOG is the official signatory to the contract with the successful bidder (contractor), QVCOG is acting as agent for the municipality in soliciting this proposal, awarding the contract and monitoring contract performance. All work must be performed to the satisfaction of the subject municipality. Any construction problems or disputes must be resolved by the contractor and the municipality. All requests for payment must be processed through the municipality. No payments will be made unless first approved by the municipality. Although all payments will be made through the QVCOG office, QVCOG will be directly responsible only for that share of the project being paid from Community Development Funds. Any and all portions of the project payable by the municipality cannot and will not be paid until those funds are received from the municipality. Payment from Allegheny County Economic Development Funds will take 4 to 8 weeks from the time it is processed from the QVCOG office. When submitting payment requests, the contractor should, therefore, anticipate the approval time required by the municipality and the processing time required by the County.

While completion of Form WH-347 is optional, it is mandatory for covered contractors and subcontractors performing work on Federally financed or assisted construction contracts to respond to the information collection contained in 29 C.F.R. §§ 3.3, 5.5(a). The Copeland Act (40 U.S.C. § 3145) contractors and subcontractors performing work on Federally financed or assisted construction contracts to "furnish weekly a statement with respect to the wages paid each employee during the preceding week." U.S. Department of Labor (DOL) regulations at 29 C.F.R. § 5.5(a)(3)(ii) require contractors to submit weekly a copy of all payrolls to the Federal agency contracting for or financing the construction project, accompanied by a signed "Statement of Compliance" indicating that the payrolls are correct and complete and that each laborer or mechanic has been paid not less than the proper Davis-Bacon prevailing wage rate for the work performed. DOL and federal contracting agencies receiving this information review the information to determine that employees have received legally required wages and fringe benefits.

Public Burden Statement

We estimate that is will take an average of 55 minutes to complete this collection, including time for reviewing instructions, searching existing data sources, gathering and maintaining the data needed, and completing and reviewing the collection of information. If you have any comments regarding these estimates or any other aspect of this collection, including suggestions for reducing this burden, send them to the Administrator, Wage and Hour Division, U.S. Department of Labor, Room S3502, 200 Constitution Avenue, N.W.
