Statement of Work (SOW)

1 INTRODUCTION
This is a non-personal services contract to provide Demolition and Renovation services to the Federal Communications Commission (FCC) Vero Beach, Florida (FL) Field Office Location.
2 BACKGROUND
The FCC, an independent agency of the United States Government established by the Communications Act of 1934, is charged with regulating non-Government interstate and international communications by radio, television, wire, satellite, and cable. The FCC’s jurisdiction covers the 50 states, the District of Columbia (DC), and U.S. possessions.
The FCC is led by a Chair and up to four Commissioners appointed by the President with the advice and consent of the U.S. Senate. The Commission staff is organized into seven (7) Bureaus (including the Enforcement Bureau (EB)), several offices (including OMD and the Offices of Engineering and Technology (OET), Strategic Planning & Policy (OSP), and General Counsel), and numerous field offices (including the Vero Beach, FL Field Office).
3 OBJECTIVES
The FCC’s objective is to obtain construction support at the FCC’s Vero Beach (FL) Field Office location focused on buildings and structures in the contract work area shown in figure 1. The objective of this project is to 1) Renovate the main building and garage as shown in figure 2 below.
2) Demolish the Old Transmitter Building, as shown in figure 3. 3) Remove the incinerator, diesel pump, underground propane tank, irrigation well and pump and two downed VHF and UHF towers located shown in figure 4. 4) Defoliate, fill cracks, seal, restripe, approximately 13,500 square feet of the parking lot and mark to match existing parking spots as shown in figure 5. Cut back tree branches, remove trees, grind stump, clear debris, defoliate, fill cracks, and resurface main driveway, as shown in figure 6.

Physical Descriptions of Relevant Buildings:
The main building is approximately 2,434 square feet, one-story, typical office style building with shingles that is connected via a breezeway with a garage that is 1,990 square feet giving a total of 4,424 square foot building; windows with hurricane shutters, a flagpole and palm trees that line up in the front of the parking lot. Down the driveway from the main entrance of the property are overarching trees that cover over the driveway. The main building consists of a first floor with a full kitchen, one full bathroom, and one-half bathroom. A breezeway connects the main building to the garage which includes a generator room, attic, and a storage room. The transmitter building is a 56 square foot building North of the main building and still has power that feeds to it.
The main office building is approximately 2,434 sq ft and the garage is approximately 1,990 sq ft giving a combined total of 4,424 sq ft.

4 SCOPE OF SERVICES
All work performed on this project shall be done in accordance with applicable State, Federal, and municipal regulations, and laws. The scope of contract encompasses the following construction support service areas:
a. Renovation
b. Demolition
c. Rehabilitation of the parking lot
d. Resurface driveway
e. Tree trimming and debris disposal (Appendix 1).
5 GENERAL INFORMATION
5.1 TYPE OF CONTRACT
The Government will award a firm-fixed-price (FFP) contract.
5.2 PERIOD OF PERFORMANCE
The period of performance shall be for six (6) months from notice to proceed. An additional six
(6) month (unfunded) option will be in place to allow for unforeseen delays. Period and priority of tasks to be determined at site visit.
5.3 PLACE OF PERFORMANCE
The services are to be provided at the FCC’s Vero Beach Florida Field Office at 255 154th avenue Vero Beach, Florida 32966. The specific location of the main building, garage, and old transmitter building can be seen in the satellite image found in figure 1.
5.4 HOURS OF OPERATION
All work shall be coordinated through the COR or COR’s point of contact.
5.4.1 RECOGNIZED HOLIDAYS
Unless expressly required in this SOW or directed by the Contracting Officer (CO), the Contractor shall not perform services on federal holidays, which include:
New Year’s Day Labor Day Martin Luther King Jr.’s Birthday Columbus Day Washington’s Birthday Veteran’s Day Memorial Day Juneteenth Day Thanksgiving Day Independence Day Christmas Day
In addition, Inauguration Day is a recognized Federal holiday in the Washington, D.C. area every four years as provided under 5 U.S.C. § 6103(c).
5.5 SECURITY REQUIREMENTS
Contractor personnel shall be able to obtain, and maintain throughout the life of the contract, a public trust position. See clause LOCAL-1 Security Requirements Suitability and Security Processing.
5.6 GOVERNMENT-FURNISHED PROPERTY AND EQUIPMENT
None.
5.7 CONTRACTOR-FURNISHED PROPERTY
All supplies, equipment, services, and other items that the Contractor requires to perform the work under this contract are the responsibility of the Contractor and shall be at the Contractor’s expense. Porta John is required as the facility cannot be used.
The Contractor shall clearly delineate all proposed supplies to support this effort in their price/technical proposal.
6 PERFORMANCE REQUIREMENTS
The Contractor is responsible for providing all labor, materials, transportation, supervision, tools, equipment, and expertise necessary to execute the required scope at the Vero Beach FL location.
The Contractor shall perform a site visit and attend a preconstruction conference or other review meetings necessary to support demolition/construction activities. In particular, note available access to the site, any existing overhead obstacles that may present problems or concerns related to the completion of this work, potential working location for equipment, etc. The planned activities associated with this work must have a minimal impact to the ongoing activities. The Contractor shall support meetings and/or teleconferences to discuss technical or regulatory issues and project progress and status. The Contractor is required to notify the CO and COR of critical issues that may affect the contract performance and/or human health and the environment. The Contractor shall apply for and obtain all Federal, State, and local, and other applicable permits, licenses, and certificates required to perform and execute this contract. The Contractor shall maintain a library of these documents at the Contractor’s site office. The Contractor shall comply with all applicable permit conditions.
6.1 TASK AREA 1 (PLANNING/SURVEYING)
6.1.1 PROJECT MANAGEMENT PLAN
Prepare a project management plan with an overarching project schedule based on the required work which shows the intended sequence of activities, milestones, and expected project completion. The project management plan shall, at a minimum, include a safety plan, Hazardous Waste abatement/disposal plan, Soil erosion and sediment control plan, and Storm Water Pollution Prevention Plan (SWPPP).
As such, the work outlined in the SOW and performance requirements are crucial to the ongoing FCC Field Office mission. Therefore, it is crucial that the Contractor work closely with the government to ensure that the organizational objectives are accomplished throughout the period of this contract. It is also imperative that the Contractor’s staff provide superior customer service, in a spirit of cooperation and accompanied by uniformly positive attitudes.
The Contractor shall obtain and maintain all applicable state and municipal licenses, bonds, insurance, and permits required in order to perform all the services required under the contract.
The Contractor shall provide copies of all licenses, insurance, and permits to the CO and COR and shall be in place three (3) calendar days prior to work commencing.
6.1.2 HAZARDOUS MATERIALS (HBM):
Based upon the age of the site and buildings, hazardous materials may exist at the job site. It is the responsibility of the vendor to conduct the appropriate HBM surveys based upon site conditions to identify if building materials and components at the site require special handling and/or disposal. If the results of surveys identify the presence of hazardous materials, the vendor shall provide the FCC a report that includes the test results, an abatement plan, updated schedule, and cost proposal to remediate all hazardous materials according to local, state, and federal laws prior to work execution. After receiving the hazardous materials report, the FCC will review and provide approval to proceed along with any contract modification required to vendor (awardee).
6.2 TASK AREA 2
6.2.1 DRIVEWAY CLEANUP
• Repair and convert light pole at front gate to dusk to dawn LED light.
• Remove old gate motor next to front gate.
• Remove pedestal mount by front gate.
• Prune/trim tree branches that cover/hover over driveway back 6 feet from edge of driveway. Tree branches shall be no lower than 16 feet from the ground to allow box truck and/or semi-truck through. Debris/vegetation shall be pushed back to main tree line minimum 25 feet from driveway. Tree branches to go to designated tree debris area identified in appendix 1.
• Prune/trim tree branches that cover/hover over driveway. Tree branches shall be no lower than 16 feet from the ground. Tree branches to go to designated tree debris area. Foliage and debris on pond side shall be cleared all the way to the pond.
• Trees that have been marked with an orange “X” and numbered 1-6 (see appendix 1) shall be cut, removed, and stump grinded (x6).
• Remove mailbox.
• Push back tree and debris to main tree line minimum back 25 feet that surrounds light pole next to main building and flagpole. Convert the light pole to dusk to dawn LED light.
• Defoliate, fill cracks, and resurface main driveway.
6.2.2 RENOVATE MAIN BUILDING EXTERIOR AND INTERIOR
• Paint main building exterior and interior of breezeway area to match existing color with a minimum of two coats of paint.
• Inspect roof for any leaks.
• Replace no more than 200 SF of only compromised insulation from leak. Expect to replace the insulation due to contamination from leak.
• Remove and replace roof with gray shingles (minimum 50-year architect shingles).
• Inspect roof deck to determine condition and replace sheeting and/or wood as necessary.
• Gutters and downspouts, gutter covers and any replacement of damaged wood/facia shall be included.
• Decommission (pull and cap) irrigation sprinkler heads that surround the main building.
• Cut back debris that surrounds irrigation well.
• Cap irrigation well, remove pump and replace with a power pedestal 36” minimum height and a 110v 30-amp service.
• Remove and replace HVAC with new equivalent system and install new condensate lines as needed.
• Existing smoke duct detectors shall be replaced.
• Replace front of main building outdoor non-LED light (next to flagpole) with dusk to dawn double/triple LED lights (x1). Match with the three (3) LED lights on right side of building. See appendix 1.
• Replace garage side main building outdoor solar non-LED light with dusk to dawn double/triple LED lights (x2). Match with the three (3) LED lights on opposite side of garage. See appendix 1.
• Defoliate, fill cracks, seal, restripe, approximately 13,500 square feet of the parking lot and mark to match existing parking spots.
• Remove palm trees that are marked with an orange “X” and numbered 7-11 that are next to the parking lot and water well, grind stump (x5). See appendix 1.
• Remove tree next to main building and palm trees that surround incinerator that are marked with an orange “X” and numbered 12, 13, and 14 (x3). See appendix 1.
• Remove palm tree that is marked with an orange “X” and numbered 15 (x1) and move debris that surrounds the antenna pole behind main building to designated vegetation and tree debris area. See appendix 1.
• Cut any foliage/debris that surround downed towers behind main building to provide access. Move foliage/debris to designated vegetation and tree debris area. Downed towers and bases remove off property.
• Remove incinerator, concrete pad, and bollards.
• Underground propane tank that the incinerator feeds and it’s fuel source shall be removed. The manhole for the propane tank is marked with an orange “X”.
• Diesel pump, concrete pad, bollards, and small tree that surrounds pump between the incinerator and main building shall be removed and capped. Pump is marked with an orange “X”.
• Emergency cut off pump on the back side of building shall be removed and capped.
• All trees that are hanging over circular driveway shall be cut back 6 to 8 feet from driveway and 16 feet vertically from the driveway to allow box truck and/or semi to pass through.
• Trim branches that is next to slanted light pole vertically and horizontally, minimum 6 to 8 feet and 16 feet vertically from the driveway. Straighten slanted light pole and convert light to dusk to dawn LED.
• Convert double fixture light pole to dusk to dawn LED.
• All garage doors are to be serviced and motors removed and replaced that meet or exceed existing equipment with two remotes per door opener.
• All hurricane shutters shall be checked, serviced, and header painted to match with exterior paint (x15).
• Remove various materials and containers from storage room in garage.
• Remove and dispose of lockers that are in breezeway.
• Paint breezeway with matching paint of exterior building.
• Remove and replace faucets in bathrooms (x2).
• Remove and replace the shower head located in full bathroom.
• Remove and cap water fountain located in the kitchen.
• Clear clogged shop sink located in garage and clear clogged kitchen sink in main building.
• Refasten outer corner trim that is across from the kitchen doorway.
• Remove all carpet and replace with carpet tiles. Carpet tiles are to match main building neutral color or equivalent. Proposed carpet tiles shall have equivalent quality, construction, and performance as Mohawk Group “Learn and Live” or “Expedition” collections. Furniture removal to install carpet shall be coordinated.
• Replace all ceiling tiles to match main building tiles or equivalent.
• Repair, and prep for paint damaged drywall in utility closet next to water heater.
• The lights located in the director’s office (x6) shall be changed to LED and match existing LED lights lumen and color temperature in rest of main building.
6.2.3 DEMOLISH OLD TRANSMITTER BUILDING
The Contractor shall empty the transmitter building of any remaining contents and properly dispose of those items:
• Plan and execute the demolition of walls and roof of the transmitter building.
• Provide demolition progress images (Google Earth, etc.) with weekly updates.
• Power and concrete slab is to remain in place to allow for power pedestal 36” minimum height and a 110v 30-amp service.
6.2.4 SITE RESTORATION AND RENOVATION:
The Contractor shall prepare images (Google Earth, etc.) and specifications to restore the sites to “pre-construction” conditions. This shall include storm water management, topsoil, and vegetation to prevent erosion.
In supporting this effort, the Contractor shall, if applicable:
• Provide a rough image (Google Earth, etc.) of site prior to completion of Work to outline areas that were impacted by the work performed by the Contractor. Care should be exercised to mitigate damage to trees and other significant vegetation on site during the work activities.
• Straw and reseed all areas to match existing grass areas.
6.2.5 DISPOSAL:
• The Contractor shall ensure construction debris is separated and disposed of in accordance with all Local, State, and Federal guidelines. Disposal fees are the responsibility of the Contractor. In supporting this effort, the Contractor shall:
o Ensure concrete and metal materials are hauled to a recycler if applicable.
o Dispose of any universal wastes (fluorescent bulbs, ballasts, mercury switches), hazardous wastes as identified, and environmental waste per Contractor’s disposal plan. All waste streams will be disposed of in accordance with all Local, State, and Federal guidelines. Performance Standard: A signed receipt by the disposal site operator will be returned to the COR within thirty (30) days of disposal. The receipt will indicate the date of receipt, and the quantity of material received. The receipt will also indicate the condition of the materials as delivered to the landfill and the location where the debris will finally rest.
o Execute and maintain the practice of removing and legally disposing offsite all construction debris from site as soon as possible while work is ongoing. Do not allow items and debris to accumulate excessively before disposal.
o Remove and transport all debris in a manner that prevents spillage on streets or adjacent areas. State and local regulations regarding hauling and disposal shall apply.
o Ensure measurement for all eligible debris removed shall be by the cubic yard and/or tons and supported by the load ticket.
o Completely clean site of any remaining construction debris. Leave premises clean and free of waste, scrap, used equipment, or other material intentionally or incidentally delivered to the site by Contractor or Contractor’s personnel.
o Be aware that the use of burning at the project site for demolition or the disposal of refuse and debris will not be permitted.
6.3 INSPECTION AND ACCEPTANCE
All services rendered to the FCC will be inspected and accepted by the COR or designated representative. Payment for completed services will only be made after the COR accepts the services rendered. After the COR inspects and accepts all required services the Contractor shall submit the invoice so it can be processed for payment within thirty days.
7 PERSONNEL REQUIREMENTS
7.1 GENERAL PERSONNEL REQUIREMENTS
The Contractor shall submit a personnel list to the FCC Security Office and the COR on the first working day of each month. This report shall list all Contractor and subcontractor personnel working at the FCC under all current contract order.
7.1.1 EMPLOYEE SCREENING
The Contractor shall screen all employees and perform background checks on all employees, agents, and subcontractors prior to sending them to work for FCC.
7.1.2 ADEQUATE PERSONNEL
The Contractor shall provide sufficient personnel, both in number and qualifications to perform all the necessary work.
7.1.3 OVERSIGHT OF CONTRACTOR PERSONNEL
The Contractor shall provide sufficient oversight to ensure that all Contractor personnel are functioning in accordance with their assigned duties and at acceptable levels of professional performance; all activities are performed in accordance with contract requirements; and all positions are filled promptly and kept filled with qualified, competent, and trained personnel.
The Contractor shall be responsible for the activities of all Contractor personnel and, if applicable, subcontractor personnel.
7.2 REMOVAL OF CONTRACTOR PERSONNEL
If the FCC finds a Contractor prospective employee to be unsuitable or unfit for duties under the terms and conditions of the contract, the Contractor will be advised immediately that such employee can no longer work under this contract. The Contractor shall remove the employee from performing any work under this contract the same business day that it receives notification from the FCC.
8 DELIVERABLES
All deliverables shall become the property of the FCC and shall not be released by the Contractor or its employees, agents, or assigns to any party outside the FCC. Each service deliverable shall be submitted in electronic format using Microsoft Word and/or PDF. The Contractor is responsible for preparing, reviewing, and indexing documents supporting the required deliverables. All documents shall be reviewed and approved by the COR or designated contact.
8.1 DELIVERABLE FORMAT
The Contractor shall generate, distribute, and maintain the Reports identified below. The Contractor shall submit proposed report formats to the COR for review, remarks, or approval within five (5) calendar days after contract award. The COR will provide a response on revised proposed report formats to the Contractor within five (5) calendar days from receipt. The deliverable documentation is a one-time submission.
Deliverables identified in the table below are reports prepared by the Contractor to reflect Contractor activities and presented to the Government for quality assurance purposes.
Government personnel will review the materials presented and evaluate them for accuracy and completeness. Delivery is stated in Table 3 below. Format will be as proposed by the Contractor and approved by the Government unless otherwise directed in this SOW.
8.2 KICKOFF MEETING AND AGENDA
An initial meeting shall be held with the COR and/or designated contact and the OMD staff to discuss project planning, execution, and contractual matters within seven (7) calendar days after contract award. To facilitate initial project planning, the vendor shall provide a draft high-level project schedule to discuss during the meeting.
8.3 WEEKLY STATUS REPORT
A weekly status report shall be submitted to the COR no later than 4 p.m. Eastern Time on the last working day of each week. The Contractor shall consult with the COR or designated contact on the format of the report. The report shall include at a minimum:
a. Current contract, deliverable, and services rendered status
b. Progress images
c. Work Scheduled verses Work Actually Completed
d. Explanation of any variance in work scheduled but not completed
e. Budgeted Cost of Work Performed verses Actual Cost of Work Performed
f. Explanation of any variance in cost budgeted and actual cost to perform the work.
g. List of all Contractor and subcontractor personnel working at the FCC under contract in the previous and upcoming week.
8.4 DELIVERABLES TABLE
